AMENDMENT 0005
The Purpose of this Amendment 0005 is to revise the Government’s response to Requests for Information and to provide Revised Factor 1 – Recent, Relevant Experience of the Firm.
1) The following are Revised Responses to Requests for Information:
Question #12: Factor 1 of the RFP states that project experience must have been "awarded within the last five (5) years prior to the initial solicitation issuance date;" Operations & Maintenance contracts typically run anywhere from 5 - 20 years in duration (from award through options years). We respectfully request the Government revise this to state "awarded within last ten (10) years."
Response #12: Factor 1 remains unchanged; pursuant to Factor 1 – Recent, Relevant Experience of the Firm, a relevant project is a project or task order that “was awarded within the last five (5) years prior to the initial solicitation issuance.” Factor 1 – Recent, Relevant Experience of the Firm has been revised.
Question #59: Project experience requires that a project, contract, or task order must have been awarded within the last 5 years. Since most O&M contracts include a Base Year plus 4 to 9 Option Years, are Offerors permitted to submit an Option year as relevant project as long as it was awarded within the last 5 years and meets all other minimum requirements as indicated in Factor 1?
Response #59: No. Pursuant to Factor 1 – Recent, Relevant Experience of the Firm, a relevant project is a project or task order that “was awarded within the last five (5) years prior to the initial solicitation issuance.” Factor 1 – Recent, Relevant Experience of the Firm has been revised.
Question #66: Many recent O&M contracts at DoD facilities are part of longer-term design-build-operate contracts.
As such the "award date" is greater than 5 years ago. The O&M, either as an exercised option or a continuation of the contract will have started within the past 5 years, however, is not a stand-alone contract. May Offerors use that experience, as long as the annual costs are broken out.
Response #66: No. Pursuant to Factor 1 – Recent, Relevant Experience of the Firm, a relevant project is a project or task order that “was awarded within the last five (5) years prior to the initial solicitation issuance.” Factor 1 – Recent, Relevant Experience of the Firm has been revised.
Question #75: Typically, RFP project experience criteria is designed to assess Offerors’ recent and relevant experience, however, Factor 1 of the RFP states that project experience must have been "awarded within the last five
(5) years prior to the initial solicitation issuance date". The award date of a project has less significance than the recency and relevancy of the work. We request that NAVFAC consider revising this requirement to “performed within the last five (5) years prior to the initial solicitation issuance date.”
Response #75: Factor 1 reflects the Government’s intent; pursuant to Factor 1 – Recent, Relevant Experience of the Firm, a relevant project is a project or task order that “was awarded within the last five (5) years prior to the initial solicitation issuance.” Factor 1 – Recent, Relevant Experience of the Firm has been revised.
2) The conformed changes to Factor 1 follow in 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014).
The revision to Factor 1 – Recent, Relevant Experience of the Firm is, as follows:
(a) Factor 1 - Recent, Relevant Experience of the Firm:
Solicitation Submittal Requirements: Submit Exhibit B (Recent, Relevant Experience of Firm Project Data Sheet) for each project under Tab “1”. Exhibit B is MANDATORY. The Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total page limit for each project data sheet shall not exceed three (3) single-sided 8.5” x 11” pages. The offeror shall ensure this form is complete and calculations are correct.
NOTE: Projects submitted under Factor 1 - Recent, Relevant Experience of Firm must be the same projects submitted for Factor 4 - Past Performance.
(i) Submit a minimum of one (1) and a maximum of two (2) relevant projects for the offeror as the Prime Contractor that best describes the offeror’s experience on projects that are similar in size, scope, and complexity to the projects that may be ordered under the solicited contract.
(ii) Project experience is defined as a project performed under a single task order or contract For multiple award contracts and IDIQ type contracts, the contract as a whole shall not be submitted as a project; rather the offeror shall submit the work performed under a task order project. For the purposes of this evaluation, a relevant project is further defined as a government or commercial contract, project or task order that: Project experience is defined as recurring services for operations and maintenance performed under a single award. Projects will only qualify for consideration when recurring requirements are funded for the period of performance; consequently, IDIQ type contracts for non-recurring requirements are disqualified from consideration. For the purposes of this evaluation, a relevant project is further defined as a government or commercial contract that:
1) Is at least 50% self-performed as the Prime Contractor in terms of the cost of contract performance; Was actively in performance within the last five (5) years prior to the initial solicitation issuance date;
2) Is at least 50% complete in terms of amount paid for contract performance; Was actively self-performed at least 50%, in terms of cost, as the Prime Contractor for a duration of twelve (12) months or more;
3) Was awarded within the last five (5) years prior to the initial solicitation issuance date; Has a total annual award value of $1 Million or more (at the date of contract award); and;
4) Has a period of performance of 12 months or more;
5) Has a total annual award value of $1 Million or more (at the date of contract award); and
6) Demonstrates experience in Annex 1604000 Wastewater for services related to the operation and maintenance of wastewater treatment plants similar in size (treating at least .5 Million Gallons per Day) at a tertiary treatment plant.
(iii) The Government will not consider any project submitted for experience that was performed by a firm other than the offeror, except:
1) If the offeror is a Joint Venture (JV), relevant project experience shall be submitted for project(s) completed by the JV entity. If the JV does not have shared experience, relevant projects shall be submitted for each JV member provided the JV offeror’s proposal includes a copy of the supporting JV agreement identifying the firm in question as a member of the JV for this procurement in the Price Proposal under Tab #5.
2) The Government will consider otherwise relevant projects that were performed by the offeror’s proposed key personnel; however, experience of proposed subcontractor employees will not be considered; and,
3) The Government will consider otherwise relevant projects performed by affiliates/subsidiaries/parent/Limited Liability Company (LLC)/ Limited Company (LTD) member companies (i.e. any office(s) of the offeror other than the one (1) submitting the current proposal as stated on the SF1449), provided the proposal clearly e xplains thatthe affiliates/subsidiaries/parent/LLC/LTD firm will have meaningful involvement in the performance of this contract.
Regarding such submitted project(s), if the offeror fails to demonstrate the affiliate/subsidiary/parent/LLC/LTD meaningful involvement in the performance of this contract, the project may not be considered relevant and may not be evaluated.
(iv) Exhibit B, Offeror Recent, Relevant Experience of the Firm Project Data Sheets submitted that exceed the maximum, three (3) single-sided 8.5” x 11” page limit will be removed prior to evaluation. Exhibit B Project Data Sheets submitted for multiple award contracts and/or IDIQ type contracts as a whole will be removed prior to evaluation. Exhibit B Project Data Sheets submitted for projects that are not at least 50% complete within five (5) years prior to the solicitation issuing date will be deemed not similar in scope and not relevant.
The Government reserves the right to contact the POC for each project to confirm at least 50% of the project was completed within the last five (5) years in terms of the amount paid for contract performance, at least 50% self-performed in terms of the cost of contract performance, and the accuracy of any other project information provided for evaluation.
*Self-Performed: Refers to the offeror who performs relevant work that is the same or similar in size, scope and complexity of the work requirements in the solicitation, by in-house workforce and not by sub-contractor(s). This does not include administrative or management functions.
(v) For each project, the offeror shall provide a detailed description of work and identify the percentage (%) and dollar amount that the firm selfperformed for each annex. Each project must demonstrate self-performance experience in Annex 160400 Wastewater for services related to the operation and maintenance of wastewater treatment plants similar in size (treating at least .5 Million Gallons per Day) at a tertiary treatment plant.
(vi) Basis of Evaluation: The basis of evaluation will include the offeror’s demonstrated experience in performing relevant work that is the same or similar in size, scope and complexity of the work requirements in the solicitation.
The assessment of the offeror’s relevant experience will be used as a means of evaluating the ability of the offeror to successfully meet the requirements of the solicitation. The Government will only review two (2) projects; any projects submitted in excess of the limitation will not be considered.
The offer may be rated “Acceptable” for this factor if the offeror submits a minimum of one (1) relevant project that complies with all of the following:
1) Are at least 50% self-performed as the Prime Contractor in terms of the cost of contract performance; Was actively performed within the last five (5) years prior to the initial solicitation issuance date;

