AMENDMENT 0006
1. RFP Price Schedule Questions Attachment H Price Schedule note #5 states that that Item 0003 may be exercised at the time of award or within 120 calendar days after award and Item 0004 may be exercised no later than 9-months prior to construction contract completion. It is assumed this is referring to CLIN 0003-004.
a) First both of these CLINs are for soil related items which may be recognized early in the project. Please revise the Price Schedule to make these CLINS Unit price items with an estimated quantity.
GOVERNMENT RESPONSE: See attached revised price schedule.
b) It is assumed if excess and unsuitable soil is encountered and required base fill material, the government will immediately award these options to reduce impact to the project. The 120 days is only for the contractor to honor that unit price.
GOVERNMENT RESPONSE: The contractor will honor the unit price for 120 days.
c) Please the 9-months is regarding CLIN 0005 – Planned MOD 1 for FF&E not CLIN 0004.
GOVERNMENT RESPONSE: The nine months is for the planned mod. See attached revised price schedule.
d) Attachment H Price Schedule note #5 states the Government may award Options 1-3 (CLINS 0002-0004) up to 365 calendar days after contract award without extending the contract duration. This contradicts note #5 and would greatly impact a project schedule that is only 440 calendar days. The contract would not be able to complete the contract in the original 440 calendar days if the options were not awarded until 365 days after award.
GOVERNMENT RESPONSE: See atached revised price schedule.
2. Referencing attachment H 'Price Schedule' of the RFP, note 5 states CLIN 0003 may be exercised at the time of award or within 120 calendar days after award, however note 9 states all options (CLINs 0002 to 0004) may be exercised up to 365 days after contract award. Please clarify how long CLIN 0003 is to be held for?
GOVERNMENT RESPONSE: The Offeror’s price is valid for 120 days.
3. Referencing attachment H 'Price Schedule' of the RFP, note 9 states all options (CLINs 0002 to 0004) may be exercised up to 365 days after contract award, however that could leave a short duration for procurement and installation of the entire electronic security systems in CLIN 0002. Please consider reducing the duration to award
CLIN 0002.
GOVERNMENT RESPONSE: Construction on the project site must be performed by U.S. Firms using U.S.
Citizens. In addition, Bidders must be aware that some works within the project must be accomplished by U.S. SECRET-cleared personnel as stated in contract section 01 14 00. The response related to the procedures, Government sponsoring contractor’s employees and clearance granted to personnel most be responded by the DoD security office.
4. The Price proposal includes Additional Information such as the Financial Statement for the prime contractor. These statements are confidential and not shared within the company. To maintain confidentiality please confirm the offeror’s CFO may submit these statements separately from the remainder of the proposal directly to the Contractor via email or some other form outside of the PIEE submission.
GOVERNMENT RESPONSE: Please submit the Financial Statements via PIEE per the solicitation.
5. In order for the Small Business Participation Commitment Strategy document to be accurate with actual costs, request that the Small Business Commitment Strategy document be submitted after the submission of the technical and price proposal. Commonly pricing from subcontractors are being received and applied to the proper CLINs on bid day and time constraints cause for the completion of the Small Business documents to be estimated ahead of the receipt of all subcontractor proposals to ensure it is completed by the deadline. If this document could be submitted within 24 hours of the technical/price proposal it would allow for accurate numbers to be used in the commitments.
GOVERNMENT RESPONSE: Submit documents as per the solicitation.
6. Please confirm that the Federal Awardee Performance and Integrity Information System (FAPIIS) Certification shall be submitted under Volume II, Section 6 – within the same tab as VETS-4212 registration.
GOVERNMENT RESPONSE: Yes submit with Volume II.
7. Please confirm that the three (3) complete fiscal year financial statements can be 2018, 2019, 2020, whereas complete financial statement for 2021 may not be completed yet.
GOVERNMENT RESPONSE: Yes
8. Request that the proposal submission deadline be extended four weeks to allow for the submission and answering of the RFIs that may arise from the upcoming site walk.
GOVERNMENT RESPONSE: Proposal due date extended to 31 March 2022.
9. Please clarify the intent to provide a re-design for the two-chiller orientation in the mechanical yard to provide cooling redundancy. This was discussed during the site walk. Pricing this with the original base bid would provide the most competitive pricing and allow for logistics coordination.
GOVERNMENT RESPONSE: See attached revised price schedule.
10. Please clarify if we are to provide a unit price or lump sum price for CLINs 0003 and 0004. If we are to provide a lump sum price, then please provide the quantity that should be included for each CLIN.
GOVERNMENT RESPONSE: See attached revised price schedule.
