CONTRACTOR RESPONSIBILITY AND PREAWARD SURVEY:

To determine a Contractor's responsibility for purposes of contract award in accordance with FAR Part 9, the Contractor is required to provide a statement regarding previous experience and past performance in performing comparable work, information related to the business organization, financial resources, and/or plant to be used in performing the work (see Section 00 22 10 or 00 22 20 OR Attachments, Preaward Survey). All Offerors will complete and return the Preaward Survey as part of the Price/Cost proposal. (Pre-award Survey is not required for Phase I, Preaward Survey will be required for Phase 2. ) Failure to submit the Preaward Survey in conjunction with the price proposal will not of itself render the offer unacceptable.

If the Contractor or Subcontractor does not already have sufficient resources demonstrated in the completed Preaward Survey, acceptable evidence of "the ability to obtain" the required, adequate resources (all of the resources discussed in FAR 9.104-1) normally consists of a commitment or explicit arrangement that will be in existence at the time of contract award to rent, purchase or otherwise acquire the needed facilities, equipment, other resources, or personnel.

The Preaward Survey as a tool used by the Government in determining responsibility of the offeror is submitted as part of the Price/Cost proposal and is separate from the technical proposal's response to the technical evaluation criteria found later in this section. Some of the information required from the offeror for completion of the Preaward Survey and the technical proposal may be duplicative but it is necessary that the information be provided in full in both places and that the Price/Cost proposal and the Technical proposal be separate documents. DO NOT state, for example, in the technical proposal, "See Price/Cost proposal for past performance information".

Offerors utilizing individual sureties in support of a bid bond shall include a Standard Form (SF) 28, Affidavit of Individual Surety, accompanied by a pledge of acceptable assets from each person acting as an individual surety, and include these with the SF 24, Bid Bond, and the bid itself (see FAR 52.228-11, Pledges of Assets).

Pledges of acceptable assets shall be in the form of (1) evidence of an escrow account and/or (2) a recorded lien on real estate.

Failure to provide pledges of acceptable assets with the bid, in the specified form, accompanied by a properly executed SF 24 and SF 28 will render the bidder nonresponsible and thus ineligible for award.

A written award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

SYSTEM FOR AWARD MANAGEMENT (SAM) REGISTRATION:

The Contracting Officer is required to make an affirmative pre-award determination of the prospective Contractor's responsibility in accordance with the mandatory requirements of Part 9 of the Federal Acquisition Regulation (FAR) and its supplements. The contracting officer must have sufficient information available to determine that a prospective Contractor meets these minimum standards. Therefore, the Offeror is requested to provide the pre-award survey information described below with its price proposal:

(1) The completed Construction Contractor Data Form with Supplemental Schedules A-C (see format which follows). If the Offeror is a large multi-segmented business concerns, the data provided on the supplemental schedules may be limited to information that directly pertains to the specific segment of the business concern (i.e., the division, group, unit, etc.) proposed to perform work under the prospective contract with its own work force. If the offer is being submitted by a Joint Venture, submit a separate form for each Joint Venture participant. The Offeror may submit pre-award survey information in another format, provided that the information furnished is substantially the same as that which would be furnished on the Construction Contractor Data Form and its supplemental schedules.

(2) Current financial statements. If the financial statement is more than 60 days old, submit a certificate stating that the firm's financial condition is substantially the same, or, if not the same, state the changes that have taken place. If a Joint Venture, provide this information for each participant in the Joint Venture.

(3) Banking information. Provide letters from banks or other financial institutions with which the Contractor conducts business. The letters should contain information about your firm's accounts, loans, lines of credit, etc. The Government is interested in financial stability, timely payments, the length and nature of the relationship between the firm and the financial institution, and the firm's financial ability to perform the contract. The letters should also provide the name and telephone number of the bank representative the Government may contact. If a Joint Venture, provide this information for each Joint Venture participant.

b. The Government will treat the pre-award survey information submitted by the Offeror as proprietary.

c. See Attachment 6, Pre-Award Survey.

6.0 GOVERNMENT EVALUATION OF PHASE-TWO

TECHNICAL PROPOSALS: EVALUATION CRITERIA

AND METHODOLOGY

6.1 General Evaluation Guidelines

a. Material submitted by each Offeror under each evaluation factor will be evaluated by the Government.

b. The Government will evaluate each Offeror's Phase-Two technical proposal on the basis of the thoroughness and factual detail of the narrative and documentation submitted.

c. Failure by an Offeror to comply with formatting or submission requirements contained in the solicitation, the presence of significant mistakes or errors in a proposal, or the presence of more than a nominal number of less significant mistakes/errors in a proposal, may be considered indicative of an increased risk of inattention to detail or quality control during contract performance. Lack of conformance may therefore result in a higher risk assessment, in addition to other possible adverse impacts on the evaluation. Material omission(s) may cause a technical proposal to be rejected as unacceptable. However, in accordance with FAR 52.215-1, the Government may waive informalities or minor irregularities in proposals. For example, a failure by a proposed key Subcontractor to submit a properly executed letter of commitment may be considered reflective of increased risk but not an outright proposal deficiency.

d. Phase-Two technical proposals which do not provide the specified information in the specified location in accordance with these submission instructions may be downgraded. The Government is not obligated to search for information that is not in its specified location.