6) Demonstrate experience in Annex 1604000 Wastewater for services related to the operation and maintenance of wastewater treatment plants similar in size (treating at least .5 Million Gallons per Day) at a tertiary treatment plant.
3) All other terms and conditions remain unchanged.

If subject to the reporting requirements, companies must file an annual VETS-4212 Report, which shows the number of covered veterans in their workforce and number of new hires, including covered veterans hired during the reporting period. Instructions, information, and follow-up assistance is provided at VETS-4212 Internet site at http://www.dol.gov/vets/vets4212.htm or employers may contact the VETS-4212 customer support at

VETS-4212 Reports must be filed between August 1 and September 30 of each year following a calendar year in which a contractor or subcontractor held a covered contract or subcontract.
Upon the successful submission of a VETS-4212 report, federal contractors will receive an email confirmation of receipt notification for their records. 4212(d) for that fiscal year.
(2) Basis of Evaluation: The Government will evaluate price based on the total price for the proposed award. Total price consists of the reccuring and non-recurring basic requirements and all option items. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in Section M of the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s). Analysis will be performed by one (1) or more of the following techniques to ensure a fair and reasonable price:
(a) Comparison of proposed prices received in response to the solicitation.
(b) Comparison of proposed prices with the IGCE.
(c) Comparison of proposed prices with available historical information.
(d) Comparison of market survey results.
A price that is found to be unreasonably high in relation to the proposed work may result in the overall proposal being considered Unacceptable. The burden of proof of price reasonableness rests solely with the offeror.
The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. In order to promote efficient competition, proposals will be initially screened for price and placed in order of price (lowest price to highest price).
Price evaluation will be conducted for all proposals independently by the SSEB Price Evaluator to ensure fair and reasonable pricing. A written evaluation documenting the outcome of the analysis of price proposals will be prepared as part of the SSEB Report and will include a narrative determination of price reasonableness/unreasonableness explaining all aspects of price proposals supporting the determination.
b. Technical Factors:
(1) Solicitation Submittal Requirements: Submit an original & four (4) copies, plus one (1) CD (with documents in Microsoft Word). Technical proposal copies shall be submitted in three-ring binders separate from price proposals, and clearly marked: Volume 2- Technical Proposal. For the purposes of this evaluation, a relevant project is further defined as a government or commercial contract that:
1) Was actively in performance within the last five (5) years prior to the initial solicitation issuance date;
2) Was actively self-performed at least 50%, in terms of cost, as the Prime Contractor for a duration of twelve

Exhibit B Project Data Sheets submitted for multiple award contracts and/or IDIQ type contracts as a whole will be removed prior to evaluation. Exhibit B Project Data Sheets submitted for projects that are not at least 50% complete within five
(5) years prior to the solicitation issuing date will be deemed not similar in scope and not relevant.
