About this file
This is a construction agreement between Bristol Borough and a contractor for the 2026 CDBG Design/Build Curb Ramp Project. The project involves the design and construction of ADA-compliant and PennDOT-compliant curb ramps with associated sidewalk improvements and sign relocation/installation at specified locations within Bristol Borough. All design work, materials, labor, and equipment must conform to PennDOT Publication 408 and Borough Standards. The contractor must complete the work within 90 calendar days from the contract commencement date to achieve substantial completion and within 110 calendar days for final completion and readiness for final payment. The work is subject to 2 CFR Part 200 compliance requirements as Bristol Borough is a CDBG grantee. Gilmore & Associates, Inc., located in Newtown, Pennsylvania, serves as the Owner's Engineer and Project Manager. The contract documents include the agreement, performance and payment bonds, general and supplementary conditions, 26 drawing sheets, detailed specifications, and five addenda.
Payment for unit price work will be based on established unit prices multiplied by actual quantities, with progress payments made monthly at 90 percent of completed work (increasing to 95 percent after 50 percent completion if satisfactory progress is demonstrated) and 50 percent of stored materials and equipment costs. Retainage is withheld on all payments, with final payment issued upon completion and acceptance. All payments require weekly payroll submissions through SkillSmart to comply with Davis-Bacon wage reporting requirements. Liquidated damages of $500 per day apply for delays beyond the specified completion date. Interest on overdue progress payments is calculated per Pennsylvania's Prompt Payment Act (62 PA.C.S. 3932), while final payment interest is computed at 10 percent per annum or the bond issue rate, whichever is less. The contractor must provide a performance bond, payment bond, insurance certificates, and execute a non-collusion certification. Additionally, the contractor must retain a professional electrographer to document existing roadway and curbing conditions via color DVD or CD prior to construction commencement and provide two copies to the Borough.
