About this file

This file is a Question and Answer (Q&A) log documenting responses to Requests for Information (RFIs) submitted by prospective bidders regarding a General Services Administration (GSA) Construction Manager as Constructor (CMc) solicitation for the Coburn Gore Land Port of Entry (LPOE) project located in Maine.

The solicitation addresses design and construction of a new CBP facility with associated officer housing, with an estimated award date in April 2026 and construction start in April 2027, with substantial completion targeted for April 2030. Key project parameters include a firm-fixed-price design phase, a Guaranteed Maximum Price (GMP) option for construction, a CMc contingency allowance increased to 5% (from 3%), and separate contract structures for the LPOE base facility and housing option. Critical requirements include compliance with the 2023 CBP LPOE Design Standards, geothermal heating systems (horizontal configuration), Buy America Act compliance with exceptions for Canadian structural steel under Trade Agreements, separate performance and payment bonds, Builder's Risk insurance (government-paid), and coordination of three-phase electrical utility work with Hydro-Québec. The proposal due date was extended to March 25, 2026, to allow adequate time for document review. Bidders must submit detailed Estimated Costs of Work (ECW), including assumptions and clarifications, with allowances for incomplete design documentation, and must document all cost segregation between base scope, housing options, and IRA-eligible items in prescribed formats. The solicitation emphasizes that planning documents, narratives, concept submissions, and feasibility studies are provided for informational purposes to inform ECW development but do not independently establish construction scope; bidders are responsible for thoroughly reviewing all amendments and documenting assumptions where specification content remains incomplete or pending.

Question Answer Date Received Date Responded Amendment Number

Given the schematic nature of the project, the complexity, the considerable amount of unknown site/geotechnical information, the lack of specifications, etc., it is requested that the CMc Contingency Allowance listed in the Solicitation Section I.E.-2 be increased from 3% to 5%.

Please see Amendment 0001 to the solicitation. GSA's intent is to issue a future amendment that will contain additional technical information to alleviate this concern and the need to consider increasing the CMc Contingency Allowance.

09/23/2025 10/27/2025 0001

Many (but not all) projects in Maine buy fabricated and installed structural steel from Canada. Under the terms of the Buy America Act, and the high security nature of CBP, are construction managers allowed to consider/purchase these or other materials and services from Canada?

The Trade Agreements Act provides the authority for the President to waive the Buy American statute for eligible products from countries that have signed an international trade agreement with the United States. The value of the acquisition is a determining factor in the applicability of trade agreements.

Canada is a party to the World Trade Organization Government Procurement Agreement (WTO GPA) and Free Trade Agreements. The threshold for the WTO GPA is $6,708,000.

As the Coburn Gore contract will exceed this amount, steel for this project can be purchased from Canada.

9/30/2025 10/27/2025 0001

Can GSA provide a sample or template of the Contract Price Form / CLIN structure to ensure cost segregation (base, housing option, IRA-eligible items) is formatted correctly?

The Contract Price Form contains separate tables for the Basic Requirement, Housing Options, Proposal Rates, and Unit Prices. The Basic Requirement and Housing Options tables contain mathematical instructions for each calculation.

10/15/2025 10/27/2025 0001

Small Business Socioeconomic Evaluation Factor (5%) - If an Other-Than-Small Business (OTSB) serves as the prime, and it forms a Contractor Team Arrangement (CTA) with a qualified Small Business, will the team receive credit (full or partial) under this evaluation factor? Or is evaluation credit limited only to primes that are themselves Small Businesses under NAICS 236220?

In the scenario raised, the Prime contractor would have to be a small business to receive any credit under the Small Business Socioeconomic Status evalutation criteria.

10/15/2025 10/27/2025 0001

The solicitation at Section II.F requires joint ventures to submit “financial information,” and the CASB DS-1 form references reconciliation with an entity’s financial accounting records. Can you please clarify whether audited financial statements (e.g., balance sheet and income statement) are required from all offerors as part of the initial proposal, or if they will only be requested during responsibility determination or when a joint venture or CAS-covered entity is involved?

In the case of a Joint Venture that qualifies as a small business, the Joint Venture entity must provide the financial information at Solicitation Section II.E.(4) with their proposal.

In the case of a Joint Venture that qualifies as a large business, the Joint Venture entity must provide the financial information at Solicitation Section II.E.(3) with their proposal.

