About this file
This is a Bid Bond document prepared by the Engineers Joint Contract Documents Committee for Horsham Township, Pennsylvania, related to Contract #2026-00182 for the demolition of a residential structure and associated site improvements at 234 McKean Road. The project scope encompasses demolition of an existing home, detached garage, two sheds, and an asphalt driveway, along with capping a domestic water well, abandoning a sanitary service line at the main connection, and restoring a stream crossing/access point damaged by previous flooding. All disturbed areas must be graded to match surrounding topography and permanently stabilized. A mandatory pre-bid meeting is scheduled for Thursday, April 2, 2026, at 1100 Limekiln Pike, Ambler, Pennsylvania 19002, with bids due by April 15, 2026.
The Bid Bond requires bidders to provide executed agreements, performance bonds, and payment bonds as specified in the bidding documents within the required timeframe. The bond establishes that the bidder and surety are jointly and severally liable to Horsham Township for the difference between the bidder's bid amount and the next lowest responsive bid, not to exceed the stated penal sum. Default occurs if the bidder fails to deliver the executed agreement and required bonds within the time specified. Any legal action must be commenced in Montgomery County Court of Common Pleas or the United States District Court for the Eastern District of Pennsylvania within one year of the bid due date. The surety must provide a current Power of Attorney demonstrating authority to execute the bond on behalf of the surety company.

Bidder and Surety, jointly and severally, bind themselves, their heirs, executors, administrators, successors, and assigns to pay to Owner upon default of Bidder any difference between the total amount of Bidder’s Bid and the total amount of the Bid of the next lowest, responsible Bidder who submitted a responsive Bid as determined by Owner for the work required by the Contract Documents, provided that:
1.1 If there is no such next Bidder, and Owner does not abandon the Project, then Bidder and Surety shall pay to

Default of Bidder shall occur upon the failure of Bidder to deliver within the time required by the Bidding Documents (or any extension thereof agreed to in writing by Owner) the executed Agreement required by the Bidding Documents and any performance and payment bonds required by the Bidding Documents.
3. This obligation shall be null and void if:

4. Payment under this Bond will be due and payable upon default of Bidder and within 30 calendar days after receipt by Bidder and Surety of written notice of default from Owner, which notice will be given with reasonable promptness, identifying this Bond and the Project and including a statement of the amount due.
5. Surety waives notice of any and all defenses based on or arising out of any time extension to issue Notice of Award agreed to in writing by Owner and Bidder, provided that the total time for issuing Notice of Award including extensions shall not in the aggregate exceed 120 days from Bid due date without Surety’s written consent.
6. No suit or action shall be commenced under this Bond prior to 30 calendar days after the notice of default required in Paragraph 4 above is received by Bidder and Surety and in no case later than one year after Bid due date.
7. Any suit or action under this Bond shall be commenced only in a court of competent jurisdiction located in the state in which the Project is located.
