About this file

This is a Frequently Asked Questions document issued by the Department of Technology, Management and Budget (DTMB) of the State of Michigan regarding recent prevailing wage law changes effective April 2, 2025. The document addresses requirements for contractors and subcontractors performing construction work for the State of Michigan under Public Act 10 of 2023 and Public Act 110 of 2024. All contractors and subcontractors must register with the Labor and Economic Opportunity (LEO) Wage and Hour division to obtain a State Project Registration (SPR) before submitting bids on state construction projects. The SPR requirement applies to all projects with bids due on or after April 2, 2025, but does not apply to projects already bid or under contract before that effective date. Contractors failing to provide the required SPR with their bids will have their bids deemed non-responsive and ineligible for contract award.

The annual SPR fee is currently $500, paid directly to LEO Wage and Hour through their website. While contractors must provide their own SPR at bid submission, SPRs for subcontractors must be available upon request and may be submitted after bid award, though failure to provide them may result in contract termination. Contractors must immediately notify the project owner of any changes to registration status for themselves or subcontractors and ensure all subcontractors maintain valid SPRs throughout project performance. Certified payroll submissions for all contractors and subcontractors must be submitted directly to LEO Wage and Hour and not to DTMB. Questions regarding appropriate wage rates and registration assistance should be directed to LEO Wage and Hour.

Frequently Asked Questions for Recent Law Changes April 8, 2025

Prevailing Wage Law Q: What has changed in the prevailing wage laws?

A: Per Public Act 10 of 2023, amended per PA110 of 2024, all contractors and subcontractors performing work for the State of Michigan as a construction mechanic must register with Labor and Economic Opportunity (LEO) Wage and Hour and receive a State Project Registration (SPR) and pay the associated annual fee to be able to submit bids for state work and submit certified payroll during the project.

Q: When did the change become effective?

A: April 2, 2025.

Q: Does this change apply to projects bid and/or already under a contract before April 2, 2025?

A: No, the change applies to all projects with bids due on or after April 2, 2025.

Q: How do I get a State Project Registration (SPR) register with LEO Wage and Hour?

A: Instructions can be found on the LEO Wage and Hour Prevailing Wage website for attaining the required State Project Registration (SPR) for all contractors and subcontractors.

Q: How much does it cost and how do I pay the annual fee?

A: The fee will be determined by LEO Wage and Hour and is currently $500. The fee is paid directly to LEO Wage and Hour through their website. Please contact LEO Wage and Hour for any assistance or questions relating to issues for registration or payment.

Q: What happens if I submit a bid without the required SPR?

A: As the law requires, the bid will be determined not responsive and cannot be awarded a contract.

Q: Do I have to provide a SPR for every subcontractor that I provide with post bid submittals when I am being considered for award of a contract?

A: No, but the SPR’s must be available if requested. If it is not able to be provided, the contract may be terminated.

Q: What happens if I need to change a subcontractor after the work begins?

A: The General Contractor must immediately notify the Owner of any change in registration status for themselves and any subcontractor and is required to ensure that all subcontractors maintain a SPR with LEO Wage and Hour.

Q: How do I submit the required certified payroll?

A: Certified payroll for both the contract and subcontractors is required to be submitted directly to LEO Wage and Hour with the access provided at the time of paying for your SPR. Certified payroll for projects with State of Michigan Prevailing Wages are not to be submitted to DTMB at any time.

Q: Who do I ask for assistance with determining the appropriate wage rate?

A: LEO Wage and Hour.
