About this file

This is a federal contracting representation form (FAR 52.204-24) requiring offerors to disclose their use of covered telecommunications and video surveillance equipment or services.

The form mandates that offerors represent whether they will or will not provide covered telecommunications equipment or services to the Government in performance of the contract. Covered telecommunications equipment and services are defined by reference to FAR 52.204-25 and include equipment or services that use covered telecommunications components as substantial or essential elements. The prohibition, established under Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, prohibits executive agencies from procuring or obtaining equipment, systems, or services using covered telecommunications equipment or services as a substantial or essential component effective August 13, 2019. A second prohibition under Section 889(a)(1)(B) prohibits contracts with entities that use such equipment or services as critical technology, effective August 13, 2020. The prohibitions do not apply to services connecting third-party facilities (backhaul, roaming, or interconnection arrangements) or to telecommunications equipment that cannot route or redirect user data traffic. Offerors must review the System for Award Management (SAM) excluded parties list for entities barred from receiving federal awards for covered telecommunications equipment or services. If the offeror responds that it will provide covered telecommunications equipment or services, or uses such equipment or services, detailed disclosure information is required, including the entity that produced the equipment, description of all covered telecommunications equipment or services offered, and explanation of proposed use and permissibility under the prohibition. The form requires signature by the offeror or legally authorized representative with date.
