About this file
This is an Exceptions Determination Response document for Solicitation #BPM005633, a Foreign Language Interpretation and Translation Services contract issued by the State. Bromberg and Associates, LLC submitted an exception to the Insurance requirements outlined in Exhibit A, Section 1.3 and 1.3.1 of the Request for Proposal. The offeror provides remote services exclusively, including document translation, voice-over services, telephonic interpreting, and video remote interpreting, and therefore requested an exemption from Sexual Abuse and Molestation (SAM) insurance coverage requirements due to the absence of face-to-face contact with other parties. During the Questions and Answers period, the offeror received confirmation that remote services could be exempted from this coverage requirement.
The State accepted the alternative language exception on November 30, 2023, with the condition that if in-person services are ever offered in the future, the Sexual Abuse and Molestation insurance coverage must be submitted. The resolution allows Bromberg and Associates to proceed without SAM coverage for their current remote-only service delivery model while maintaining the obligation to provide appropriate insurance documentation if service delivery methods change. The exception was acknowledged and accepted as of December 1, 2023.

Exhibit A 1.3, 1.3.1, a.&b.
Alternate language:
The policy shall include coverage for Sexual Abuse and Molestation (SAM) for services having face-to-face encounters.
Rationale: Our services would be only remote, as we are providing document translation, voice-over, telephonic and video remote interpreting, so we would not have any direct contact with other parties.
During Q&A we asked if we could get an exemption from this coverage and the answer was “yes” for remote services.
The policy shall include coverage for Sexual Abuse and Molestation (SAM). This coverage may be sub-limited to no less than $500,000. The limits may be included within the General Liability limit or provided by separate endorsement with its own limits. If you are unable to obtain SAM coverage under your General Liability because the insurance market will not support it, it should it be included with the Professional Liability. b. Contractor must provide the following statement on their Certificate(s) of Insurance: “Sexual Abuse and Molestation coverage is included” or “Sexual Abuse and Molestation coverage is not excluded.”