e. Any prescribed page and formatting limitations will be strictly adhered to by the Government. The Government will not evaluate information contained on pages that exceed the limitations set forth in these instructions. For example, submission of a three page document in response to a requirement with a two page limitation will be treated as follows: information on the first two pages will be evaluated while any information on the third page will be ignored. Similarly, if an Offeror were to submit a fold-out sheet (e.g. 11"x17") in response to an information request with a one-page limitation where fold-out sheets are not authorized, only the information that could reasonably be submitted on one 8-1/2 x 11 inch sheet will be evaluated. If an Offeror were to submit three 8-1/2 x 11 inch pages in response to a request containing a not-to-exceed 11 x 17 inch page limitation, only the information that could reasonably be submitted on one 11 x 17 inch sheet would be evaluated. If an Offeror were to submit alternates that were not requested (e.g. key Subcontractor), the information would not be evaluated.

f. Proposals which are generic, vague, or lacking in detail may be downgraded. Responses that are essentially blanket offers of compliance cannot substitute for inclusion of the detailed and thorough technical information necessary to determine an Offeror's qualifications to successfully complete the proposed project. Accordingly a proposal's omission of information the Government requests in this solicitation may result in a finding of deficiency or a downgrade of the proposal if inadequate detail is provided.

g. An "uncertainty" or "ambiguity" is any aspect of the proposal for which the intent of the Offeror is unclear because there may be more than one way to interpret the proposal or because inconsistencies in the proposal indicate that there may be an error, omission, or mistake. Examples include a mistake in calculation or measurement and contradictory statements. A "strength" is an aspect of an Offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance. A "deficiency" is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. "Weakness" means a flaw in a proposal that increases the risk of unsuccessful contract performance. A "significant weakness" is a proposal flaw that appreciably increases the risk of unsuccessful contract performance. The Government cannot accept an offer with a deficiency in its technical proposal. The term "acceptable" is therefore used in this context to describe a technical proposal that does not contain a deficiency and thus could be accepted by the Government, notwithstanding any weaknesses or significant weaknesses in the proposal.

h. The Government cannot make award to a Contractor with a deficient offer. Proposals containing deficiencies will be rated "Unacceptable," making them ineligible for award unless the Government elects to enter into discussions with that Offeror and all deficiencies are remedied in a revised proposal.

6.2 Technical Evaluation

6.2.1 Factor 3 - Design and Construction Approach

a. Factor 3 Tab 1A-Technical Narrative.

(1) The Government will evaluate how well the proposal indicates an approach and understanding of the requirements that decreases the risk of unsuccessful performance. The soundness and workability of the Offeror's approach and method to design and construct the subject procurement. As part of its evaluation, the Government will consider whether the Offeror's approach appears reasonable, achievable, and reflects logical sequencing and progression of activities.

(2) The greater the narrative demonstrates knowledge and understanding based on the specifications and drawings as it relates to : (1) site preparation; (2) security requirements; (3) establishment and maintenance of Free Zones;(4) Aircraft Shade Structures(5) Foreign Object Debris (FOD) remediation;

(6) installation of subgrade utilities; (7) construction work discipline sequencing; (8) site work including concrete mix design, and (8) clean- up.; the higher the evaluation rating.

(3) The Government will evaluate the identified roles and involvement of the key- Subcontractor(s), and planned interaction between Technical Reviewers and various Contractor and Government personnel for how well the proposal indicates an approach and understanding of the requirements that decreases the risk of unsuccessful performance.

(4) The Government will evaluate the description of any significant problems or major difficulties anticipated in performing or accomplishing the work, challenges associated with this project, and Offeror's plan for avoiding problems and mitigating difficulties which could adversely impact project schedule for how well proposal indicates an approach and understanding of the requirements that decreases the risk of unsuccessful performance.

b. Factor 3 Tab 1B - Network Analysis Schedule (NAS).

(1) The Government will evaluate the NAS to determine the extent to which it demonstrates (i) the Offeror's understanding of the unique requirements and challenges of this project and (ii) the Offeror's ability to schedule and integrate the design and major work elements at the "feature of work" level, phasing of the major work features, construction and close-out activities on the critical and near-critical path meeting the contract performance schedule specified in the solicitation. As part of its evaluation, the Government may consider whether the Offeror's approach to the scheduling/phasing of these major activities appears reasonable, and achievable. The Government may also consider whether the Offeror's approach to scheduling/phasing of major activities reflects logical sequencing and progression of activities; inclusion of all of the important features of the work;

milestones along the critical path, incorporation of time for Government activities; and appropriate consideration of recognizable constraints, including material and equipment lead times and the impacts on construction activities of adverse weather typical for the construction site.

(2) The Government will ensure, at a minimum, all activities in paragraph 4.3.1.2.b, the critical path and identified time frames are included and that the period of performance does not exceed the performance period specified in block 11 of the SF1442.

(3) The schedule will be evaluated for how well it indicates an approach and understanding of the requirements that decreases the risk of unsuccessful performance. A proposed schedule and approach that clearly reflect an understanding of the complexity of this project will be evaluated more favorably. Schedule and approach demonstrating professionalism and thoroughness may be evaluated more favorably.

6.2.2 For Factor 3, the Government will assign an adjectival rating as set forth in the following chart:
