About this file

This document is an addendum to the FAR 52.212-2 clause, "Evaluation-Commercial Products and Commercial Services," for a commercial item acquisition conducted under FAR Parts 12 and 13. The acquisition is for Storage Sheds for Universal Pre-Kindergarten at multiple schools in the Pacific region, solicited under Solicitation Number HE125424QE025 by the Department of Defense Education Activity (DoDEA).

The Government anticipates awarding one Firm-Fixed Price contract to the offeror whose quote, conforming to all requirements, represents the best value based on two factors: Technical (must be rated Acceptable) and Price (evaluated for fairness and reasonableness). If more than three quotes are received, the Government will evaluate the three lowest priced quotes for technical acceptability first, with the option to evaluate additional quotes if none of the initial three are acceptable. Quotes are due by 2:00 PM JST on September 4, 2024.

52.212-2 ADDENDUM, EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV

2021)

Basis for Award

(a) Addendum to Paragraph (a). Paragraph (a) is changed to read as follows:

This acquisition will be conducted in accordance with FAR Parts 12 and 13. The Government anticipates awarding one (1) Firm-Fixed Price (FFP) contract to the Offeror whose quote, conforming to all the requirements of the solicitation, represents the best value to the Government price and other factors considered. In addition, any potential awardee will need to be deemed responsible in accordance with requirements of FAR Part 9.

Failure to meet a requirement may render a quote ineligible for award consideration. Offerors shall clearly identify, in writing, any exception to the solicitation terms and conditions and provide a complete rationale for the Government’s consideration of each exception taken. Rationale to exceptions shall state the document, item number, paragraph number, page number, etc. where the term appears.

To make the award decision, the Government will evaluate each quote using the following two (2) factors:

1. Factor 1-Technical – Offeror must receive an overall rating of Acceptable to be considered for award

2. Factor 2-Price

Evaluation Factors: These will be rated in accordance with FAR Subpart 13.106-2 and:

i. Volume I – Factor 1: Technical. The Government will evaluate the product documentation provided in the Offeror’s to determine if the Offeror’s quote clearly meets the Government’s requirements.

Technical rating will be based on the following Technical Rating method:

ii. Volume II – Factor 2: Price. This factor will not be assigned a rating. However, the Offeror’s quote, using attachment 24QE025_Pricing Sheet_081924, will be evaluated to determine if the price offered is fair and reasonable in accordance with the techniques and procedures stated in FAR 13.106-3.

(b) Options. Addendum to Paragraph (b). Paragraph (b) is deleted.

(c) If three (3) or fewer quotes are received, the Government will evaluate all quotes for technical acceptability. If more than three (3) quotes are received, the Government will then evaluate the three (3) lowest priced quotes for Technical Acceptability. However, the Government reserves the right to evaluate additional quotes for technical acceptability if deemed to be in the Government’s best interest. If additional quotes are evaluated for technical acceptability, they will be evaluated in the order of increasing total evaluated price, when the agency determines that none of the initial three (3) lowest priced quote are qualified as acceptable. The agency will reject and not consider for award any quote found technically unacceptable and ineligible for award under the terms of this RFQ, in the absence of interchanges.

(End of FAR 52.212-2 Addendum)

Rating Description

Acceptable Offeror’s quote clearly meets the requirements of the solicitation.