10/15/2025 10/27/2025 0001

Is RFP Document 12 to be included as part of proposal? No, Solicitation Document #12, CBP Non-Disclosure Agreement Form, is required to be submitted to the Contracting Officer to receive approval to dowload the Controlled but Unclassified Information (CUI) documents from www.SAM.gov. These are RFP Attachments 8, 9, 12, and 13.

10/15/2025 10/27/2025 0001

For the Housing Option CLIN, should escalation or market volatility adjustments be included in the proposed price, or will this be handled under EPA provisions?

There are no Economic Price Adjustment (EPA) provisions in this solicitation and contract. 10/15/2025 10/27/2025 0001

Are joint venture/teaming agreements required to be fully executed at proposal submission, or can they be provided post-award?

Per Solicitation Sections II.A and II.F, fully executed Joint Venture Agreements are required with proposal submission.

10/15/2025 10/27/2025 0001

To what level of detail does GSA expect the initial risk registry to be developed for the proposal submission?

The initial risk registry can be top level by trade for GSA / CBP review. 10/15/2025 10/27/2025 0001

Will GSA require the CMc to prepare independent cost estimates at each A/E design milestone (Concept, 65%, 95%, 100%), or only at certain stages?

At each AE design milestone to allow GSA to review trends by trade for value management.

10/15/2025 10/27/2025 0001

Does the CMc team need to budget for third-party peer reviewers under Construction Excellence Peer Reviews (CEPR), or will these be GSA-funded?

No, this will not be the resposibility of the CMc contractor. 10/15/2025 10/27/2025 0001

Is the CMc responsible for procuring and managing the commissioning agent (CxP), or will this be provided separately by GSA as indicated in attachments?

The commissioning agent will be contracted for separately by the GSA. 10/15/2025 10/27/2025 0001

Will GSA allow early work packages (e.g., utilities, site prep, demolition) to be authorized prior to GMP, and if so, what approvals are required?

Early Work Packages may be proposed by the CMc contractor and/or requested by the GSA. Design will be completed by the Architect Engineer (AE) contractor. The GSA would request a proposal from the CMc contractor. If an early work package reduces the scope of the construction services under the Guaranteed Maximum Price (GMP), the Estimated Cost of the Work (ECW) shall be reduced, and the Construction Contingency Allowance (CCA), fee for the construction work, and GMP shall be adjusted accordingly.

10/15/2025 10/27/2025 0001

What is the government’s expectation for phased occupancy or turnover — single turnover at the end, or rolling handovers (e.g., CBP operations before housing)?

Single turnover for the LPOE. The housing can be turned over later, subject to CBP approval and the construction sequencing plan by the CMc contractor. Separate Notices to Proceed (NTP) and completion dates will be established for the Port and Housing options.

10/15/2025 10/27/2025 0001

For IRA Emerging & Sustainable Technology installations (PV, heat pumps, LEDs, insulation), will the CMc be responsible for long-term performance monitoring, or only installation/certification at turnover?

The CMc contractor will be responsible for installation / certification / training only. GSA will perform longterm maintenance and monitoring.

10/15/2025 10/27/2025 0001

Does the 3% CMc Contingency Allowance apply to both base and IRA-funded CLINs, or only to base scope?

There are no IRA funded CLINS in this procurement. 10/15/2025 10/27/2025 0001

Will GSA provide a standard deliverables matrix (to be included in PMIS) that defines all submittals, or must the CMc develop it from scratch?

Please see Amendment 0001. The 2025 Interim Core Building Standards Submittal Matrix has been added to the Solicitation as Master Attachment Number 18.

10/15/2025 10/27/2025 0001

Are Environmental Product Declarations (EPDs) required with the proposal submission for IRA-eligible materials, or only after award during construction procurement?

LEC materials that would have qualified for IRA funds are still able to be procured, provided the CMc demonstrate they are cost neutral to conventional materials. If LEC materials are proposed, EPDs need to be provided to demonstrate compliance.

10/15/2025 10/27/2025 0001

What format should be used for as-built BIM deliverables — COBie spreadsheets, native model files, or both?

Please see Amendment 0001. The GSA Building Information Modeling (BIM) Guide 07 has been added to the Solicitation as Master Attachment Number 19. The public facing link to 3D-4D Building Information Modeling has been added to the Solicitation as Master Attachment Number 20.

10/15/2025 10/27/2025 0001

Will GSA accept a corporate safety plan (with site-specific appendices added post-award), or must a full site-specific safety plan be included in the proposal submission?

