MUNITIONS & EXPLOSIVES DISCOVERY & REMOVAL (Revised Amendment 007) 04/18

PART 1 GENERAL

1.1 INTRODUCTION

The Air Force Targeting Center Facility (AF TCF) military construction (MILCON) project site, Joint Base Langley-Eustis (JBLE), is partially located within a Langley munitions response area (MRA) / munitions response site (MRS) established under the Military Munitions Response Program (MMRP). The subject MRA has associated with it unique munitions and explosives of concern (MEC) and munitions constituents (MC) issues.

The purpose of this Statement of Work (SOW) is to conduct munitions response actions, as necessary, in support of this MILCON activity.

1.2 GENERAL REQUIREMENTS

Given the nature of the MRA to be constructed on and the potential to encounter MEC, safety shall be a paramount concern in providing support to this construction activity. The contractor shall prepare for and perform munitions and explosives of concern (MEC) support to include but not be limited to providing standby safety support, subsurface removal of the construction footprint, and remove all discovered MEC subsequent to construction activities. All construction activities shall adhere to provisions in Department of Defense (DoD) Ammunition and Explosives Safety Standards (DoD 6055.09-M) and USACE Explosives Safety and Health Requirements Manual EM 385-1-97 in dealing with explosives safety. All munitions response actions will be conducted in full compliance with USACE, Department of the Air Force, Department of the Army, DoD, and local/state requirements regarding personnel, equipment and procedures.

The following additional general requirements shall apply in support of this construction activity:

The contractor shall supply all labor, equipment, and materials necessary to achieve the requirements of this SOW. The contractor will be required to submit personal information (i.e. SSN, driver's license, etc.) for all individuals working at the installation so they can gain installation access.

1.2.1 Site

The construction support will be performed in accordance with the requirements outlined in this SOW for the MSA MRS identified in Figure A-1 Intrusive Results Data Gap Investigation (DGI) - East Area and as otherwise necessary to support the construction footprint the attached Explosive Safety Submission (ESS) . See Spec Appendix B for the Explosive Safety Submission.

1.2.2 Planning Documents

Documents shall be clear, concise, and written using standard English and shall correctly use all technical and regulatory terminology. Provide easily readable maps and figures in the planning documents. Prepare and submit MRA related planning documents prior to construction activities as necessary to obtain approval of Final planning documents by authorities as

designated. Submit internal draft planning documents for USACE review, draft planning documents for DoD Project Team member review, draft final planning documents for stakeholder project team member review, and final planning documents.

1.2.3 Meetings

Meetings shall be held to brief the Project Team on initiation of activities, coordination of activities, progress, and conclusion of activities. The contractor will coordinate with the USACE representative(s) in conducting and participating in the meetings as required. The contractor shall anticipate at least weekly status meetings with the USACE representative(s) and other meetings as required by the Air Force.

1.2.4 Team Member

The contractor shall function as an integral member of the Project Team in support of the AF mission. To facilitate this, the AF will rely on the contractor's expertise in munitions response; however, the AF as the lead agency under CERCLA retains all decision-making authority.

1.2.5 Trouble Reporting

The contractor shall immediately report to the USACE Project Manager and installation remedial project manager any irresolvable technical or regulatory problems or issues preventing successful fulfillment of SOW requirements.

1.3 SPECIFIC REQUIRMENTS

1.3.1 Coordination

All work will be coordinated with the USACE (Baltimore District) Ordnance and Explosive (OE) Safety Representative or Resident Engineer (RE)/Administrative Contracting Officer (ACO) and Contracting Officer Representative (COR) and installation personnel.

1.3.2 MEC Support for Construction Activities

MEC support during construction activities may require stand-by support and/or a complete MEC subsurface removal, depending on an assessment of the probability of encountering MEC and level of confidence associated with the determination. Support shall include but not be limited to:

a. Unexploded Ordnance (UXO) Team. The team will consist of a minimum of two (2) personnel, one (1) must be a qualified UXO Technician III and one (1) qualified UXO Technician II or above.

b. UXO personnel involved in performing MEC procedures will follow the provisions and work standards identified in Department of Defense Explosive Safety Board (DDESB) Technical Paper (TP) - 18.

1.3.3 Safety and Occupational Health Plans

MEC site operations require development and implementation of an Accident Prevention Plan (APP) supplemented with a Site Safety and Health Plan (SSHP) appendix to address MEC-related hazards. The contractor shall be responsible for developing and implementing an APP supplemented with a

SSHP appendix, which includes coordination with the USACE COR regarding the possible presence of MEC-related hazards.

1.3.4 Explosive Safety Submission (ESS)

MEC removal response subsequent to construction support will require an Explosive Safety Submission (ESS). Unless otherwise directed by the Resident Engineer (RE)/Administrative Contracting Officer (ACO) and Contracting Officer Representative (COR), USACE will be responsible for preparing and submitting an ESS for MEC removal work to be conducted in support of construction activities. The government will be responsible for obtaining necessary approvals through the chain of command to DoD Explosives Safety Board (DDESB). The contractor will support the Resident Engineer (RE)/Administrative Contracting Officer (ACO) and Contracting Officer Representative (COR) as necessary including responding to comments, making revisions to the document, providing a qualified team, etc. The DDESB-approved ESS is attached as Appendix B.

