(End of provision) 252.234-7001 NOTICE OF EARNED VALUE MANAGEMENT SYSTEM (DEVIATION 2015-O0017)(SEP 2015)
(a) If the offeror submits a proposal in the amount of $100,000,000 or more—
(1) The offeror shall provide documentation that the Cognizant Federal Agency (CFA) has determined that the proposed Earned Value Management System (EVMS) complies with the EVMS guidelines in the American National Standards Institute/Electronic Industries Alliance Standard 748, Earned Value Management Systems (ANSI/EIA-748) (current version at time of solicitation). The Government reserves the right to perform reviews of the EVMS when deemed necessary to verify compliance.
(2) If the offeror proposes to use a system that has not been determined to be in compliance with the requirements of paragraph (a)(1) of this provision, the offeror shall submit a comprehensive plan for compliance with the guidelines in ANSI/EIA-748.
(i) The plan shall—
(A) Describe the EVMS the offeror intends to use in performance of the contract, and how the proposed EVMS complies with the EVMS guidelines in ANSI/EIA-748;
(B) Distinguish between the offeror’s existing management system and modifications proposed to meet the EVMS guidelines;
(C) Describe the management system and its application in terms of the EVMS guidelines;
(D) Describe the proposed procedure for administration of the EVMS guidelines as applied to subcontractors; and
(E) Describe the process the offeror will use to determine subcontractor compliance with ANSI/EIA-748.
(ii) The offeror shall provide information and assistance as required by the Contracting Officer to support review of the plan.
(iii) The offeror’s EVMS plan must provide milestones that indicate when the offeror anticipates that the EVMS will be compliant with the guidelines in ANSI/EIA-748.
(b) If the offeror submits a proposal in an amount less than $100,000,000—
(1) The offeror shall submit a written description of the management procedures it will use and maintain in the performance of any resultant contract to comply with the requirements of the Earned Value Management System clause of the contract. The description shall include—
(i) A matrix that correlates each guideline in ANSI/EIA-748 (current version at time of solicitation) to the corresponding process in the offeror’s written management procedures; and
(ii) The process the offeror will use to determine subcontractor compliance with ANSI/EIA-748.
(2) If the offeror proposes to use an EVMS that has been determined by the CFA to be in compliance with the EVMS guidelines in ANSI/EIA-748, the offeror may submit a copy of the documentation of such determination instead of the written description required by paragraph (b)(1) of this provision.
(c) The offeror shall identify the subcontractors (or the subcontracted effort if subcontractors have not been selected) to whom the EVMS requirements will apply. The offeror and the Government shall agree to the subcontractors or the subcontracted effort selected for application of the EVMS requirements. The offeror shall be responsible for ensuring that the selected subcontractors comply with the requirements of the Earned Value Management System clause of the contract.

| 252.237-7024 | NOTICE OF CONTINUATION OF ESSENTIAL CONTRACTOR SERVICES (OCT 2010) |
| (a) | Definitions. “Essential contractor service” and “mission-essential functions” have the meanings given in the clause at 252.237-7023, Continuation of Essential Contractor Services, in this solicitation. |
| (b) | The offeror shall provide with its offer a written plan describing how it will continue to perform the essential contractor services listed in each task order statement of objectives during periods of crisis. The offeror shall– |
| (1) | Identify provisions made for the acquisition of essential personnel and resources, if necessary, for continuity of operations for up to 30 days or until normal operations can be resumed; |
| (2) | Address in the plan, at a minimum— |
| (i) | Challenges associated with maintaining essential contractor services during an extended event, such as a pandemic that occurs in repeated waves; |
| (ii) | The time lapse associated with the initiation of the acquisition of essential personnel and resources and their actual availability on site; |
| (iii) | The components, processes, and requirements for the identification, training, and preparedness of personnel who are capable of relocating to alternate facilities or performing work from home; |
| (iv) | Any established alert and notification procedures for mobilizing identified “essential contractor service” personnel; and |
| (v) | The approach for communicating expectations to contractor employees regarding their roles and responsibilities during a crisis. |
(End of provision) L-01 MDA Supplemental Subcontracting Plan Requirements (Oct 2009) In addition to the content requirements specified in the small business subcontracting plan clauses incorporated herein, plans submitted for consideration by the Contracting Officer shall include the following.

