52.212-2 EVALUATION—COMMERCIAL ITEMS (Oct 2014)
M-1 EVALUATION OF OFFERORS (SINGLE AWARD FOR ALL ITEMS)
(g) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
Gate Criteria
Gate 1: Experience
Gate 2: Small Business Participation
Factor 1-Technical Approach
Subfactor 1.1: Provisioning and Delivery
Subfactor 1.2: Supply Chain Risk Management
Factor 2-Device Specifications
Factor 3-Price
(b) Upon receipt of proposals, the Government will evaluate the Gate Criteria for compliance with the stated criteria in the solicitation. The Gate Criteria will be evaluated on an acceptable/unacceptable basis. When evaluators identify a single deficiency within a Gate Criterion, the evaluation will conclude and the proposal will be rated as “Unacceptable.” A proposal that receives a rating of “Unacceptable” in any of the Gate Criteria will be ineligible for award without further evaluation. For proposals rated “Acceptable” for the Gate Criteria, the Government will evaluate the remaining price and non-price factor(s) in accordance with the evaluation criteria stated in this solicitation.
LIST OF ATTACHMENTS (DOCUMENTS)
ATTACHMENT TITLE Date
L-1 Price Workbook 12/14/2018
(c) Factor 2 will be evaluated on an acceptable/unacceptable basis and is not part of the tradeoff. The failure of any aspect of Factor 2 to meet the minimum requirements will render the entire Factor 2 proposal unacceptable. A proposal that receives a rating of “Unacceptable” in Factor 2 will be ineligible for award.
(d) There will be a tradeoff between Subfactor 1.1, Subfactor 1.2, and Factor 3. Factor 3, Price, is significantly more important than Subfactors 1.1 and 1.2, when combined. Subfactor 1.1 is slightly more important than
Subfactor 1.2. An “Unacceptable” rating in Subfactor 1.1, Subfactor 1.2, or Factor 2 will render the Offer
“Unacceptable.” The Source Selection Authority’s (SSA’s) decision regarding which proposal is most advantageous to the Government will be based on a comparative assessment of proposals against all source selection criteria in this solicitation. The SSA will perform this assessment by comparing the strengths, weaknesses, and the Total Contract Price (described below) of the competing proposals to determine which proposal represents the best value to the Government. The tradeoff process allows for selection of the lowest price acceptable offer or a higher priced offer as providing the best value.
(e) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are materially unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(f) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
M-2 EVALUATION METHODOLOGY AND RATINGS
(a) Evaluation of Gate Criteria. The offeror’s proposal will be evaluated on an Acceptable/Unacceptable basis for the following:
(1) Gate Criteria 1 - Experience: The proposal demonstrates that the Offeror’s experience meets the minimum requirements as described in Section L-4(a)(1), Gate Criteria 1.
(2) Gate Criteria 2 - Small Business Participation: The proposal demonstrates that the Offeror’s Small
Business Participation meets the minimum requirements as described in Section L-4(a)(2), Gate
Criteria 2.
(3) The following table reflects the evaluation ratings prescribed for Gate 1 (Experience):
GATE 1 - EXPERIENCE: ACCEPTABLE/UNACCEPTABLE RATINGS
RATING DESCRIPTION
ACCEPTABLE Proposal clearly meets the minimum requirements of the solicitation.
UNACCEPTABLE Proposal does not clearly meet the minimum requirements of the solicitation.
(4) The following table reflects the evaluation ratings prescribed for Gate 2 (Small Business Participation):
GATE 2 – SMALL BUSINESS PARTICIPATION: ACCEPTABLE/UNACCEPTABLE RATINGS
ACCEPTABLE
Proposal indicates an adequate approach and understanding of small business objectives.
UNACCEPTABLE Proposal does not meet small business objectives.
(b) Evaluation of Factor 1: Technical Approach.
(1) Subfactor 1.1: Provisioning and Delivery. The evaluation standard is the degree to which the Offeror’s proposal demonstrates:
(i) Understanding of the core build imaging requirements, to include interdependency with the
Network Provider, and how the Offeror’s proposed imaging processes benefit the Government.
(ii) Understanding of the device delivery requirements and how the Offeror’s proposed delivery processes maximize efficiency, and minimize service disruption to end-users.
(iii) Understanding of the State of the Shelf (SOTS) requirements, to include certification and accreditation processes with the Network Manager, and how the Offeror’s implementation of
SOTS benefits the Government.
