About this file

This document is a Pre-Proposal Conference presentation for Request for Proposal (RFP) 47PB0025R0044 for a Construction Manager-as-Constructor (CMc) project at the Coburn Gore, Maine Land Port of Entry (LPOE). The solicitation seeks a contractor to provide design and construction services for a new land port of entry and housing facility, with an estimated total contract price between $125M and $135M. The project will utilize a Construction Manager-as-Constructor (CMc) delivery method, which involves the contractor providing advisory services during design and then acting as a general contractor during construction.

Key details include a proposal submission deadline of November 17, 2025, with offers to be evaluated across five factors: experience on similar projects (30%), management and technical approach (25%), key personnel qualifications (20%), past performance (20%), and small business status (5%). The project has a design completion expected in Fall 2026 for the LPOE and Winter 2026-27 for housing, with construction to be completed within 37 months for the LPOE and 30 months for housing. The contract includes a Guaranteed Maximum Price (GMP) option, with a shared savings incentive where the contractor can retain 50% of cost savings. Liquidated damages are set at $6,760 per calendar day, and the government intends to award the contract without discussions, requiring offerors to submit their best initial proposal.

The CMc Delivery Method

• The Construction-Manager-as-Constructor (CMc) Delivery Method is considered a Fixed-Price Incentive Contract in accordance with FAR 16.403.

• The CMc project delivery method is centered on “the CMc who provides advisory professional management assistance to the owner before construction during the project planning and design phases; then the CMc acts as a general contractor during construction.”

• Firm-Fixed-Price (FFP) Design Phase Services

• The CMc is responsible for the construction option(s) at a Guaranteed Maximum Price (GMP) following the completion of the design.

• GMP Construction Services

The CMc Delivery Method – Design Phase

The CMc services are solicited during the design phase (at roughly Concept Design) for FFP Design Phase Services and a GMP Construction Option(s). During the Design Phase Services, the CMc advises the owner and the A/E for:

• Constructability;

• Work phasing and sequencing;

• Systems analysis;

• Involvement of trades;

• Cost reconciliation;

• Market analysis (labor and materials availability);

• Risk assessments;

• Cost estimating; and

• Scheduling

The CMc Delivery Method – Construction Phase

• Initial GMP Option Price: Given that the CMc is hired before the design is complete, the need to have a price within the available budget is met by the CMc guaranteeing a maximum price (GMP), which is a ceiling on the eventual construction price.

• Final GMP Option Price: At approximately 75% design, GSA requests a final GMP Option Price. The Initial GMP can go down, but not up (unless there is additional scope added to the project).

The CMc Delivery Method – Construction Phase

• If, at this stage, the final GMP is not accepted by the owner and negotiations fail, the CMc will step out of the project. In such a case, having the completed design, the owner can re-bid for a general contractor to construct the project using, by default, Design-Bid-Build.

• During construction, the CMc has an open-book contract; the owner has direct access all contract costs. The GMP is a prediction of the cost of the construction (Estimated Cost of the Work) + Contingency (CCA) + Fee. The

GMP incentivizes the contractor to deliver the project within or under budget, with an offer to share in any savings achieved.

Advantages of the CMc Delivery Method

• Incentivizes cost control by offering shared savings if the final cost of construction is less than the GMP;

• Early collaboration between the AE and the constructor – Reduced-cost growth, schedule growth, and administrative savings, resulting in a net economic burden reduction compared with the other project delivery methods;

• Early constructor involvement results in a better understanding of the project risks allowing for more efficient risk allocation;

• Conducive to teamwork and information sharing – the CMc theoretically reduces the risk of every entity involved in the project;

• Helps the project team develop a more practical and realistic schedule or even “exceed schedule requirements because of concurrent design and construction,” critical in the schedule of sensitive projects.

Period of Performance

• Design Phase Services

• The Contractor shall commence performance of the Design Phase Services within ten (10) calendar days after the Contractor receives the Notice to Proceed (NTP);

• Design Phase Services shall be complete upon acceptance of all deliverables required by the Design Phase Services Statement of Work;

• Note: Design Completion is expected to be achieved in the Fall of 2026 for the Land Port of Entry and the Winter of 2026-27 for the Housing.