Reference RFI # 19 response related to CLIN 0002 Option 1 for the ESS - the response references Note 13 which we assume to be referring to Note # 10 on TY-001. Please confirm. The response to the RFI reads:
GOVERNMENT RESPONSE: The intent of the TY series of drawings is to depict an ESS INFRASTRUCTURE ONLY design. The breakout of responsibilities is discussed in Note 13 of TY-001. The Government's ESS contractor will provide and install the ESS equipment.”
Please confirm that the Contractor is to include the TY series infrastructure in the base bid offer.
Please clarify: If the “Government's ESS contractor will provide and install the ESS equipment” presumably under a separate contract per the RFI response, then what equipment (or other cost items) are the contractors to include with CLIN 0002 - Option 1: Electronic Security Systems Equipment:”?
GOVERNMENT RESPONSE: See attached revised price schedule.
11. Can the Government confirm that the “option” columns in (1) the chart on the last page of Attachment E (p.
5) and (2) the chart on the last page of Attachment F (p. 12) the Individual Small Business Subcontracting Plan template apply to option years (which are inapplicable to this project and are related more to a MATOC submission) rather than the optional scopes of work associated with this project? Each chart includes text that indicates that these “option” columns apply to years only (specifically, the footer in item 1 above and the header in item 2 above) and are therefore inapplicable to this submission.
GOVERNMENT RESPONSE: Please submit attachments and documents in accordance to the solicitation.
12. Specification 01 46 00 Par. 1.11. Please specify the direction of the blast load for each criteria for each opening i.e., seating or unseating
GOVERNMENT RESPONSE: The positive phase pressure is applied perpendicular to the surface and the direction occurs from the outside of the building toward the surface of the building. The negative phase pressure is applied opposite of the positive phase loading condition. Refer to the architecture floor plans for the orientation and swing of the doors.
13. Openings 100C, 100CX, 100D, 200C and 200D list a fire rating on Drawing A-601 Door Schedule.
Reference Specification 01 46 00 Par. 1.5. The Low Level of Protection Category III per UFC 4-010-01 specified allows the door to deform and be inoperable after blast event. In same specification, Par. 2.1.1.e states “Hardware is not required for resistance of rebound loading as the door leaf may fail outward away from the building.” Both contradict fire rating conditions which should meet High Level Category I with the door to remain latched and operable. Please explain.
GOVERNMENT RESPONSE: Egress & Fire code conditions are building code requirements that are not required to occur simultaneously with a blast loading threat condition. The specific requirements are independent of each other.
14. Will a structural sub-frame / embed be installed at each jamb opening of the blast resistant doors as noted in Specification 08 11 13 Par. 2.3.2.b for weld-in anchorage. Due to the stress loads transferred and fire rating, this is a preferred method. Entire Section 2.8.4 ‘Anchors’ under the same specification contradicts the weld-in anchorage.
Details B3 and C3 on Drawing A-512 show masonry anchors.
GOVERNMENT RESPONSE: The RFI referenced embed elements may be utilized. The RFI referenced embeds, additional steel elements, and anchorage must be included in the delegated design requriements of specification section 01 46 00. As indicatd per 01 46 00 section 1.12.4, design, provide, and install any additional loading transfer connection element that may be required per the connection design to transfer the glazing, door and roof hatch, and louver system loading to the backup wall system.
15. Verify min. 11ga. carbon steel face sheet as specified in Specification 08 11 13 Par. 2.3.2.b meets the requirement in Specification 01 46 00 Par. 1.12.1.c. If not, please fully describe the A and D missile projectiles in ASTM E1996 Table 2 or provide the table for formal review.
GOVERNMENT RESPONSE: Provide minimum requirements indicated per specification 08 11 13 Par.
2.3.2.b and 01 46 00 Par. 1.12.1.c. ASTM E1996-20 Table 2 indicates: Missile Level A = 2 g (31 grains) +/- 5% steel ball with impact speed 39.62 m/s (130 f/s), Missile Level D = 4100g +/- 100g (9.0 lb +/- 0.25 lb) 2x4 in.
2.4m +/- 100 mm (8ft +/- 4 in) lumber with 15.25 m/s (50 f/s). Reference ASTM E1996-20 for additional information.
16. Do any of the blast resistant door openings need to meet ADA minimum opening requirements. If so, should any of the jamb openings at the single swing doors be 3’2” wide (versus 3’0” wide).
GOVERNMENT RESPONSE: Blast resistant doors need to meet the Architectural Barrier Act (ABA) with a clear door opening width of 32 inches minimum. Clear openings of doorways with swinging doors shall be measured between the face of the door and the stop, with the door open 90 degrees. If the blast resistant door thickness is greater than 1 ¾”, then the door needs to be 3’-2” wide. The following doors will be impacted by this condition: 100CX, 100C, 100Dx, 100D, 174X, 175X, 176X, 180X, 200C, 200D, 301X.
17. Corner guard quantities and product types shown on the Architectural drawings conflict with corner guards shown on the Interior drawings. Architectural drawings A-101 and 102, indicate 42” stainless steel and 42” resilient corner guards. However, in the Interior drawings, aluminum and PVC corner guards were mentioned on sheets I- 103,105,106. Should we follow the Interior drawings for corner guards, or should Architectural drawings be followed for determining corner guard quantities and product types?
GOVERNMENT RESPONSE: Please refer to specs for product resiliency/construction requirements. As PVC falls under resilient, refer to Interiors drawings for color and location requirements. Refer to interiors drawings for locations of cornerguards.
18. Please clarify if A01, A07, and A11-A13 in the furniture schedule are included in the FF&E budget.
GOVERNMENT RESPONSE: Yes, these items are to be included in the FF&E budget.
19. Drawing CS101, Note 28 states to provide brick column with wood infill to match existing.
GOVERNMENT RESPONSE: Yes, the note says this.
20. Please provide design or photograph of existing wood fence to be matched.
GOVERNMENT RESPONSE: Photo already provided in attachments to #104.
21. Please confirm if the contractor is to provide all CxC commissioning services or if CxC commissioning services will be provided by the government.
GOVERNMENT RESPONSE: Per Spec 01 91 00.15 20 Para 1.8, the CxC is employed by the Government under a separate contract.
22. Per LS502 Note 2.3, fencing must have vertical and horizontal support railings. Per LS502 detail C1, horizontal support railings are only installed at the bottom of the fencing. Please confirm this is the intent.
GOVERNMENT RESPONSE: Provide Horizontal support railings per Note 2.3.
23. Per LS502 detail C1, tension bar for tree protection chain link fencing is optional. Per specification section 32 31 13.53 para 2.1.3.2-e, references attaching fabric to tension wire using tie wire. Please confirm if a tension bar/wire is required on (chain link) tree protection fence or high security fence only.
GOVERNMENT RESPONSE: Provide tension wire for tree protection fencing.
24. Drawings E-501 and ES-100 indicate new fixture for types “P2 & P4” There are no pole types, pole height or pole bases shown on the drawings. Please provide information for such.
GOVERNMENT RESPONSE: Match existing pole height in parking lot. Provide pole lights in 1-2 head configurations as shown on plans. Additional installation information is provided in attachment.
25. On drawings T-100, T-507 and T-508 show a communication manhole and indicates that the size is on the plans, however, cannot find any size indicated for the MH on the plans. Please provide information for such.
GOVERNMENT RESPONSE: 6-feet wide X 12-feet long X 7-feet depth minimum with variable depth to provide positive drainage away from the building.
26. Per spec section 32 31 13.53 paragraph 2.1.9., the slide gates are to be provided with electric gate operators but the only device to the gates shown on the drawings is infrastructure for DPS devices. Please confirm if electric gate operators are required and if power is to be ran to each sliding gate. If required, please provide power requirements for each gate.
GOVERNMENT RESPONSE: Both vehicular sliding gates are manual and power is not required.
27. Please confirm that all security devices/CCTV shown on drawings TY100, TY101, TY121, TY122, TY123 are shown for reference only and are to be provided by the government.
Please confirm that these are shown for infrastructure purposes only.
GOVERNMENT RESPONSE: The TY series drawings are presented as an infrastructure only design.
28. S-001, Structural Steel Note 14 states to provide intumescent paint for steel members denoted on the plans however there are no callout references or plan notes indicating which steel members will require intumescent paint.
There is only a keynote reference for cementitious spray applied fireproofing. Please clarify location of intumescent paint for bidding purposes.
GOVERNMENT RESPONSE: Provide bid considering 1-Hour rated cementitious spray-on fireproofing -- in accordance with Keyed Note 11 on A-405 -- for all steel members denoted with an asterisk on structural plans -- in accordance with the legend on S-002.
29. Reference S-301/Detail C4 and S-506/Detail D1. Please provide thickness of the raised secondary slab on metal deck. Is there to be any infill of insulation or other material in between the W10X19 steel shim beam supporting the secondary metal deck. Does the W10X19 steel shim beam need to be fireproofed?
