About this file
This document is an amendment to a solicitation for a Design-Build/Design-Bid-Build, Indefinite Delivery/Indefinite Quantity Multiple Award Construction Contract for facilities primarily in the Hampton Roads Area of Responsibility in Virginia. The amendment revises the small business utilization factor and provides updated attachments and wage determinations. The solicitation seeks to award multiple IDIQ contracts for large general construction projects with a total maximum value of $950 million to be used for small business participation evaluation. Offerors must demonstrate a history of small business utilization and propose a minimum of 20% total small business participation including meaningful participation from small businesses, HUBZone small businesses, women-owned small businesses, small disadvantaged businesses, veteran-owned small businesses, and service-disabled veteran-owned small businesses. The amendment provides updated attachments for historical small business utilization, proposed small business subcontracting commitments, and a revised wage determination.

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE (SF 30)
The following have been added by full text:
This amendment hereby:
1. Revises Factor 4, Small Business Utilization
2. Provides Attachments D and E. All previous versions of Small Business Utilization attachments (Att C and Att E) have been replaced by Attachment D (Historical Small Business Utilization) and Attachment E (Small Business Participation Commitment Document (SBPCD)). Both Attachments D and E shall be submitted with Factor 4, Small Business Utilization.
3. Provide Attachment G, Small Business Subcontracting Plan. Attachment G Shall be submitted as part of the price proposal regardless of any changes in pricing.
4. Provide Updated Wage Decision
1. Factor 4, Small Business Utilization, is replaced in its entirety with the following:
Factor 4 – Small Business Utilization:
(i) Solicitation Submittal Requirement:
The total contract value to be used when developing a response to this Factor is the MACC contract value:
$950,000,000.
It is the policy of the Government to provide maximum practicable opportunities in its acquisitions to Small Business (SB) concerns, including Historically Underutilized Business Zone Small Business (HUBZone SB), Woman-Owned Small Business (WOSB)/Economically Disadvantaged Woman-Owned Small Business (EDWOSB), Small Disadvantaged Business (SDB), Veteran-Owned Small Business (VOSB), Service-Disabled Veteran-Owned Small Business (SDVOSB), and other small business concerns. Further, it is the policy of the Government that such concerns will have the maximum practicable opportunity to participate in contract performance consistent with its efficient performance.
This Factor assesses both the Offeror’s historical achievements in utilizing small business concerns and its proposed small business participation commitment and strategy for this requirement. The Offeror is required to demonstrate its previous commitment to SBs through its record of past utilization of SBs and its planned level of commitment to small business if awarded a contract under this solicitation.
A. Historical Achievements
In order to assess the Offeror’s historical achievements in utilizing small business concerns, all Offerors (both Other than Small Businesses (OTSB) AND SBs) shall use Attachment D (Historical Small Business Utilization) to demonstrate their historical utilization of SBs. Each project submitted under Factor 1, Experience, shall be included on Attachment D. Failure to include any project submitted under Factor 1, Experience, or failure to fully complete Attachment D may result in a Deficiency. Further instructions regarding how to complete Attachment D are included at the beginning of the attachment.
B. Planned Level of Commitment and Narrative.
The minimum required planned small business participation during performance of the contract is 20% of the total MACC contract value. Large business Offerors may achieve the minimum total small business participation requirement through subcontracting to small businesses. Small business Offerors may achieve the minimum total small business participation requirement through their own performance/participation as a prime and also through a joint venture, teaming arrangement, and/or subcontracting with other small business concerns. Offerors are encouraged to exceed the minimum total small business participation requirement of 20% and seek meaningful levels of participation in each of the specific small business categories (i.e., SB, HUBZone SB, WOSB, SDB, VOSB, and SDVOSB) consistent with efficient contract performance.
In order to assess the Offeror’s proposed small business subcontracting planned level of commitment and small business engagement strategy for this MACC, Offerors are required to provide a completed Attachment E and a narrative in accordance with the following:
1. Attachment E: All Offerors (both OTSBs and SBs) shall use Attachment E (Small Business Participation Commitment Document (SBPCD)) to submit the following information for evaluation of this factor utilizing the total MACC contract value as noted above:
A. Offeror Information and Subcontracting Breakdown (Blocks 1 and 2 on Attachment E) B. Planned/Proposed Subcontractors for products and services to be awarded under this contract
(Blocks 3.a. through 3.f. on Attachment E) in accordance with the following:
a. When possible, identify all Planned Subcontractors by name that will be used to support each specific small business category (i.e., SB, HUBZone SB, WOSB/EDWOSB, SDB, VOSB, and SDVOSB) and the type and complexity of product/service to be subcontracted.
i. Offerors should also include the type of commitment (i.e., teaming agreement, letter of commitment, etc.) with each subcontractor to the maximum extent practicable.
b. If specific Planned Subcontractors are not yet identified for a particular small business category, the topic should be addressed in the required narrative, see section 2 below.
