Amendment 0003

The following Requests for Information (RFIs) and Government responses are hereby incorporated into the subject solicitation:

RFI 001: What are GSA’s Small Business Goals?

Response 001: Please see the “Small Business Slides” that were posted under amendment 002. The 2016 Small Business goals are:

Small Business: 29%

Small Disadvantage Business: 5%

Women Owned Small Business: 5%

HUB Zone Small Business: 3%

Service Disabled Veteran Owned Small Business: 3%

RFI 002: Reference is made to RFP section IV Contract Clauses:

1. Paragraph 1 (c) Guaranteed Maximum Price. This clause state that the award will be “at a Guaranteed Maximum Price (GMP), which equals the sum of the ECW, the CMc Contingency Allowance (CCA) and the Fee.” This clause further states that the Contract at award is a target ECW; a final ECW is negotiated during the Design Phase Services and will be incorporated into the Contract prior to exercise of the GMP Option.” This is followed by a statement that “The final ECW must be equal to or less than the target

ECW.”

2. Paragraph 1 (d) Final Estimated Cost of the Work. Item (ii) Establishment of the Final ECW states that “the final ECW, CCA and Fee may not exceed the GMP established in the Contract.” This final ECW will then be entered into the contract by bilateral modification provided all components of this paragraph 1 (d) are met.

Is the target ECW indicated in the above paragraph to be prepared from detailed estimating of the bidding documents and specifications provided?

Response 002: Offerors are to prepare a Guaranteed Maximum Price for Phase 1 and Phase 2 using the bidding documents that are posted to the “Federal Business Opportunities” website.

RFI 003: Is the contractor required to assist in the management of the design to contain/control the project cost of work through the Design Phase Services?

Response 003: Yes, the scope of work for the “Base” contract requires the offeror to assist in the design process. Please refer to the scope of work, “Section III. Scope of Services – A. Design Stage” for details.

RFI 004: If the negotiations of the final ECW do not result in an amount less than or equal to the target ECW, how will this issue be resolved?

Response 004: The sum total of the “Estimated Cost of Work”, “Contingency Allowance” and the “Fee” must be equal to or less than the submitted “Guaranteed Maximum Price.” If one area is increased, than the remaining areas must be decreased accordingly to keep the GMP price at or below the submitted amount.

RFI 005: Will all responses by the government to questions from the Offeror during the RFP response period be contract binding? Or will the Government issue an Amendment for all government responses to questions during the RFP response period that are to be included in the project contract?

Response 005: The Government’s responses to RFIs will be issued in an amendment and incorporated into the solicitation. The responses will be bound in the subsequent contract.

RFI 006: In the RFP under FACTOR 4 the solicitation request a resume for Construction Superintendent, in the Core and Shell Specifications in Section 014000 1.3.A a Project superintendent is stated as a person who may also serve as the QC manager, are the role titles of Construction Superintendent and Project Superintendent for the same person?

Response 006: The “Construction Superintendent” and the “Project Superintendent” are the same individual.

RFI 007: I am unable to find the required bid guarantee amount in the solicitation. The solicitation references FAR 52.228-1, BUT in the FAR, there are blanks that need to be completed per project:

(c) The amount of the bid guarantee shall be ______ percent of the bid price or $________, whichever is less.

Response 007: Offerors must submit a bid bond valued at 20% of their total evaluated proposal (base and options). The bid bond must be submitted with the price proposal.

RFI 008: Page 5 of CMc201, Section II.B states that there should be an original price proposal, two (2) copies of the price proposal, five (5) copies of the technical proposal, and a CD containing the price & technical proposals as separate PDF documents. The SF1442 states only that an original and five (5) copies are required to be submitted.

Please advise whether the separate technical and price proposals are necessary and confirm the number of copies of the proposal(s) that are required to be submitted.

Response 008: The offerors must submit separate price proposals and separate technical proposals. The technical proposal shall not contain pricing information.

Offerors are required to submit the following number of proposals:

The original version of the price proposal.

Two (2) copies of the price proposal

Five (5) copies of the technical proposal

A compact disc containing the price and technical proposals are separate PDF documents.

RFI 009: Page 5 of CMc201, Section II.C states that the Project Labor Agreement shall be included in the Price Proposal, but the Agreement is not listed as being required as part of Section II.B. Please advise whether the Project Labor Agreement shall be included with the Price Proposal.

Response 009: If an offeror chooses to submit a proposal with a PLA, the agreement must be submitted with the price proposal.

The technical proposal shall NOT contain pricing information.

RFI 010: Page 12 of CMc201 indicates that a copy of the executed joint venture agreement is required as part of the proposal. Please advise if this should be included with the Price Proposal.

Response 010: The “Joint Venture Agreement” (If required) shall be submitted with the price proposal.

RFI 011: Can we deliver our proposals directly to the GSA office? If so, what address?

Response 011: Proposals can be delivered to the following location: General Services Administration, 100 S. Independence Mall West, Philadelphia, PA 19106 (DOW Building). Proposals must be submitted by the closing period stated in the solicitation.

Please contact the Contracting Officer to coordinate delivery. Contractors can not wait in the lobby of the building for extended periods.

RFI 012: The solicitation states that the most recent “Davis Bacon” wage rate will be incorporated into the contract when the options are exercised for the Construction Phases. Can we increase our proposal to account for the newer and potentially higher wage rate?

Response 012: Please refer to clause “52.222-30 (b) Construction Wage Rate Requirement, which states “The Contracting Officer will make no adjustment in contract price, other than provided for elsewhere in the contract, to cover any increases or decreases in wages and benefits.” The contractor should account for the risk of a wage rate increase when preparing the GMP proposal.

RFI 013: Item II.A.6 on page 6 of 64 of the CMc101 Document states:

(6) Bid Rates. If this Contract includes Bid Rates to be used in the determination of equitable adjustments (e.g., overhead, profit, daily rates for time related costs) such rates shall be...

The proposal form or 1442 does not include any Bid Rates. Please identify any Rates you wish to be submitted with the proposal.

Response 013: This solicitation does not contain bid rates. Offerors should not include bid rates in their proposals.
