About this file

This is Amendment 3 to solicitation 47PH0825R0007, issued January 29, 2026, providing government responses to 192 Requests for Information (RFIs) and revisions to the Agreement, Solicitation, and Scope of Work for a Design-Build contract to repair and replace pavement at the Santa Teresa Land Port of Entry in Santa Teresa, New Mexico. The amendment extends the proposal due date to February 6, 2026, at 12:00 p.m. Central Time, with submissions to ashley.morgan@gsa.gov. Key clarifications address: (1) New Mexico construction licensing requirements—bidders may bid without a license but must obtain appropriate licensing upon becoming apparent successful bidder; (2) NMDOT standards shall be the Basis of Design with specific requirements for HMAC base (TY-B, PG 70-22) and cement-treated subgrade; (3) professional liability insurance of $500,000 per claim required for design professionals; (4) option exercise window extended from 90 days to 180 calendar days post-award; (5) CLINs 10, 11, and 12 are not options and overhead, profit, bond, and insurance are not all-inclusive across base and options; (6) low embodied carbon material requirements removed; and (7) pavement marking of approximately 4,800 linear feet required with temporary signage for detours and lane closures.

The statement of work encompasses approximately 202,455 square feet of pavement repair and replacement involving complete reconstruction (8" to 13" concrete), surface reconstruction, joint sealing, patching, and utility relocation as needed. The DB Contractor must provide design services including three design review submittals (65%, 95%, final CD/IFC) with 14-calendar-day government review cycles, and construction services with phasing plans to maintain port operations during work. Critical scheduling constraints include: no more than 50% of lanes closed at any given time, coordination with U.S. Customs and Border Protection for lane closures and operational impacts, and substantial completion within 180 calendar days of each construction Notice to Proceed (335 days total if all options awarded at contract award). The contract is a firm-fixed-price, small business set-aside with estimated value between $5 million and $10 million, requiring performance and payment bonds, comprehensive general liability insurance ($500,000 per occurrence), automobile liability coverage, and workers' compensation. The government will conduct design reviews and maintain GSA oversight throughout both design and construction phases using the Kahua project management information system.

Santa Teresa Solicitation # 47PH0825R0007 January 29, 2026 RFI # RFI/Question GSA Response 1 Please provide a copy of the sign-in sheet/list of attendees for the pre-proposal site Issued with Amendment #1 on 1/9/26

2 Does the General Contractor and/or Subcontractors require State of New Mexico Construction License? – If yes, what is the Specific Classification of Work License required from the State of New Mexico?

a. The Construction Industries Licensing Act of the State of New Mexico states that “Any contractor may bid on a New Mexico highway project and shall upon becoming the apparent successful bidder apply to the division for a license. In other words, a successful bidder must then apply for and earn the appropriate license before beginning work, but need not do so before entering a bid (only on Federally funded highway projects)”. New Mexico Business & Law Course, AYPO, p. 24/366.

While NM law requires licensing to work, Construction Industries Licensing Act (CILA) explicitly allows that "Any contractor may bid on a New Mexico highway project involving the expenditure of federal funds prior to making application to the division for a license." However, the contractor must, upon becoming the apparent successful bidder, apply for and obtain the necessary license before beginning work. Since licensing is governed by the state of NM, offerors will need to consult state law for the applicable classification.

3 What Municipality or County from the State of New Mexico does this project belong to? This information is needed to determine Tax Rate.

Santa Teresa, New Mexico (Dona Ana County)

4 Are there Previous Traffic Counts available? Per information provided by CBP on January 8th, 2025, the LPOE processes approximately 750 commercial vehicles and 1,900 POV's per day.

5 Are there any As-builds Drawings available for previous construction?

– We would like to identify possible underground utilities to plan relocation of these exiting facilities if needed.

Some drawings are available. In order for a contractor to obtain a copy of the drawings, the contractor shall establish a GACA account and submit the Controlled Unclassified Information Document Security Notice to the Contracting Officer prior to the government releasing the drawings.

Instructions are provided in Amendment 1. This answer replaces answer to question 4. included in Amendment 01.

6 Would the Basis of Design (Standards and Design Criteria) be based on Texas Department of Transportation and/or New Mexico Department of Transportation Standard Specifications for Construction and Maintenance of Highways, Streets and Bridges

(TXDOT/NMDOT)?

Basis of Design shall be NMDOT

7 Would GSA accept a Value Engineering (Systematic Approach) of Short-Slab Design and/or Pavement Panels with Optimized Geometry and Fiber Reinforced? Following ACI 330.2R-17 Guide for the Design and Construction of Concrete Site Paving or Industrial and Trucking Facilities. This approach will enhance the value of construction by Function, Performance and Quality over the cost.

The Government would accept the design submissions for our review and comment

8 Statement of Work – Page 10 of 46 Construction Option No. 3 has a Surface Reconstruction 11” CRCP NMDOT; the SOW does not mention any subgrade stabilization with 5% cement nor HMAC base for option No. 3. Please confirm these items need to be excluded.

Install 4" HMAC base (TY-B, PG 70-22) Treat 8" of subgrade (5% cement)

9 Statement of Work – Page 11 of 46 Construction Option No. 6 has a Surface Reconstruction 11” CRCP NMDOT;

the SOW does not mention any subgrade stabilization with 5% cement nor HMAC base for option No. 6. Please confirm these items need to be excluded.

Install 4" HMAC base (TY-B, PG 70-22) Treat 8" of subgrade (5% cement)

10 Do we need to include Professional Liability Coverage with Errors and Omissions for the Desing portion of the Contract? – The Agreement, III.E. Insurance Requirements (p.8 of 36) does not mention Professional Liability Coverage.

