About this file

This is a Division 01 General Requirements specification template for GSA capital construction projects, specifically tailored for the Coburn Gore Land Port of Entry (LPOE) project in Maine under solicitation 47PB0025R0044. The template comprises comprehensive administrative, procedural, and technical requirements spanning contract management, quality assurance, commissioning, safety, sustainability, and project closeout across multiple specification sections (01 10 00 through 01 91 19).

Key administrative requirements include: project coordination and management via GSA's Project Management Information System (PMIS); Construction Manager as Constructor (CMc) delivery method; phased work sequences with specific substantial completion timelines; comprehensive submittal procedures through PMIS with 10-20 day review periods; schedule submissions using Critical Path Method (CPM) with monthly updates; and payment processing based on approved Schedule of Values. The specification mandates quality assurance through independent testing agencies, including air barrier system testing, building enclosure commissioning, and HVAC commissioning. Specific operational requirements address temporary facilities (utilities, offices, waste management), work restrictions (drone operations, working hours, security), fire prevention for hot work, tree and plant protection, and construction indoor air quality management. The project requires extensive documentation including record drawings in BIM format, Building Information Exchange (COBie) data submissions at 30%, 60%, substantial completion, and project closeout milestones with associated payment withholdings ($25,000-$35,000 per submittal cycle). Safety and health requirements mandate a site-specific Construction Safety and Health Plan, designated safety officers, hazard communication plans, and compliance with OSHA standards. Closeout procedures require punch list completion within specified timeframes, final cleaning, operation and maintenance manual preparation, and demonstration and training of Government personnel on all systems and equipment. The estimated contract value ranges from $125,000,000 to $135,000,000 with options, and a pre-proposal conference and site visit is scheduled for October 21, 2025, requiring offerors to register with no more than four representatives per organization.

Project Name: Coburn Gore LPOE CMc Project Location: Coburn Gore LPOE, ME Solicitation #: 47PB0025R0044 TEMPLATE is to be used as a GUIDE This is a template for the use of FY2025 capital project teams Editor: Notes that are in [BLUE] are guidance for the Editor to consider during the requirements development phase of the RFP. Delete all BLUE text prior to issuance of the RFP.] The sections in GSA Division 01, which are collectively referred to as the General Requirements, specify administrative requirements, procedural requirements, temporary facilities and controls, performance requirements, and life cycle activities. Administrative and procedural requirements are those relating to the process of contract administration, the assignment of contractual responsibilities, and the methods of communicating, controlling, and assuring quality. Temporary facilities and controls are those put into place for use only during the period of construction and that will be removed when no longer required for construction operations. Performance requirements are related to facility and system performance. Life cycle activities are related to commissioning, facility operation, facility maintenance, and facility decommissioning. Division 01 sections expand on certain of the administrative and procedural provisions in the conditions of the contract and apply broadly to the execution of the work of all the other sections of the specifications. Administrative and procedural requirements unique to a specific section should be covered in the affected section. Division 01 sections cover general requirements for execution of the work and should be written in language broad enough to apply to sections in Divisions 02 through 49. Without Division 01, these requirements would otherwise be repeated throughout the specifications, and the possibility of conflicts and omissions would be increased. This Division 01 concept adheres to the CSI principle of stating information only once and in the right place.

END OF SECTION 01 25 00

01 26 00 CONTRACT MODIFICATION PROCEDURES

SECTION 01 26 00 - CONTRACT MODIFICATION PROCEDURES

PART 1 GENERAL

1.1 PROJECT INFORMATION

Drawings and general provisions of the Contract, including General and Supplementary Conditions and other Division 01 Specification Sections, apply to this Section.

1.2 SUMMARY

The CONTRACT MODIFICATION or Change Order is fundamental to construction contracting as the primary means to modify the contract for construction and is defined as “A written instrument prepared by the CMa (A/E) and signed by the Owner, Contractor, and Architect stating their agreement upon all of the following: 1) the change in the Work; 2) the amount of the adjustment, if any, in the Contract Sum; and 3) the extent of the adjustment, if any, in the Contract Time.” The operative language is that a change order is an “agreement” amongst the parties and, therefore, the terms are settled and become a part of the contract.

