About this file
This document is a Questions and Answers clarification for RFP 80GSFC26R0028 regarding NASA's Sounder for Microwave-Based Applications (SMBA) contract. The file does not address specific products or services required, but rather clarifies contractual payment terms and cost allocation between two Contract Line Item Numbers (CLINs).
Question 13 addresses payment milestone timing, specifically whether the final 7% Performance-Based Payment (PBP) for each instrument is due upon successful completion of on-orbit commissioning and demonstration (satisfying 2009 and 2017 Milestone events in Attachment O), or deferred until the end of the five-year mission life. The Government confirmed that payment milestones 2009 and 2017 must be completed during the on-orbit commissioning timeframe, with the associated 7% payment becoming due at that time rather than at mission end.
Question 14 clarifies cost responsibility between CLIN 0001 (parts procurement for Flight Models 1-3) and CLIN 0002 (production through Bench Acceptance Test for Flight Models 2-3 at the contractor's facility). The Government established that all parts procurement costs, including rework and replacements for defective parts discovered during assembly or testing, will be charged to CLIN 0001. Conversely, all non-parts-related costs arising from contractor mishandling, production errors, assembly defects, or integration issues associated with Flight Models 2 and 3 will be charged to CLIN 0002.

Near Earth Orbit Network’s
Sounder for Microwave-Based Applications
Request for Proposal 80GSFC26R0028
Questions and Answers 13 and 14
Below are questions and answers related to the Sounder for Microwave-Based Applications (SMBA) Request for Proposal (RFP) 80GSFC26R0028. In the event of any discrepancy, the RFP provisions and contract terms (including all amendments) will take precedence.
13. Our understanding is that successful completion of on-orbit commissioning and demonstration meets the on-orbit performance requirements satisfying the 2009 and 2017 Milestone events in Attachment O, and that the associated 7% payment for each instrument becomes due at that time.
a. Could you please confirm that this understanding is correct, and that NASA does not intend to defer the final 7% PBP until the end of the five-year mission life?
Government Response: The Government expects the contractor to complete payment milestones 2009 and 2017 along with the associated completion criteria during the timeframe of on-orbit commissioning, not the end of the five-year mission life.
14. CLIN 0001 encompasses the procurement of parts for Flight Models 1-3, while CLIN 0002 covers the Production through Bench Acceptance Test (BAT) for Flight Models 2 and 3 at the Contractor’s facility. Regarding the delineation of cost responsibility between these CLINs, the Government’s clarification is requested on the following scenarios:
a. Should any parts procured under CLIN 0001 later be found to be defective (e.g., latent defects not discoverable upon receipt/inspection) during assembly or testing under CLIN 0002 would the issues be addressed under CLIN 0001 cost-reimbursable effort (including any replacement parts, rework, or recovery actions directly related to the defective part itself)?
Government Response: All parts procurement costs, including re-work or replacements, will occur under CLIN 0001.
b. Conversely, should any costs arising from contractor mishandling, production errors, assembly defects, or integration issues under CLIN 0002 be the contractor’s responsibility under CLIN 0002?
Government Response: All non-parts-related costs associated with Flight Models 2 and 3 will occur under CLIN 0002.