• Construction Services (the Work)

• If the Government exercises the GMP Option(s), the Contractor shall commence performance of the construction within ten (10) calendar days after the Contractor receives the NTP for the Work.

Period of Performance (cont.)

• Construction Services (the Work)

• If the Government exercises the GMP Option(s), the Contractor shall achieve Substantial Completion of the Construction Phase Work no later than 37 months from issuance of Notice to Proceed (NTP) for the Work for the Land Port of Entry and 30 months from the issuance of the NTP for the Work for the Housing.

• If the Government exercises the GMP Option(s), the Contractor shall achieve Contract Completion within sixty (60) calendar days of Substantial Completion.

Magnitude of Construction

• The estimated Total Contract Price (See Agreement, Section II.B.) is between $125M and $135M, inclusive of a Housing option.

Joint Ventures

Important note on Joint Ventures:

Federal Acquisition Regulation (FAR) Clause 52.204-7, System for Award Management, requires that an offeror be registered in SAM when submitting an offer. Paragraph (d) of this clause warns contractors that processing time should be taken into consideration when registering.

In addition to the FAR Clause, Section II.E.(1) of the RFP, Representations and Certifications, states, “Offerors are reminded their SAM registration status must be “Active”, at the time their offer is submitted, to be considered for award (see 52.204-7).”

• Please refer to additional proposal submission, content, and format requirements in the Solicitation Section II, Proposals;

• Please follow requirements exactly so as not to lose consideration during Government proposal evaluations;

• Standards for Government evaluation of factors are contained in Solicitation Section VI.F., Non-Price Factors.

Evaluation Factor 1 – Experience in Providing Design Phase Services and Construction Phase Services on Similar Projects

(30%)

This factor considers the Offeror’s experience as a firm in providing comparable Design Phase and Construction Phase Services for “similar” projects that the Offeror has completed.

• Please note “Similar Project” definition;

• Provide three (3) “similar” projects completed in the last fifteen (15) years in which the Offeror performed as a Construction Manager-as-Constructor, a Construction Manager-at-Risk, a Design-Builder, or a Design-Builder with Bridging;

• Current similar projects must be substantially complete to be considered relevant for this factor;

• Please note narrative requirements for this evaluation factor. Respond to every detail requested.

Evaluation Factor 2 – Management and Technical Approach (Design Phase Services and Construction Phase Services)

(25%)

This factor considers the Offeror’s project management plan which indicates the methods and means they will employ to ensure management of the project in a manner which will maximize the opportunity for successful completion that is on-time, on-budget, and within quality expectations.

The Proposal must delineate the Offeror’s knowledge, programs, and processes, relating them to the unique requirements of this project and demonstrating their approach to its management and execution of the project. The plan must include:

• Overall approach ;

• Staffing Plan;

• Quality Control Plan;

• Safety Plan;

Evaluation Factor 3 – Qualifications and Experience of Key Personnel (20%)

The Offeror shall identify the personnel they propose to fill the key team member positions listed below and state their roles and responsibilities on the Project. The Offeror shall provide evidence of the competency, past performance, qualifications and related experience of key team members.

• The Offeror shall provide resumes for each key team member clearly indicating their currently held position/title, proposed project position/title, education, qualifications, professional licensing, personal awards received, and work experience (including roles) over the last ten (10) years;

• Offerors shall provide a matrix chart clearly identifying the roles that key team members held on the projects submitted under Evaluation Factor 1.

Evaluation Factor 3 – Qualifications and Experience of Key Personnel (20%) (cont.)

This factor considers the Offeror’s Past Performance with regard to the projects submitted under Evaluation Factor 1, as a predictor of the Offeror’s compliance with contract requirements and overall quality of performance.

• For each of the (3) “similar” projects submitted under Evaluation Factor 1, the Offeror must submit a Past Performance Questionnaire (PPQ), completed by the applicable client. Completed PPQs should be submitted with the proposal;

• Also include performance recognition documents received within the last (6) years, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

Evaluation Factor 4 – Past Performance in Providing Design Phase Services and Construction Phase Services on Similar

Projects Provided under Factor #1 (20%) (cont.)