(Note: All Offerors are required to be compliant with section 2, even if Planned Subcontractors have been identified.)
2. Narrative: All Offerors shall provide a narrative, limited to 4 single-sided (or 2 double-sided) pages that addresses the following:
A. State the Offeror’s proposed small business participation in both dollar value and as percentage of the total MACC contract value. All Offerors who are not able to meet the minimum total small business participation requirement of 20% (of the total MACC contract value) shall provide a detailed explanation why the minimum total small business participation requirement cannot be achieved.
B. Provide a detailed explanation to support the Offeror’s proposed total small business participation rate for the duration of this MACC. Note that simply proposing a 20% total small business participation rate without describing the methods used to support the figure may result in a Deficiency. The detailed explanation shall include, but is not limited to, the following:
a. Types of supplies or services to be subcontracted.
b. The percentage of the total MACC contract value planned to be subcontracted to each of the specific small business categories b.1. Small Business, b.2. HUBZone SB, b.3. WOSB/EDWOSB, b.4. SDB, b.5. VOSB, and b.6. SDVOSB
c. The specific methodology, resources, and/or tools used to develop the percentage for each specific small business category listed above. If the Offeror projects that it will be unable to subcontract any work to a specific small business category and/or did not identify any Planned Subcontractors for a specific small business category in Attachment
E, the Offeror shall provide an explanation detailing why it does not anticipate subcontracting to the referenced category of businesses.
d. Specific initiatives and strategies that the Offeror will use to ensure it will meet the proposed percentages of the total MACC contract value planned to be subcontracted for each of the specific small business categories for the maximum five year duration of this
MACC.
C. If the Offeror does not intend to subcontract any work during performance of the MACC, provide a detailed explanation as to why subcontracting would not result in efficient contract performance.
(Note: Offerors proposing to subcontract to small businesses are not required to address this item.)
(ii) Basis of Evaluation:
The Government will evaluate the realism of the Offeror’s subcontracting projections and its likelihood of success in achieving the small business objectives of this acquisition based on the following:
A. Historical Achievements:
The extent to which the Offeror is able to demonstrate a history of supporting Government policies concerning the utilization of small business concerns (including all of the various socioeconomic categories of SB, HUBZone SB, WOSB/EDWOSB, SDB, VOSB, and SDVOSB) and the success in achieving goals established by subcontracting plans on prior contracts. If the submitted Project(s) did not have goals established by subcontracting plans, the Project(s) will be evaluated based on the actual small business participation rate in terms of demonstrating a history of supporting the utilization of small business concerns.
B. Planned Level of Commitment and Narrative.
1. Attachment E: The extent to which the Offeror has identified Planned Subcontractors by specific small business category, including subcontractor names and type and complexity of products/services to be subcontracted in Attachment E and, if applicable, the degree of commitment to use named sources as evidenced by identifying the type of commitment.
2. Narrative: The extent to which the Offeror has demonstrated an achievable commitment to use small businesses (including SB, HUBZone SB, WOSB/EDWOSB, SDB, VOSB, and SDVOSB) in the performance of this MACC. This will include evaluating the realism of :
a. The complexity and variety of the work small business concerns will perform.
b. The proposed percentages of the total MACC contract value planned to be subcontracted to each of the specific small business categories (i.e., SB, HUBZone SB, WOSB/EDWOSB, SDB, VOSB, and SDVOSB)
c. The specific methodology, resources, and/or tools used to develop the percentage for each of the specific small business categories. If applicable, the explanation of why the Offeror projects that it will be unable to subcontract any work to a specific small business category and/or did not identify any Planned Subcontractors for a specific small business category in Attachment E.
d. The specific initiatives and strategies the Offeror will use to ensure the proposed percentages of the total MACC contract value planned to be subcontracted for each of the specific small business categories are met for the maximum five year duration of this
MACC.
The Offeror may be considered more favorably if:
A. It identifies specific Planned Subcontractors for particular small business categories.
B. It identifies specific types of commitments with Planned Subcontractors.
C. It exceeds the 20% minimum total small business participation requirement percentage and developed its proposed goal through realistic methodology, resources, and/or tools and if the proposed subcontracting level is consistent with efficient contract performance.
D. It proposes meaningful levels of participation in the specific small business categories (i.e., SB, HUBZone SB, WOSB, SDB, VOSB, and SDVOSB) and developed its proposed utilization through realistic methodology, resources, and/or tools and the goals are consistent with efficient contract performance.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
