About this file
This justification and approval document and related solicitation provide details for a construction contract to renovate the Air Force Materiel Command Headquarters building at Wright-Patterson Air Force Base in Ohio. The renovation project will repair and modernize over 60,000 square feet of the building, replacing HVAC, electrical, plumbing and other systems. The justification approves the use of either Siemens Talon or Johnson Controls HVAC controls and monitoring equipment due to the need for the new system to integrate with the base-wide environmental monitoring control system, which currently only interfaces with those two manufacturers' products. The solicitation will be for a single-phase design/bid/build contract awarded on a firm-fixed price basis with a period of performance of 1,095 calendar days. The solicitation is expected to be released on November 10, 2022 through the System for Award Management website. The estimated value of the construction project is between $100-250 million.

JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Agency: U.S. Army Corps of Engineers (USACE), Louisville District, Post Office Box 59, Louisville, Kentucky 40201-0059.
2. Description of Action: This justification and approval (J&A) is being prepared for the use of brand name requirement for a Siemens Talon or Johnson Controls Metasys in the firm fixed price construction contract for the Repair/Renovate Air Force Materiel Command (AFMC) Headquarters Building 10262 Package A project at Wright-Patterson Air Force Base, Ohio. The government will not purchase the equipment directly, but rather brand name specifications will be included in the design bid build solicitation that will lead to a new firm fixed price (FFP) construction contract. The construction contract is planned to be awarded under a full and open solicitation, using FY23 Air Force O&M funding.
3. Description of Supplies/Services: The controls equipment selected for use on the
Phase 1 (Package A) AFMC Headquarters Building Renovation will connect to existing facilities at Wright-Patterson Air Force Base that are either Siemens Talon or Johnson Controls Metasys equipment. The software and hardware are required for the building to be able to tie into the current base-wide Environmental Monitoring Control System (EMCS). The estimated total cost for the equipment is .
4. Authority Cited: 10 United States Code (U.S.C.) 3204(e), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2), “When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.” This authority is applicable to brand name justifications in accordance with FAR 6.302-1(c)(1).
5. Reason for Authority Cited:
a. Background: WPAFB AFMC HQ currently monitors all building HVAC systems base-wide with an EMCS. Currently all buildings at WPAFB use the Siemen Talon Control System or Johnson Controls Metasys System.
b. Justification: The current configuration of the EMCS is limited to two (2) manufacturer systems: Johnson Controls Metasys System Extended Architecture (MSEA) supervisory and facility controls system, and the Siemens Talon (BACnet) supervisory and control system. The EMCS controls the operations of HVAC equipment throughout the Base. The Base’s Installation Facility Standard dictates that any new Direct Digital Controls (DDC) must provide 100% interface with facility and the existing Metasys Controls or Talon Controls system without the use of third-party interface hardware/software. Due to the proprietary nature of the EMCS, no other manufacturer’s products can connect to and function with the existing control system. Johnson Controls and Siemens systems are the only two systems capable of interfacing with the existing EMCS and both manufacturers are acceptable. If a Johnson Controls or Siemens system is not installed, this facility will not satisfy the user’s requirement to be integrated with the base-wide system. The installation would either have to monitor via two different programs or replace the entire system at significant cost. The base currently has no plans to shift away from utilization of the existing EMCS system which is compatible with both Johnson Controls and Siemens.
c. Impact: If equipment other than the specified Johnson Controls or Siemens DDC equipment is installed in this facility it will prevent the facility from connecting to the base-wide monitoring system. The facility would have to be monitored separately from the rest of WPAFB, which would require the establishment of a separate service contract at a significant cost to the government.
Alternatives: None viable to achieve a fully functioning system for the reasons noted above in paragraph 5. b) and c).
6. Efforts to Obtain Competition: Technical requirements of various manufacturers were reviewed for compatibility to the current EMCS; however, the use of different equipment from the two manufacturers identified would require the installation of third-party software for integration which goes against the Base Facility Standard.
A Notice of Intent was posted on 05 January 2022. To date, no other sources have written to express interest. If prior to issuance of the solicitation, responses are received expressing interest, the justification will be amended.
7. Actions to Increase Competition: None, for the reasons cited above.
8. Market Research: Market Research was completed as identified in paragraph 6 above. The technical team additionally reviewed manufacturers that may be compatible and found that there are no feasible alternatives.
9. Interested Sources: N/A, this J&A will be posted with the issuance of the solicitation in accordance with FAR 5.102 (a)(6) and 6.302-1(c)(1)(ii)(C). All responsible sources may submit a capability statement, proposal, or quotation, which will be considered by the agency.
10. Other Factors: None
11. Technical Certification: I certify that the supporting data under my cognizance, which are included in the Justification and Approval, are accurate and complete to the best of my knowledge and belief.
12. Requirements Certification: I certify that the supporting data under my cognizance, which are included in the Justification and Approval, are accurate and complete to the best of my knowledge and belief.
13. Legal Review and Concurrence: I hereby determine that the information herein is legally sufficient, and I concur with the sole source procurement.
14. Contracting Officer Certification and Fair and Reasonable Cost Determination:
I certify that this justification is accurate and complete to the best of my knowledge and belief.
I hereby determine that the anticipated cost for Siemens Talon or Johnson Controls HVAC controls and monitoring system for this project will be fair and reasonable based upon the estimate outlined in paragraph 3. At time of evaluating proposal price, the overall proposed price will be evaluated for fair and reasonableness. I recommend this approach to the prompt attainment of services for the upcoming construction.
Approval
