GOVERNMENT RESPONSE: Question answered in Amendment 0005. Page 3. Number 6.
4. The government response to questions #4, regarding government sponsorship of contractors for US Secret Clearance states the question must be responded to by the DoD Security Office.
Note, for workers to submit for their US Secret clearance they must be sponsored or have a reason for requesting clearance. Thus, we need to confirm NAVFAC will act as a sponsor for additional workers to request clearance.
GOVERNMENT RESPONSE: Per the JADOC Chief of Intelligence and Security and ICD‐750 Chapter 3.B.5, there is no requirement for the construction contractor to have active security clearance. Consequently US Security Clearance sponsorship is not needed for the project.
5. Please advise who we should contact in the DoD Security Office to confirm NAVFAC can sponsor workers for this project?
GOVERNMENT RESPONSE: Refer to RFI question # 4.
6. Please confirm the “secure areas” which requires US‐Secret Cleared personnel when performing work per specification 01 14 00 is only for work within the existing building and the ICD‐705 Areas on the 2nd floor (Room 251, 251A, and 251B) as noted on the Security Drawings.

GOVERNMENT RESPONSE: Please refer to the solicitation.
13. 01 30 01.00 23 does not note any requirement for AV nor is there a typical Planned MOD for AV. The only item noted as AV is the Public Address Systems.
GOVERNMENT RESPONSE: There is no Planned MOD for AV systems. The Public Address System and all those components on note 12 sheet T‐401 should be included in the base BID, CLIN 001AA.
14. Please confirm the Contractor is not responsible for any AV design or procurement except for the Public Address Systems.
GOVERNMENT RESPONSE: Confirmed
15. In amendment 3, RFI #5 states see the CSP files “JADOC CSP2021‐10‐05‐114956.pdf.” However, this document was not provided with Amendment 3 nor Amendment 4. Only an except was provided. Please provide the entire file or confirm a complete file will not be provided as noted in Amendment 3.

17. In Amendment 4, the Government’s Response to RFI #60 states, “the ESS installation by the GC is limited to "rough in". Meaning conduit with pull strings and back boxes as described in the General Notes. Therefore, systems specifications are not required.”
GOVERNMENT RESPONSE: See attached revised price schedule.
18. Please confirm CLIN 0002 should not be price and will be removed from the Price Schedule. All “rough in” for the ESS will be in the Base Bid CLIN 0001AA.
GOVERNMENT RESPONSE: CLIN002 is valid. Construction contractor is to purchase ESS equipment. All "rough in" are included in CLIN001AA.
19. 09 69 13 – Rigid Grid Access Flooring paragraph 3.4 – Fire Safety, identifies an Automatic detection system below the raised floor.