| L.3.2 | Written Communications |
| L.3.2.1 | The Joint National Integration Center (JNIC) Research and Development Contract (JRDC) provides all administrative and general services information technology support to the MDA. To minimize the risk of JRDC workforce access to interested party communications related to the IRES acquisition, the IRES Contracting Officer provides three secure methods for written communications. |
| L.3.2.2 | Send digitally signed and encrypted unclassified emails to the Contracting Officer at IRESCoreTeam@mda.mil. Commercial organizations that do not have an established Public Key Infrastructure (PKI) architecture that is trusted by the Federal Bridge can send encrypted, unclassified email to and receive encrypted, unclassified email from Department of Defense (DoD) entities by leveraging the external certification authority (ECA) Program. The DoD established the ECA program to support the issuance of DoD-approved certificates to industry partners and other external entities and organizations. The ECA Program is designed to provide the mechanism for these entities to securely communicate with DoD (e.g., exchange digitally signed and encrypted email) and authenticate to DoD information systems (e.g., access DoD websites). For information on how to obtain an ECA certificate, visit the DISA ECA PKI Program website. MDA requires the Medium Assurance ECA certificate and the Identity/Signature and Encryption certificate types. Encrypted email is the preferred method of written communications from prospective offerors. |
| L.3.2.3 | Mail hard copy or CD/DVD communications to the address in paragraph L.3.1. CD/DVD is preferred over hard copy. Please be aware that delivery of mail (even overnight mail) may be delayed by several days after arrival at Schriever Air Force Base (AFB). | L.3.3 | Errors, Omissions and /or Ambiguities |
If an offeror believes the requirements in these instructions or the solicitation, including any of the solicitation’s attachments, contain an error, omission, ambiguity, or are otherwise unsound, the offeror shall notify the Contracting Officer in writing with supporting rationale not later than May 31, 2016, 0800 MDT.
L.3.4 Solicitation Amendments The Government reserves the right to amend any portion of this solicitation. Amendments will be available on the FedBizOpps website at https://www.fbo.gov/. Offerors are encouraged to subscribe for real-time email notifications when information has been posted to FedBizOpps. If amendments include material changes, the proposal due date may be extended at the discretion of the Contracting Officer. In such cases, the amendment will include the new proposal due date and time.
L.3.5 Bidders’ Library Interested parties may request the IRES Bidders’ Library at any time using the attached IRES Request for Bidders’ Library and Document Handling and Safeguarding Procedures Agreement provided at Attachment L-01. Companies that have already requested the library need not submit another request to receive any and all updates. After receipt of proposals, offerors are the only parties that will be eligible to receive library updates.
L.3.6 Site Visit Reference FAR 52.237-1, Site Visit. A site visit was conducted on December 2, 2015. If additional site visits for self-identified prospective prime contractors are scheduled, the details will be published on the FedBizOpps website.
L.3.7 Pre-Proposal Conference The details associated with a pre-proposal conference, if conducted, will be published on the FedBizOpps website.
| L.3.8 | Use of Non-Government Support Services and Advisors |
| L.3.8.1 | Non-Government personnel from the companies identified below will be utilized in support and advisory roles. Contractor personnel supporting this acquisition have signed non-disclosure agreements (NDAs) and are subject to organizational conflict of interest (OCI) restrictions. These companies, having access to the proprietary information of others during source selection activities, are contractually required to protect proprietary data submitted by prospective offerors. | L.3.8.3 | If an offeror objects to disclosure of its submittals to non-Government personnel, the offeror shall provide its written objections to the Contracting Officer not later than May 31, 2016, 0800 MDT (or as specifically required in a solicitation amendment). If an offeror objects to disclosure of a portion of its proposal, it shall provide its consent for the remainder of the proposal to the Contracting Officer within the same timeframe. Written objections must include a detailed statement of the basis for the objection and identify specific portions of the proposal that are not to be disclosed to non-Government personnel. The Contracting Officer will adjudicate the identified concerns with the offeror to reach agreement on the appropriate resolution. |
| L.3.9 | Examination / Audit of Records and Preaward Survey |
The Contracting Officer, or an authorized representative of the Contracting Officer to include the Defense Contract Management Agency (DCMA) and the Defense Contract Audit Agency (DCAA), shall have the right to examine and audit all records necessary to permit an adequate evaluation of the proposed cost / price and offeror business systems. A preaward survey or similar survey may be accomplished to support a determination regarding any or all of the contractor responsibility factors identified in FAR Subpart 9.1 as supplemented. The survey may be conducted with the assistance of DCMA and DCAA and may include, if necessary, the examination and audit of all records to permit an adequate evaluation of contractor responsibility.
L.3.10 Major Subcontractor Throughout this solicitation and unless otherwise stated, “major subcontractor” is defined as a subcontractor, teammate, or partner: 1) whose proposed effort provides 10% or more of the proposed total price of the task orders associated with Attachments L-08, L-10, L-11, and L-12; or 2) included in the offeror’s Contract Data Matrix at Attachment L-04.
L.3.11 Classified Data Classified submissions from offerors are not requested or authorized.
L.3.12 Alternate Proposals Alternate proposals will not be considered.
L.3.13 Awardable Task Orders The Government reserves the right to award task orders associated with Attachments L-08, L-10, L-11, and L-12 in conjunction with contract award or at any time during the transition period following award of the basic contract. All information necessary to negotiate and prepare the task orders for award is included / requested in the solicitation or will be obtained during the discussion / negotiation process. If those task orders are to be awarded in conjunction with the basic contract award and without further negotiation, those task orders in their negotiated format will be provided to each offeror in the competitive range for signature and submittal with its final proposal revision.