GOVERNMENT RESPONSE: In accordance with Keyed Note on S-102, the raised secondary slab is a 2.5" thick slab on 1.5" metal deck. Provide bid considering shim beams do not require fireproofing and no additional insulation is required between shim beams.
30. On A602, the Exterior Finish Schedule notes the GL-10 finish/color to be guardian gray or guardian crystal gray. Specification Section 08 81 00 calls for glazing to be clear low-E glass in the blast windows. Please confirm if the exterior blast resistant glazing for the exterior windows should be clear or the finish/color noted in the Exterior Finish schedule.
GOVERNMENT RESPONSE: "The information provided in the finish schedule is to convey color pattern, texture and salient characteristics only. The manufacturer information is not intended to limit the selection of products provided by other manufacturers. The selected glazing must meet the performance criteria described in the construction documents. Please note that Glass Type GL-10 does not need to be clear and is preferred to have a tint as described in the exterior finish schedule. The performance requirements are as described in the specifications and drawings. However, the visible transmittance per NFRC needs to be 45% minimum instead of 66% minimum and the solar heat gain coefficient needs to be 0.30 maximum instead of
0.24 maximum.
31. The Exterior Finish Schedule notes the mullions for the exterior windows to be Kawneer. Please confirm where these mullions are located because these windows are punched openings, not curtainwall. Please confirm what specification section 08 44 00 Curtain Wall and Glazed Assemblies refers to.
GOVERNMENT RESPONSE: The information provided in the finish schedule is to convey color pattern, texture and salient characteristics only. The manufacturer information is not intended to limit the selection of products provided by other manufacturers. A curtain wall system specification was used to meet the performance requirement including but not limited to blast resistance. The selected mullion system must meet the performance criteria described in the construction documents and integrate with adjacent building component systems as described in the drawings.
32. Please clarify the intent to provide a re-design for the two-chiller orientation in the mechanical yard to provide cooling redundancy. This was discussed during the site walk. Pricing this with the original base bid would provide the most competitive pricing and allow for logistics coordination.
GOVERNMENT RESPONSE: The purpose of the chiller re-design is not to provide redundancy. The design change from one large chiller to two smaller chillers offers some degree of resiliency if one chiller needs maintenance or is temporarily non-functional.
GOVERNMENT RESPONSE: Submit in accordance with the solicitation
34. Drawing AD101, Note 10 states to “COORDINATE WITH COR REQUIREMENTS FOR ALTERNATIVE MEANS OF EGRESS FOR BUILDING OCCUPANTS DURING THE WORK.” Please clarify the extent of expected measures, temporary walkways, overhead protection, etc. that should be assumed as part of this scope.
GOVERNMENT RESPONSE: See response #9 in amendment 0005
35. Please confirm that the existing computer equipment, screens, telephones and all other furnishings will be relocated by the Government prior to mobilization for demolition.
GOVERNMENT RESPONSE: See response #9 in amendent 0005
36. Please clarify the dimension of the glazing for Type G doors.
GOVERNMENT RESPONSE: See response #17 in amendment 0004
37. Reference specification 08 11 13 paragraph 2.4.4 for Bay Doors. Can individual operators for each door half be provided in lieu of single, center mounted pushrod style operators which typically do not allow for manual closing in the event of power/operator failure when open?
GOVERNMENT RESPONSE: See response #9 in amendment 0005
38. Reference specification section 01 46 00 – Blast Resistance, paragraph 1.5-a. lists facility designed according to UFC 4-010-01 Low Level of Protection (LLOP). Are blast doors to be classified as low level of protection in lieu of Medium Level (MLOP)?
GOVERNMENT RESPONSE: See response #9 amendment 0005
39. Reference specification section 01 46 00 – Blast Resistance, paragraph 1.11. Does this negative pressure requirements remain? If so, the hardware cannot fail. If this is the design intent, will Level of Protection be changed to Medium/MLOP and ASTM damage Category changed to II?
GOVERNMENT RESPONSE: See above response
40. Reference specification section 01 46 00 – Blast Resistance, paragraph 2.1.1.e states hardware is not required for resistance of rebound loading as the door leaf may fail outward away from the building. This contradicts negative pressure requirements of subsection 1.11. Please clarify.
GOVERNMENT RESPONSE: See above response
41. Reference Drawing LS002. Please confirm planting quantities identified in the planting schedule shall govern over any conflicts that may be found in the subsequent LS drawings.
GOVERNMENT RESPONSE: See response #4 & #9 amendment 0005

** Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($15.00) or 13658 ($11.25). Please see the Note at the top of the wage determination for more information.
Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers.
0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example:
SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