A. This Section specifies administrative and procedural requirements for handling and processing contract modifications.

B. There are two primary types of modifications: bilateral, signed by the GC and the CO; and unilateral, signed only by the CO.

C. Related Sections include the following:

1. GSA FY25 01 27 00 UNIT PRICES for administrative requirements for using unit prices.

2. GSA FY25 01 25 00 SUBSTITUTION PROCEDURES for administrative procedures for handling requests for substitutions made after Contract award.

3. GSA FY25 01 31 00 PROJECT MANAGEMENT & COORDINATION

4. GSA FY25 01 21 00 ALLOWANCES

D. Contract Modification Process

1. Initiated by one or more of the following actions:

a. Proposal Request: A proposal request is issued by the CO/CS to the contractor requesting a proposal for a change, or a modification to the scope of the contract and is issued on behalf of the owner, to determine the cost of a change it is contemplating or that may be required to properly perform the Work. [Editor: Refer to SECTION 1.6 PROPOSAL REQUESTS A. Contracting Officer-Initiated Proposal Requests]

b. Architect’s Supplemental Instructions (“ASI”): The ASI is a directive issued by the CMa (A/E) to the contractor providing additional information within the scope of the contract documents or to make minor changes to the work that, in the CMa’s opinion, will not result in an adjustment to the contract sum or time.

c. Construction Change Directive (“CCD”): A CCD directs the contractor to immediately commence additional work or to implement a change to the work. This tool may be used where GSA and contractor have not agreed on proposed changes in the contract sum or time, or to direct changes in the work which, if not expeditiously implemented, might delay the project. It is important to understand, however, that while a CCD directs work and binds the contractor to perform such work, the modifications to the scope, cost and time still must be incorporated into the contract by change order.

d. Request for Information (“RFI”):

e. Request for a Change Order: A Change Order Request is a proposal issued by the contractor either as a self-initiated claim, or in response to a proposal request, RFI or ASI if, in the Contractor’s opinion, the RFI or ASI modifies the scope of the Contract. [Editor: Refer to SECTION 1.6 PROPOSAL REQUESTS B. Contractor-Initiated Proposals]

2. Contractor Submits a Change Order Proposal The contractor will submit to the CMa its proposal documenting the cost and time impact of the proposed change.

[Editor: It is an important duty of the CMa to carefully review the contractor’s proposal and advise the CO of its reasonableness. Most important is to confirm that the contractor is not asserting a claim for work that is already required of the Contract Documents and is not including costs such as general conditions and overhead that are included in the OH&P percentage, or for other work already contracted for.] Additionally, the CMa must consider the proposed impact on cost and time. Are the costs presented reasonable? (Typically, the CMa is required by its agreement with GSA to perform a detailed estimate, but rather assure the owner that the costs presented are reasonable, quantities are correct, and costs presented are allowed by contract.) The CMa shall analyze the schedule logic, and assess whether the proposed schedule impact is reasonable. In reviewing the impact on time, the CMa will need to consider a number of factors, including:

1. Does the proposed change impact the schedule’s critical path?

2. Could the contractor mitigate delays by adjusting other activities?

3. Are there concurrent delays that are already the responsibility of the contractor.

If the CO does not fully agree with the contractor’s proposal, the CO must respond in writing to the contractor, detailing its reasons, and then endeavor to reach mutually agreeable terms with the contractor.

3. Change Order Finalization Once all parties agree, the CMa prepares the change order. The description of the change should be clear, succinct, and complete. It should be adequate for a third-party to generally understand the change and its impacts. There are three parts to the description that coincide with the definition of the change order – the scope, the impact on cost, and the impact on time. For the scope, the change order should reference the specific Contract Documents that are to be changed as well as the documents prepared and issued by the CMa (A/E) that describe and detail the change. For the cost and time, the change order should state the contractor’s proposed change to the contract sum and contract time, referencing its proposal.

After describing the change and the impacts on the contract sum and time, the change order should list any attachments, including each of the supporting documents, with the date of each. Upon completing the changer order form, the CMa (A/E) will compile all attachments and issue with the change order.