• The Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Contractor Performance Assessment Reporting System (CPARS), for all offeror team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror's proposal;

• While the Government may elect to consider data from a variety of sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

Evaluation Factor 5 – Small Business Socioeconomic Status (5%)

The Offeror shall provide evidence to establish its standing as a Small Business; Small Disadvantaged Business (SDB); Historically Underutilized Business Zone (HUBZone); Service-Disabled, Veteran-Owned Small Business (SDVOSB); and/or Woman-Owned Small Business (WOSB) under

NAICS 236220.

If a small business firm belongs to one or more of the above socioeconomic categories, the Offeror shall submit evidence for each category. If the Offeror proposes a Contractor Team Arrangement in accordance with Federal Acquisition Regulation (FAR) Subpart 9.6, separate evidence of each firm’s socioeconomic status shall be submitted.

Evaluation Factor – Price

Three (3) components of the Price Proposal:

1. Price Proposal on SF-1442 (signed) – Solicitation, Offor, and Award. The Price Proposal shall consist of the SF-1442 and the Agreement. Indicate the Total Contract Price from the completed Contract Price Form in Block 17 of the SF 1442, which must be fully executed by the Offeror;

1. A completed Contract Price Form included as part of the SF-1442 and in Section II of the Agreement.

Evaluation Factor – Price (cont.)

3. “Other than Certified Cost and Pricing Data” Documentation. Cost proposals must be organized and submitted using the Uniformat II classification framework developed by the American Society for Testing and Materials (ASTM), specifically under the designation E1557. Costs shall be provided for project work at the Level 3 Individual Elements classification (e.g. A1010 Standard Foundations), and summarized at the Level 2 classification (e.g. A10 Foundations). Any additional costs that the offeror believes must be included shall be well defined and included at the summary level.

Our Uniformat II – Level 3 Detail Reference Guide is provided to assist you with this documentation.

• The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s);

• Total Evaluated Price shall be calculated using the prices indicated in the Price Proposal, using the following formula:

• Walk through Pricing Form

GSA CMc Process

• Estimated Cost of the Work (ECW) means the estimated cost of the construction work, not including home office overhead.

• CMc Contingency Allowance (CCA) means an allowance for the exclusive use of the construction contractor to cover reimbursable costs during construction that are not the basis of a change order. These costs could include estimating, scheduling, and planning errors in the final ECW or other contractor errors.

• Fee for the Construction Work means the amount established in the construction contract for the contractor's profit and home office overhead costs.

• Guaranteed Maximum Price (GMP) means the sum of the ECW, CCA, and the Fee for the construction work.

GSA CMc Process

• Early Work Package. Early Work Package means a set of construction activities that can be clearly defined and separately performed from the remainder of the construction work. Demolition is an example of an early work package.

• May be used in the procurement and priced separately or included in the

GMP option;

• If any early work package exercised reduces the scope of the construction services under the GMP option, the ECW shall be reduced, and the CCA, fee for the construction work, and GMP shall be adjusted accordingly.

• Shared Savings Incentive. The incentive is a shared portion of the difference between the final GMP and the final cost of performance. The Share Ratio for the CMc contractor is set at 50% for this procurement.

Proposal Evaluations

• The Government will award a contract resulting from this Solicitation to the responsible Offeror whose offer conforming to the Solicitation will be the best value to the Government, Total Evaluated Price and other factors considered. In addition to Total Evaluated Price, the following non-price factors shall be used to evaluate offers:

• Experience in Providing Design Phase Services and Construction Phase Services on Similar Projects (30%);

• Management and Technical Approach (Design Phase Services and Construction Phase Services) (25%);

• Qualifications and Experience of Key Personnel (20%);

• Past Performance in Providing Design Phase Services and Construction Phase

Services on Similar Projects Provided under Factor 1 (20%)

• Small Business Socioeconomic Status (5%)

Proposal Evaluations (cont.)

• In total, Non-Price Factors, when combined, are significantly more important than the Total Evaluated Price. The degree of importance of price could become greater depending upon the equality of the non-price proposals. Price becomes more controlling as the equality of competing non-price proposals becomes greater;

• The Government intends to make contract award without discussions with offerors.

Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. However, the Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