(2) Subfactor 1.2: Supply Chain Risk Management (SCRM). The evaluation standard is the degree to which the Offeror’s proposal demonstrates the ability and processes to:
(i) Ensure that the SCRM practices are sufficient to minimize or eliminate an adversary’s ability to surveil, deny, disrupt, or otherwise degrade the function, use, or operation of the information technology delivered to the Government.
(ii) Ensure that devices are supplied to the Government in accordance with DFARS 252.246-7008, Sources of Electronic Parts.
(iii) Ensure that the SCRM practices are employed throughout the product life cycle to include maintenance and repair.
(3) The following adjectival ratings/definitions shall be used for the Factor 1. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses and deficiencies in determining technical ratings.
COMBINED TECHNICAL/RISK RATING
Outstanding Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is low.
Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.
Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
Unacceptable Proposal does not meet requirements and contains one or more deficiencies. The risk of unsuccessful performance is unacceptable. Proposal is un-awardable.
TECHNIAL RATING DEFINTIONS
Low Risk Proposal may contain weakness(es) which have little potential to cause disruption of schedule, or degradation of performance. Normal contractor effort and normal
Government monitoring will likely be able to overcome any difficulties.
Moderate Risk Proposal contains a significant weakness or combination of weaknesses which may potentially cause disruption of schedule or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome difficulties.
High Risk Proposal contains a significant weakness or combination of weaknesses which is likely to cause significant disruption of schedule or degradation of performance. Is unlikely to overcome any difficulties, even with special contractor emphasis and close
Government monitoring.
Unacceptable Risk Proposal contains a material failure or a combination of significant weaknesses that increases the risk of unsuccessful performance to an unacceptable level.
Strength An aspect of an offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
Weakness A flaw in the proposal that increases the risk of unsuccessful contract performance. See
FAR 15.001.
Significant
Weakness
A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.
Deficiency A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.
(c) Evaluation of Factor 2-Device Specifications: The Government will confirm that the proposal provides specifications for all devices and that all devices meet the minimum specifications as listed in the PWS
(Attachment 1), and EUHW Device Specifications (Attachment 10), and as described in Section L-4(c). The following table reflects the evaluation ratings prescribed for the Device Specifications Factor:
FACTOR 2 – DEVICE SPECIFICATIONS: ACCEPTABLE/UNACCEPTABLE RATINGS
ACCEPTABLE Proposal clearly meets the minimum requirements of the solicitation.
UNACCEPTABLE Proposal does not clearly meet the minimum requirements of the solicitation.
(d) Evaluation of Factor 3-Price:
(1) The Government will confirm whether the offeror accurately completed all pricing documents, inclusive of Contract CLIN Pricing, Price Workbook (Attachment L-1), and EUHWaaS Buy-Back
(Attachment 9). The Government will verify the accuracy of all the price calculations.
(2) Price Analysis.
(i) The Government will perform a price analysis of all items priced, at the quantities identified in
Price Workbook (Attachment L-1).
(ii) Price Reasonableness.
a. The assessment of all the proposed prices will include the consideration of reasonableness. A price is considered reasonable if it does not exceed what a prudent person in the conduct of competitive business would incur or is not unreasonably low.
Normally, competition establishes price reasonableness.
b. If, after receipt of a proposal, the PCO determines that adequate price competition does not exist for the firm-fixed-price efforts, the Government will require the Offeror to provide data other than certified cost and pricing data in accordance with FAR 15.403-3.
(iii) Balanced Pricing.
a. The Government will analyze the proposals to determine if prices are unbalanced.
Unbalanced pricing exists when, despite an acceptable total price, the price of one (1) or more contract line items is significantly over or understated as indicated by the application of price analysis techniques. The Government may reject an unbalanced offer that may pose an unacceptable risk to the Government.
(3) EUHWaaS Buy-Back.
The EUHWaaS Buy-Back methodology, including calculation(s), and rationale will be evaluated for reasonableness.
(4) Small Business Subcontracting Plan.
The Government will evaluate the Small Business Subcontracting Plan in accordance with FAR
52.219-9. Failure to submit and negotiate a subcontracting plan acceptable to the Contacting Officer, may make the offeror ineligible for contract award.
(5) Total Contract Price.
The Total Contract Price for contract award will be the sum of the proposed prices and the Not To
Exceed (NTE) price of CLIN 0008, in Attachment L-1. The Total Contract Price will be stated as the maximum contract in value clause 52.212-4, Contracts Terms and Conditions - Commercial Items
(AUG 2018) – Addendum.
(6) Best value trade-off consideration.
The Total Contract Price, as described above, will be used in the best value trade-off consideration.
(End of provision)

The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum". The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum".
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and
Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract more than 5 days after the last day of the final ordering period.