L.4.3 Proposal Delivery All proposals shall be hand-delivered to the IRES representative at the Schriever AFB Visitor’s Center/Pass and Registration (Building 15, on the right immediately prior to entering the North/Main/Enoch gate on Enoch Road) on the dates specified in Exhibit L-1, 0900 – 1400 MDT. Early submission of proposals can be accommodated if delivery date / time are pre-coordinated with the Contracting Officer identified in paragraph L.3.1 at least 3 days prior to the delivery date. To ensure an IRES representative is at the Visitor’s Center to receive the proposal, offerors shall confirm their delivery date and time with the Contracting Officer identified in paragraph L.3.1 at least 3 calendar days prior to the delivery date.
L.4.4 Packaging and Marking All copies, paper and electronic, of an offeror’s proposal shall be submitted together in accordance with the due date for the particular volumes defined in Exhibit L-1. Offeror and team member information (including sealed packages) must be packaged into the proposal submission. The proposal may be submitted in multiple boxes. If multiple boxes are used, the outside of each box is to be labeled with the box numbered (e.g., box 1 of 3) on the top and sides. An inventory of the contents of each box (e.g., Vol 1, “#” binders, Vol 2, “#” binders) should be enclosed within the box.
L.4.5 Receipt Bring two copies of the delivery receipt for the IRES representative to sign. The IRES representative will keep one signed receipt and provide the other signed receipt to the offeror’s delivery person.
L.4.6 Proposal Expiration Date Proposals in response to this solicitation shall be valid for at least 270 days after the proposal due date.

The offeror’s assessment of whether or not a particular contract or relationship may create and actual or potential OCI must consider the general rules in FAR Subpart 9.505 and Defense FAR Supplement (DFARS) Subpart 209.5, including the following types of potential or actual OCIs: (a) impaired objectivity, (2) biased ground rules, (3) unequal access to information; and (4) Systems Engineering and Technical Assistance (SETA) (reference L.6.3.4). Include an index that identifies the prime, each subcontractor, and the list of the disclosure documents submitted for each. |
| L.6.2.2 | To protect sensitive data, subcontractors may submit a sealed package with the sensitive portions of their disclosures to the prime contractor for inclusion with the prime contractor’s submission to the Government. The prime contractor, however, is responsible for an independent OCI assessment and comprehensive mitigation plan for itself and all subcontractors. |
| L.6.3 | Tab 1c: Organizational Conflict of Interest (OCI) Management and Mitigation Plan |
| L.6.3.1 | Submit an OCI Management and Mitigation Plan that addresses internal processes and procedures for identifying, evaluating, and resolving actual or potential OCI, both prior to and after contract award, for the prime contractor (including affiliates) and all subcontractors (including affiliates). The plan shall describe the offeror’s approach to supply chain risk management, including how the offeror will identify the risks to the supply chain and the risk management strategies employed to counter those risks in accordance with Tier 2 and 3 tasks identified in NIST 800-161, Supply Chain Risk Management Practices for Federal Information Systems and Organizations, dated April 2015. The offeror’s plan shall also address the appropriate controls to ensure their subcontractor’s plans comply with supply chain risk management requirements in accordance with DoD 5200.44 and Software Assurance Countermeasures in Program Protection Planning dated March 2014. |
| L.6.4.2 | Identify critical components and subcomponents in their system design and describe how the offeror will ensure visibility into the supply chain and to ensure the integrity of those critical components and subcomponents. The offeror shall describe their process to verify that critical function components received from suppliers are free from malicious code, counterfeit parts or unauthorized product substitution (e.g., seals, inspection, secure shipping, testing, etc.). |
| L.6.4.3 | Identify known suppliers and subcontractors within the contractor’s supply chain. | L.6.5.1 | Submit a plan detailing the approach to safeguarding Covered Defense Information within the contractor’s (offeror and all subcontractors) facilities in accordance with National Institute of Standards and Technology (NIST) Special Publication (SP) 800-171, Protecting Controlled Unclassified Information in Nonfederal Information Systems and Organizations, as identified in DFARS 252.204-7012, Safeguarding Covered Defense Information and Cyber Incident Reporting. The NIST 800-171 security requirements shall be extended to include all Covered Defense Information (CDI) which resides on, or transits through the contractor’s (offeror and all subcontractors) unclassified information technology systems. As required by DFARS 252.204-7008, Compliance with Safeguarding Covered Defense Information Controls, the offeror shall identify in this plan any request to deviate from NIST SP 800-171. An authorized representative of the DoD CIO will approve or disapprove offeror requests to deviate from NIST SP 800-171 requirements, as extended to include all CDI as described in this paragraph, in writing prior to contract award. |
| L.6.5.2 | Describe the policies, procedures, and standards used to safeguard and protect CDI from unauthorized access, disclosure, incident, or compromise provided by or generated for the Government (other than public information) that transits or resides on any non-Government information technology system (offeror and all subcontractors) from both internal and external sources. |
| L.6.5.3 | Describe the procedures to track and report Cybersecurity incidents at offeror (and subcontractor) facilities. |
| L.6.5.4 | Validate that any IT service either utilized or provided by them (offeror and subcontractor) leveraging cloud computing in the execution of the IRES contract are executed in accordance with the provision described in DFARS 252.239-7010, Cloud Computing Services. |
