About this file
This is a confidentiality determination letter issued by the Arizona Department of Administration regarding Request for Proposal #BPM005385 for Foreign Language Interpretation and Translation Services. The determination, dated January 4, 2024, was issued by Stephanie Stevens, Statewide Procurement Manager, to Charlotte Knoll, Chief Administrative Officer of LinguaLinx Language Solutions, Inc., located in Troy, New York. The letter addresses the offeror's designation of certain proposal documents as confidential and communicates the procurement officer's final determination regarding their disclosure status.
The Arizona Department of Administration determined that two documents submitted by LinguaLinx and marked as confidential—Attachment 11 (References and References Supplement) and Attachment 12 (Method of Approach documents)—may be disclosed to the public. This determination was made on the basis that neither document contained trade secrets or information that could not be readily ascertained through public web searches or legal means, as defined under Arizona Administrative Code and the Arizona Procurement Code. The department clarified that contract terms and conditions, pricing information, and generally available public information are not considered confidential and therefore are subject to disclosure.

Re: Determination of Confidential Documents Request for Proposal #BPM005385 – Foreign Language Interpretation and Translation Services
Dear Charlotte Knoll, Proposal documents are designated confidential when the material is proprietary or a trade secret and therefore not subject to disclosure. Per A.A.C. R2-7-101(52), a trade secret is “information, including a formula, pattern, device, compilation, program, method, technique, or process, that is the subject of reasonable efforts to maintain its secrecy and that derives independent economic value, actual or potential, as a result of not being generally known to and not being readily ascertainable by legal means”.
In accordance with A.R.S. § 41-2502 A.A.C. R2-7-10, Written Determinations and the Arizona Procurement Code R2-7-103, Confidential Information, a Procurement Officer shall, upon receipt of an Offeror’s submission of information designated as “confidential” determine whether such submission is confidential or whether the information may be disclosed. The documents listed below were uploaded and designated “Confidential” in your offer, and we have determined that the documents listed below may be disclosed. This determination was made because none of these documents contained trade secrets or information that could not be ready ascertainable by a web search, or by legal means.
· Attachment 11 References and References Supplement
· Attachment 12 Method of Approach documents
Please keep in mind that, in accordance with A.A.C. R2-7-103, contract terms and conditions, pricing, and information generally available to the public are not considered confidential information.
This Determination is effective and shall remain in effect unless otherwise modified or revoked.
If there are any questions regarding this, please contact me at stephanie.stevens@azdoa.gov.
Sincerely, Stephanie Stevens