The Agreement will be updated to state: (2) The Contractor shall require that the licensed design professionals it retains for the Project acquire and maintain professional liability insurance in the amount of $500,000 per claim and shall provide proof to the Contracting Officer.

11 Would the Govt accept unit pricing for this work? No. Refer to updated pricing sheet 12 Will the options be exercised within 90 days of Contract award as stated in paragraph (4) Options of Section II. Prices, II.A. Basis of Pricing on page 7 of 36 of the AGREEMENT included in the RFP?

The Agreement will be updated to state: Unless otherwise specified, all options may be exercised within 180 calendar days of Contract award.

13 Note 2 on page 5 of 36 partially states “Depending on when the Government exercises each construction NTP, the substantial completion date of this contract may exceed 335 calendar days”. How will the general contractor be compensated for this additional time should the government extend the period of performance due to the timing of option award?

Unless the Government exercises each option at time of award, each option period of performance is severable. Therefore, the period of performance (time) to complete the work (180 calendar days) for the option should be included in the option price.

14 Will CLIN’s 0010, 0011, and 0012 be options? Will they be inclusive of all Options? If the answer is yes, how will this process work should the government only award selective Options?

CLINS 10, 11 & 12 are not options. See updated pricing sheet.

15 If the government removes the Low Embodied Carbon Materials (concrete, asphalt, and steel) requirement, will it still be necessary to provide the individual CLIN item breakdowns (quantity and cost) for concrete, asphalt, and steel on each CLIN?

No. Reference updated pricing sheet

16 Referring to the CLIN schedule, will the Overhead, Profit, Bond, and Insurance values requested be all-inclusive of the Base Bid plus all Options? If the answer is yes, how will the process work should the government only award the Base Bid for design and/or selective Options?

No. Reference updated pricing sheet

17 As the prime contractor, will it be permitted to submit a past performance/past experience project performed by the engineering team we intend to use for this project as part of our proposal submission?

Yes. However, in order for the past performance/past expereince to be considered, a teaming arrangement will need to be submitted with the proposal identifying the Prime Contractor and subcontractor to whom the experience is submited for in order for the past performance/past expereince to be considered. Offerors should also consider Factor 3 in which an org chart shall demonstrate the proposed team. The teaming arrangement will not count against the page limit as it shall be submitted with the Price Proposal.

The government does not anticipate the relocation of utilities.

68 Per the CBS Submittal Matrix, seeking information on whether a National Historical Preservation Act (NHPA) Section 106 consultation has already identified specific “preservation zones” or high-risk areas during ground disturbance.

No preservation zones or high risk areas have been identified.

69 Requesting any existing assessment of hazardous materials on-site that might impact selective demolition or excavations.

There are no known or documented hazardous materials onsite that may impact demolition/excavation activities.

70 Is there a specific CBP Land Port of Entry design guide that supersedes or supplements the GSA P-100 standards for this project?

P-100 is not referenced in the SOW and is no longer in use.

71 The matrix requires at least two HVAC design alternatives and an Energy Usage Model. Clarification is needed on whether these apply to the roadway improvement project or if they are boilerplate requirements from the 2025 Interim Core Building Standards that may be marked N/A for this specific civil-heavy scope.

Only submittals applicable to the SOW will be addressed.

72 Specification 01 14 00 Paragraph 1.1, Section B; Subsection 15:

Permits, states to refer to FAR 52.236-7. This FAR dictates that all required permits are to be at no cost to the Government. What are the required or anticipated permits for this project?

There are no permits required for this project.

73 Spec 01 14 00 Paragraph 1.2 Section A states to “Cooperate with the GSA’s and CBP’s representatives during construction operations to minimize conflicts, mitigate noise...” Is there a noise threshold in decibels that work is to be under to be determined “noisy” and must be performed during Government Unoccupied Hours?

Refer to OSHA requirements for decibel requirements. In order to help mitigate noise activities, contractor shall provide ear protection for use by employees and CBP staff when working in close proximity to the Commercial Cargo dock and POV Primary booths.

74 Only Noisy and Odor Producing activities are listed to be performed during Government Unoccupied Hours. Provide clarification if utility interruptions and outages can be performed during Occupied Hours.

As this project is only pavement replacement/reconstruction, there should be no need for utility interruptions or outages unless the contractor damages the underground utilities.

75 Are design submittal reviews 21 days or 14 days for critical submittals?

14 calendar days. The government does not anticipate any critical submittals

76 If a contractor’s mandatory independent geotechnical analysis reveals conditions significantly more expensive to remediate than the "informational" data provided by the Government, will this be handled as a change order, or is the contractor expected to absorb that risk within their fixed price?

Refer to FAR 52.236-2 (GSA Class Deviation RFO-2025-36), Differing Site Conditions

77 Will the preliminary CPM schedule and detailed phasing diagrams count toward the 40-page technical limit, or can they be submitted as an appendix?

The CPM schedule and detailed phasing diagrams will not count toward the 40 page limit for the technical proposal.

78 Will GSA define the "primary function areas" indicated in the CBS Submittal Matrix for this roadway project? If the work is limited to exterior paving and roadways, does the government expect the contractor to perform accessibility upgrades to existing building interiors as part of the "path of travel" requirement?

All work is limited to exterior paving. The contractor is not expected to perform accessibility upgrades to the exterior path of travel. Should work under this contract damage or change the access, (ramps, etc.) the contractor is expected to repair any damage caused.