The requirements for the Safety Plan submission, as part of the Management and Technical Approach (Design Phase Services and Construction Phase Services), are detailed at Solicitation Section II.D.(2)(b). The Evaluation Standard for this Evaluation Criteria is detailed at Solicitation Section VI.F.(2). Per this document, the proposal must delineate the Offeror's knowledge, programs, and processes, relating them to the unique requirements of this project and demonstrating their approach to its management and execution of the project.

10/15/2025 10/27/2025 0001

For the Small Business Subcontracting Plan, are there specific percentage targets (beyond FAR 19.7 thresholds) that apply to this region or project?

No, but it may be helpful to know GSA's goals, which are as follows: Small Business (25%); Small Disadvantaged Business (5%); Woman-Owned Small Business (5%); Service- Disabled Veteran-Owned Small Business (5%); HUBZone Small Business (3%).

10/15/2025 10/27/2025 0001

Can GSA confirm whether financial statements and bonding capacity letters must be included with the initial proposal, or only upon request during responsibility determination?

Please see Amendment 0001 to the solicitation. Solicitation Section III.G., Bond Requirements, has been amended to include FAR Clause 52.228-1, Bid Guarantee. See Agreement Section III.I., Performance and Payment Bonds, for additional bonding requirements.

10/15/2025 10/27/2025 0001

Can you confirm whether the Uniformat II Level 3 cost breakdown must be submitted in Excel format using the provided reference guide, or is a PDF narrative acceptable?

Excel is preferred, but a .pdf printout would be acceptable. 10/15/2025 10/27/2025 0001

For the Fee Percentage (CLIN 0005) and overhead/delay rates, does the Government require supporting documentation (e.g., audited indirect rates, historical data), or is a self-certified rate sufficient?

No backup or supporting documentation is required. 10/15/2025 10/27/2025 0001

Should unit prices for adjustments (Rate 0001–0002) be submitted in a separate attachment, or consolidated within the Contract Price Form?

Please use the Pricing Form provided as Solicitation Document (2). 10/15/2025 10/27/2025 0001

Is there a required page limit or format (font size, spacing, section order) for the Technical Proposal submission?

Please see Solicitation Section II.A., Proposal Contents, and Solicitation Section II.B., Proposal Format.

10/15/2025 10/27/2025 0001

The solicitation references multiple Statements of Work (SOWs) and design attachments

— should we address all of them in the Technical Proposal, or only the “CMc SOW Final 2025 03 2.pdf” as the governing SOW?

CMc SOW Final 2025 03 2 only. 10/15/2025 10/27/2025 0001

The solicitation limits site visit attendance to four representatives — do subcontractors count toward this limit, or only prime contractor staff?

The limit is four representatives per offeror. However, companies at both the prime and subcontract levels are welcome to register separately.

10/15/2025 10/15/25 (email) 0001

For the CBP Short Term Contractor Information Sheet, is there a specific format (PDF vs Excel), and should it be submitted only once for the site visit or again with the full proposal?

The required form was provided as Solicitation Document 13. A copy is attached to this email for your convenience. This document is only needed for the Pre-Proposal Meeting and Site Visit.

10/15/2025 10/15/25 (email) 0001

Are Past Performance Questionnaires (PPQs) required to be submitted directly by the client to PBS, or may the offeror collect and submit them in the proposal package?

Please see Solicitation Section II.D.(4)(b). Completed PPQs shall be submitted with the proposal...Offerors should follow-up with clients/references to ensure timely submission of questionnaires. If the Offeror is unable to obtain a completed PPQ from a client for a project before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the project. If the client requests, the client may submit a questionnaire directly to the Government's point of contact, via email at (james.adamo@gsa.gov) and (michele.valenza@gsa.gov) prior to proposal closing date.

10/15/2025 10/27/2025 0001

Is there a minimum number of PPQs required (e.g., 3 projects), or will the Government evaluate all that are submitted regardless of number?

The government will evaluate the three (3) PPQs submitted for each of the three (3) “similar” projects submitted under Evaluation Factor 1.

10/15/2025 10/27/2025 0001

For the Individual Subcontracting Plan, does GSA expect separate goals for each option period as well as the base period, or is a total roll-up across the contract acceptable?

Please see Solicitation Document 7, Individual Model Small Business Subcontracting Plan (May 2025). This document states the following. For contracts with option periods, the individual plan will include:

● separate goals for the base period

● separate goals for each option period

● a sum total of all periods for the entire contract term

10/15/2025 10/27/2025 0001

For the Bid Bond (SF-24), what is the required penal sum percentage of the bid? Please see Amendment 0001 to the solicitation. Solicitation Section III.G., Bond Requirements, has been amended to include FAR Clause 52.228-1, Bid Guarantee.