4. Change Order Issuance Once the change order is finalized, it is signed first by the contractor and then by the CO.

1.3 CONTRACT MODIFICATION PROCESSING SYSTEM

[Editor: The CMa should establish a contract modification processing system consistent with GSA’s procedures and regulations and “modify this SECTION accordingly before issuance”. The system must encompass potential, ongoing, and completed contract modifications and encompass the following:

1. Defining the roles and responsibilities of the parties involved

2. Identifying, evaluating, and justifying the need for modifications

3. Defining the scope of modifications

4. Tracking modifications through a numbering system

5. Prescribing all steps necessary to process modifications

6. Listing all required documents and forms

7. Identifying cost impacts of modifications on the project budget

8. Establishing time impacts of modifications on the project]

1.4 CHANGES IN THE WORK

A. The Contracting Officer or designated representatives are the only entities authorized to direct work or change the contract.

1.5 MINOR CHANGES IN THE WORK

A. The Contracting Officer or his/her designated representative as directed by GSA will issue (after a review by the GSA Region D&C Quality Manager) supplemental instructions authorizing Minor Changes in the Work, not involving adjustment to the Contract Sum or the Contract Time.

1.6 PROPOSAL REQUESTS

A. Contracting Officer-Initiated Proposal Requests Sample Change Request Submitted by GSA [DOCX - 19 KB] Sample Change Request Submitted by Customer [DOCX - 19 KB] The Contracting Officer or designated representative will issue a detailed description of proposed changes in the Work that may require adjustment to the Contract Sum or the Contract Time. If necessary, the description will include supplemental or revised Drawings and Specifications. Proposal Requests issued by Contracting Officer or designated representative are for information only. Do not consider them instructions either to stop work in progress or to execute the proposed change.

1. Within [time specified in Proposal Request] [or] [20 days, when not otherwise specified,] [Insert number of days] after receipt of Proposal Request, submit a quotation estimating cost adjustments to the Contract Sum and the Contract Time necessary to execute the change.

[Editor: Revise 20-day time period in first subparagraph below to suit Project; suggested 20-day time period may be too long for many projects.]

2. Include a list of quantities of products required or eliminated and unit costs, with total amount of purchases and credits to be made. If requested, furnish survey data to substantiate quantities.

3. Indicate applicable taxes, delivery charges, equipment rental, and amounts of trade discounts.

4. Include costs of labor and supervision directly attributable to the change.

5. Include an updated Contractor's construction schedule that indicates the effect of the change, including, but not limited to, changes in activity duration, start and finish times, and activity relationship. Use available total float before requesting an extension of the Contract Time.

B. Contractor-Initiated Proposals If latent or unforeseen conditions require modifications to the Contract, the Contractor may propose changes by submitting a request for a change to the Construction Manager Agency (CMa).

1. Include a statement outlining reasons for the change and the effect of the change on the Work. Provide a complete description of the proposed change. Indicate the effect of the proposed change on the Contract Sum and the Contract Time.

2. Submit a complete cost proposal and TIA as outlined above for Contracting Officer- initiated changes. Include a list of quantities of products required or eliminated and unit costs, with total amount of purchases and credits to be made. If requested, furnish survey data to substantiate quantities.

3. Proposal Request Form: Sample Change Request Submitted by Contractor [DOCX - 19 KB]

4. Materials and Equipment: Materials incorporated in Work at Contractor's actual invoice cost, including freight but excluding sales tax. Indicate rates and units required.

5. Include an updated Contractor's construction schedule that indicates the effect of the change, including, but not limited to, changes in activity duration, start and finish times, and activity relationship. Use available total float before requesting an extension of the Contract Time.

6. Comply with requirements in SECTION 01 25 00 SUBSTITUTION PROCEDURES if the proposed change requires substitution of one product or system for product or system specified.

7. Overhead and Profit: The GC [or DB] and Subcontractors will be allowed up to 20 percent of the net change in cost for work performed by their own forces to account for both overhead and profit. The allowance for the overhead includes, but is not limited to, costs for: estimating; field supervision above the foreman level, general foreman, superintendents, assistant superintendents, engineers, accountants, timekeepers, schedulers, office managers, and others on staff; office supplies; drinking water; temporary heat, temporary cooling, light and power; field toilets;…