1.3.5 Material Processing and Disposition

Contractor shall comply with the procedures stipulated in (1) DoD Instruction Number 4140.62, Material Potentially Presenting an Explosive Hazard, (2) USACE Engineering Manual EM 385-1-97, Explosives Safety and Health Requirements Manual, Section 11 for the inspection and processing of material potentially presenting an explosive hazard (MPPEH) for final disposition. These documents provide guidance to ensure unknown explosive hazards are not present when transferring MPPEH, material documented as an explosive hazard (MDEH), or material documented as safe (MDAS) within the DoD, transferring MDEH to a qualified receiver, or releasing MDAS to the public. Contractor shall dispose of recovered MDAS at a USACE-approved facility, if judged appropriate by the USACE. The Senior UXO Supervisor shall prepare and certify the inspection on DD Form 1348-1A.

1.3.6 Encountered Items Accounting

A detailed accounting of all military munitions (MM) items/components shall be maintained. Contractor will record in field logbooks a detailed accounting of all MEC, MPPEH and MD items encountered. This accounting will include the standard official nomenclature, condition of the item, location and disposition of each item. This accounting will also be documented in an electronic database. A permanent record shall be generated for all sensor data that is digitally-recorded or geo-referenced. All work activities will be recorded in a Daily Operations Report provided to the on-site USACE Point of Contact by 10:00 am local time, the following work day.

1.3.7 Quality Control (QC)

The contractor is responsible for quality control (QC) of all MEC activities and for ensuring that only those procedures and processes conforming to the Work Plan and ESS are implemented. The UXOQC will perform periodic QC reviews of MEC activities. The UXOQC will document in the Daily Operations Report the results of inspections and audits and any corrective actions for quality defects.

1.4 QUALITY ASSURANCE

The Government will employ quality assurance (QA) measures, to include but not be limited to periodic assessments of the contractor's performance by

SECTION 02 60 00 Page 3 the Resident Engineer (RE)/Administrative Contracting Officer (ACO) and Contracting Officer Representative (COR), and other technical experts, as deemed necessary. Ultimately, the contractor is responsible for overall performance and achieving the requirements of this SOW.

1.4.1 Government Reviews

The Government will conduct reviews, as a part of the Project Team. A maximum of 30 calendar days is allowed for DoD review of deliverables.

The contractor may request additional Government input or in-progress reviews; however, such requests must be coordinated with the Resident Engineer (RE)/Administrative Contracting Officer (ACO) and Contracting Officer Representative (COR). The Government reserves the right to conduct additional reviews, as needed. Other stakeholders may be identified by AFCEC and/or the installation to review these deliverables, as deemed necessary. After review, comments and suggested revisions will be forwarded to the contractor. The contractor shall address the comments from each entity and incorporate suggested revisions of the draft deliverables, as appropriate.

1.4.2 Corrective Measures

The Government will execute the following corrective measures, as needed, to insure that it's legal, regulatory, and other guidance are met in providing MEC support to this construction activity.

a. If performance deficiencies are found, the contractor will be given the right to correct the deficiencies first.

b. Until deficiencies are corrected, the Contracting Officer (CO) and/or Administrative Contracting Officer (ACO) may stop milestone payments.

c. The Government reserves its rights to seek equitable adjustments under current contract provisions.

1.5 GOVERNMENT POINTS OF CONTACT

Government Point of Contacts (POCs) for administration, coordination, and facilitation of this task order will be provided after award.

1.6 SECURITY CONTRACT LANGUAGE

The contractor shall comply with Security Contract Language for all Corps of Engineers' Unclassified Contracts (PIL 2003-06, 19 Feb 03).

1.7 RESTRICTIONS

1.7.1 Guidance

The contractor is cautioned to take no guidance during the course of the work from any other source except the USACE Ordnance and Explosive (OE) Safety Representative or Resident Engineer (RE)/Administrative Contracting Officer (ACO) and Contracting Officer Representative (COR). The contractor shall make on-site field investigations, as necessary, to verify and obtain information on site utilities and conditions, but is not responsible for performing utility locates for the area. Utility locates shall be the responsibility of the installation. The contractor shall coordinate with the Resident Engineer (RE)/Administrative Contracting Officer (ACO) and Contracting Officer Representative (COR) and the USACE

OE Safety Representative during the performance of the work.

1.7.2 Release of Information

Unless specifically approved by the Resident Engineer (RE)/Administrative Contracting Officer (ACO) and Contracting Officer Representative (COR), the contractor shall not release, present, clarify or discuss any drawing, specification, design investigation, budget, estimate, schedule or any other material or information of any nature pertaining to the work for which services are performed under the terms of this contract. The provisions of this clause will apply to unnecessary contact with any outside individual or agency during design, solicitation and performance of this project. The contractor and any subcontractors shall refer all questions and inquiries from outside sources to the Resident Engineer (RE)/Administrative Contracting Officer (ACO) and Contracting Officer Representative (COR). The provisions of this clause are not intended to limit, restrict or inhibit normal contact necessary to fulfill the terms of this contract.