10/15/2025 10/27/2025 0001

For performance and payment bonds, how many calendar days after award must they be submitted? The SF-1442 references this but doesn’t specify clearly.

See Agreement Section III.I., Performance and Payment Bonds. 10/15/2025 10/27/2025 0001

Are there any specific insurance coverage limits beyond standard FAR/GSAR requirements (e.g., Builder’s Risk, Pollution Liability)?

No. However, should the contractor wish to carry Builder's Risk Insurance, the Government will pay for the cost as an allowable expense.

10/15/2025 10/27/2025 0001

Should the Offeror Reps & Certs (CMc301) be submitted as a signed standalone document, or will SAM.gov registration suffice?

Both. 10/15/2025 10/27/2025 0001

The Proprietary Information Agreement must be submitted with the proposal. 10/15/2025 10/27/2025 0001

The solicitation references multiple Design Narratives and PORs — should we submit acknowledgments for each, or is it sufficient to reference the final combined concept?

Reference the final combined concept when available. 10/15/2025 10/27/2025 0001

In the event of an Offer being submitted by an SBA-approved joint-venture (JV), in which case the JV itself qualifies as a Small Business (and therefore qualifies for the SB socioeconomic 5% scoring), would the JV also be permitted to present past performance not performed as the JV, but performed independently by the member companies? For example, if a member of the JV is a large business with projects which meet all of the criteria of a “similar” project, would the JV receive the credit for those projects? The spirit of the 5% scoring is for it to go to actual small businesses, and not for it to be manipulated by large businesses through the JV loophole, correct? It would seem most fair that the member entities would have to decide between getting the SB scoring by submitting as a SB JV or getting the past performance scoring by submitting as a large business, but not both, correct?

Please see Solicitation Section II.F.(4). Representations and certifications, financial information, and past performance information must be submitted for each member of the joint venture.

10/15/2025 10/27/2025 0001

Please extend RFI due date to at least 11/5/25 as more RFIs are anticipated Please see Amendment 0001 to the solicitation. 10/21/2025 10/27/2025 0001 Please confirm how the bid security should be calculated. Please see Amendment 0001 to the solicitation. Solicitation Section III.G., Bond

Requirements, has been amended to include FAR Clause 52.228-1, Bid Guarantee.

10/21/2025 10/27/2025 0001

As discussed at the walk-through, FAR requires the SAM registration status for a joint venture (JV) to be “Active” at the time their offer is submitted to be considered for award.

If the current government shutdown does not allow a new JV registration to be processed in time for the offer, how will this be handled or considered by the GSA?

If a potential Joint Venture offeror should experience issues with SAM registration, this information shall be provided to the CO as soon as it becomes know.

10/22/25 10/27/2025 0001

Master Attachment 15 – “Coburn Gore LPOE Final Concept Submission Combined REV 08-11-25” is not listed as a CUI document in the Solicitation. However, the associated content is stamped with bold or highlighted red font noting, “PROPERTY OF THE UNITED STATES GOVERNMENT This is controlled unclassified information. Do not remove the CUI marking. Properly destroy or return documents when no longer needed.

Controlled By: GSA (Records@gsa.gov)”. In a September 30, 2025 email from GSA, we received confirmation that the document was not marked CUI. The file name was not marked but the documents clearly are. Therefore, we respectfully request that the CUI markings be redacted/removed based on your confirmation that the document is not marked CUI and redistributed for intended use. As a CMMC level 2 certified company and as the individual pages of the document are marked as CUI, the document will need to be handled as CUI as otherwise our certification is jeopardized.

Please see Amendment 0001 to the solicitation. Master Attachments 14 and 15 are now marked as CUI.

10/24/25 10/27/2025 0001

Please confirm the CMc will not be held to the Target ECW CLIN 0002 and reaffirm this is solely used for evaluation purposes for the selection of the CMc. The only CLIN that the CMc will be held to is CLIN 0001 “Design Phase Services (Firm Fixed Price) – Includes all Housing Options.” Our understating is the GMP will be established at roughly 75% design.

The CMc contract includes design phase services at a firm-fixed-price (FFP) and an option(s) for construction at a Guaranteed Maximum Price (GMP). The GMP, which includes the Estimated Cost of the Work (ECW), CMc Contingency Allowance (CCA) and Fee, is the construction ceiling price described by Federal Acquisition Regulation (FAR) Subpart 16.403. The GMP is established at contract award. As is the case for Coburn Gore, the GMP may be established as one option or as multiple options, with separate GMP amounts.