23. Section 41 22 23.19 Monorail Hoists, Paragraph 2.2.1 Monorail Track System states to provide monorail and support structure for underrunning monorail of rolled steel shapes confirming to CMA 74, patented track beams conforming to MHI MH27.1, or enclosed track beams conforming to MHI MH27.2. The general specification from wbdg.org which this is extracted from notes under Paragraph 2.2.2 Monorail Track System that Monorail tracks may be of three types. "Patented track" as defined in the definitions section and built IAW MHI MH27.1, "enclosed track" built IAW MHI MH27.2 and "rolled steel shapes" which is defined in CMAA 74. The activity may decide the track type to be used or allow the provider to decide, except ordinance handling cranes require patented track.
GOVERNMENT RESPONSE: Please consider "patented track" monorail track system for bidding purposes.
24. 41 22 23.19 opens by referencing the NAVCRANECEN INSTRUCTION 11450.2A for design criteria and requirements. 11450.2A, 2‐1.5.2.1 Rails Paragraph (a) states that the recommended monorail beam design is the “patented track” type beam designed in accordance with MMA MH27.1. Rolled structural steel shape monorails shall be designed in accordance with CMAA #74. Enclosed track monorail systems are not recommended, but if utilized, shall be designed in accordance with MMA MH27.2. 11450.2A, B‐1.2.2 notes that the NCC specifies patented track rails, and B‐1.2.4 notes that the standard patented track is governed by MH27.1, and enclosed beams under MH27.2 should only be considered for capacities less than 2,000 lbs.
GOVERNMENT RESPONSE: Please consider "patented track" monorail track system for bidding purposes.
25. There is a SIGNIFCIANT price difference between patented track and enclosed track rails. Please confirm that enclosed track per MHI MH27.2 is acceptable to the end users, or if they would rather the NCI standard patented track rails.
Note 5 and Note 9 on Sheet AD100 state to remove approximately three (3) and eight (8) access floor panels, respectively. Note 21 on Sheet A‐102 states to replace approximately eight (8) access floor panels per modified partition similar in type and make of existing access floor system. There is no note on A‐102 that calls for the remaining three (3) panels to be replaced. Please confirm that along with Note 21 on Sheet A‐ 102, the remaining three (3) panels from AD100 also need to be replaced.
GOVERNMENT RESPONSE: Refer to RFI Question #23 MHI MH27.2 , RFI question #25 which refers to monorail track systems. Refer to RFI question #26 floor panel and RFI question #25 which refers to access floor panels.
26. Note 21 on Sheet A‐102 states to replace approximately eight (8) access floor panels per modified partition similar in type and make of existing access floor system. Please provide the type and make of the existing raised access floor system.
GOVERNMENT RESPONSE: Type and make of the existing access floor system that they currently have in JADOC II’s Tate raised access floor.
27. Sheet A‐612 provides the details for Wall Type 1W, SW, and 0W. Sheet A‐613 shows another wall type that is tagged as 0W. Please confirm that the Wall Type 0W on Sheet A‐613 is supposed to be Wall Type 0AE being that is listed between Wall Types 0AD and 0AF.
GOVERNMENT RESPONSE: Confirmed, partition type 0W on sheet A‐613 is supposed to be Partition Type
0AE.
28. Wall Type 0H on Sheet A‐610 calls for a minimum of 3‐1/2” sound attenuation blanket insulation but no insulation is shown on the detail. Please confirm whether Wall Type 0H should have blanket insulation.
GOVERNMENT RESPONSE: Insulation in partition Type 0H & 0F are not required.
29. Referencing the amended price schedule in amendment 06. Please clarify the price and scope to be carried in CLIN 02 as the Electronic Security Systems are clarified to be provided by a government contractor and the infrastructure is to be carried in CLIN 01AA. Is the "Government's ESS contractor" to be carried as an allowance?
GOVERNMENT RESPONSE: Please refer to question #18.
30. Amendment 03 deleted amendment 02 stating “The following have been deleted: AMENDMENT 0002” This amendment included the latest wage determination. Please provide an updated wage determination.
GOVERNMENT RESPONSE: See attached current wage rate determination.
31. A previously submitted RFI & response stated: “Please clarify if we are to provide a unit price or lump sum price for CLINs 0003 and 0004. If we are to provide a lump sum price, then please provide the quantity that should be included for each CLIN. GOVERNMENT RESPONSE: Please provide a unit price for CLINs 0003 and 0004.” Are bidders to simply insert a unit cost in that line (ie $/ton) or was there supposed to be a unit price, quantity and extension line on the bid form for CLIN03 and 04?
GOVERNMENT RESPONSE: See attached revised price schedule.
32. . A previously submitted RFI & response stated: “GOVERNMENT RESPONSE: The Site Security Manager prepared a CSP for the project. Please see the "JADOC CSP2021‐10‐05‐114956.pdf” This document does not appear to be included in the amendment. Please provide.
GOVERNMENT RESPONSE: Already answered in #005. “The Site Security Manager prepared a CSP for the project. Security procedures are detailed in the specifications. Personnel requirements from the CSP can be shared. See pdf "P‐5001 CSP Excerpt"”
33. . Please confirm that the Contractor is to include the TY series infrastructure in the base bid offer.
34. . Please clarify: If the “Government's ESS contractor will provide and install the ESS equipment” presumably under a separate contract per the RFI response, then what equipment (or other cost items) are the contractors to include with CLIN 0002 ‐ Option 1: Electronic Security Systems Equipment:”?
GOVERNMENT RESPONSE: Please refer to question 29.
35. Can the Government confirm that the “option” columns in (1) the chart on the last page of Attachment E (p.
5) and (2) the chart on the last page of Attachment F (p. 12) the Individual Small Business Subcontracting Plan template apply to option years (which are inapplicable to this project and are related more to a MATOC submission) rather than the optional scopes of work associated with this project? Each chart includes text that indicates that these “option” columns apply to years only (specifically, the footer in item 1 above and the header in item 2 above) and are therefore inapplicable to this submission.
GOVERNMENT RESPONSE: Please submit attachments and documents in accordance to the solicitation.
36. Reference RFI # 19 response related to CLIN 0002 Option 1 for the ESS ‐ the response references Note 13 which we assume to be referring to Note # 10 on TY‐001. Please confirm. The response to the RFI reads:
“GOVERNMENT RESPONSE: The intent of the TY series of drawings is to depict an ESS INFRASTRUCTURE ONLY design. The breakout of responsibilities is discussed in Note 13 of TY‐001. The Government's ESS contractor will provide and install the ESS equipment.”
GOVERNMENT RESPONSE: Please refer to question 29.
37. Regarding RFI Response 16 in Amendment 003, please confirm that the cost for providing the gas meter and the gas main extensions as noted on CU101 shall be included in our base price for CLIN 001A.
GOVERNMENT RESPONSE: Gas service relocation and extension are to be provided by natural gas provider.
Installation cost for the work is to be determined and coordinated with natural gas provider. The intent is for the bidding contractor to have any and all cost for the gas service line extension and meter included in their bid.
38. Page 10 – please confirm that the three (3) complete fiscal year financial statements can be 2018, 2019, 2020, whereas complete financial statement for 2021 may not be completed yet.
GOVERNMENT RESPONSE: Confirmed, years 2018, 2019 and 2020 are acceptable.
39. Factor 1 (Experience): Would the government consider increasing the look‐back period for relevant projects from 5 years to 10 years? 10 years is an increasingly common look‐back period in solicitations and the difference between 5 and 10 years is negligible, while the adjustment may allow offerors to provide more relevant projects for the government’s consideration, with no reduction in the government’s ability to evaluate relevancy.
GOVERNMENT RESPONSE: Factor 1 Experience is hereby revised: Projects submitted for the offeror shall be completed within the past ten (10) years prior to the date of issue of this RFP.
GOVERNMENT RESPONSE: Factor 4, Past Performance: Recency and relevancy is defined as:
Recency is projects submitted for the Offeror shall be completed within the past ten (10) years prior to the date of issuance of this RFP.

** Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($15.00) or 13658 ($11.25). Please see the Note at the top of the wage determination for more information.
Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