The GMP may be bilaterally modified upward during the design phase ONLY for approved additions to the scope of work. The GMP may be bilaterally modified downward during the design phase for deletions to the scope of work

10/24/25 10/27/2025 0001

Please confirm the site visit, held Tuesday, October 21, 2025 is/was a mandatory requirement for all offerors.

The Pre-Proposal Conference and Site Visit is NOT mandatory to attend. 10/24/25 10/27/2025 0001

Please re-affirm that all RFIs should also go to the Alternate Contracting Officer besides the Prime CO and PM. Please confirm that the PM should receive a copy of the Offeror’s submission as well.

Yes, in addition to the CO, Molly Lewis, Molly.Lewis@gsa.gov and PM, Li-hang Wang, li-hang.wang@gsa.gov, please included Michele Valenza,michele.valenza@gsa.gov on all RFI's.

10/24/25 10/27/2025 0001

As the government is currently shutdown, please advise what the impact may be on the project and proposal timeline.

It is not yet known what impact, if any, the current lapse in appropriations will have on the Coburn Gore CMc solicitation. All potential offerors will be notified of any changes, should they occur.

10/24/25 10/27/2025 0001

Who is responsible for the primary electrical work? Will that be provided by GSA? Please confirm the extent of the primary electrical work, compared to secondary and building distribution systems.

As communicated during the site walk through, the three phase power installation to the site from Hydroquebec is the responsibility of the CMc as part of the pre-enabling work. GSA has established a customer record with Hydroquebec (HQ), and HQ requires a Quebec licensed master electrician contracted to continue the execution of the three phase power installation. It is expected the HQ will perform all of the utility line work to carry three phase across the border from Canada. Also, GSA expects that HQ provide the transformers for the LPOE and the Housing. exact locations TBD. GSA will lead the communication between HQ and the CMc contracted to execute the work. (GSA is also sorting out the presidential permit requirements of cross border utility work between Dept of Energy and Dept of State and will advise of any potential impacts to this scope to the CMc). Secondary and building distribution systems are also the responsibility of the CMc.

10/21/2025 12/10/2025 0002

Contract documents contain conflicting dates for Substantial Completion and Notice to Proceed:

A/E SOW Section 6 (Page 17): February 16, 2029 CMa SOW Section 2.3 (Page 10): December 15, 2028 CMc SOW Section 4.a (Page 12): February 16, 2029 CMc Agreement Section I.C.(2)(b) (Page 6): "37 months from NTP"

NTP listed as both July 6, 2026 (CMc SOW Page 12) and September 15, 2026 (A/E SOW Page 17)

Please clarify:

What is the official contractual Substantial Completion date for the LPOE?

What is the confirmed Construction NTP date?

Are there separate Substantial Completion dates for LPOE vs. Housing components?

This affects project schedule development, milestone planning, and coordination with all project team members.

The documents were prepared and gathered while the concept design workflow was active.

The housing design has evolved much slower than initially anticipated since the posting.

Presently our internal tracker indicates the following: CMC award: estimated April 2026, Construction start: estimated April 30, 2027, susbtantial completion: estimated April 30, 2030. The CMc is expected to develop a phased construction plan with GSA and CBP to enable the land port to remain in continuous operation and the housing to remain available to officers uninterrupted. GSA and CBP anticipates two separate CPM schedules tracking the LPOE construction and the Housing program construction on separate paths, with a confirmed phasing plan and logistics plan developed together after award

Per the NEPA contracotr: Right now, the only mitigation measures are for the Canada Lynx:

Avoid tree clearing and disturbance to the extent practicable between May 1 and July 15 to avoid the breeding and denning season of Canada lynx.

If work must be conducted between May 1 and July 15, work crews or an environmental monitor should be trained to perform a pre-construction walkthrough of the area and inspect for evidence of Canada lynx dens or Canada lynx (sightings, tracks, scat, etc.). If Canada lynx evidence is observed within 100 ft of the site, do not proceed with construction until after July 15.

Brief project personnel on avoiding Canada lynx and preventing vehicle collisions (drive slowly and during daylight hours as much as possible).

Schedule construction work during daylight hours to minimize trips during the dusk and dawn periods when Canada lynx are most active.

Any permanent fencing must be permeable to wildlife to allow any trapped Canada lynx to escape.

Install temporary fencing around any open pits to prevent Canada lynx from falling in, and/or place ramps into any pits or trenches for Canada lynx to escape if they fall in.
