FA5000-12-R-0001 Bidder Questions and Government Answers 8 May 2012
1. In reviewing the RFP for the above project, I cannot seem to find instructions to offerors, evaluation criteria or an RFP section. Can you tell me what section that information would be in?
Answer: The instructions to offerors and evaluation criteria are listed in the solicitation section L and M.
The RFP section is attachment 6.
2. I cannot locate the solicitation file, the SF1442 or Sections L and/or M on any of the documents that are posted on FBO; the posted documents start with Attachment 1. There is a table of contents but it, too, does not show the solicitation.
Answer: I reposted the solicitation, it should be available .
3. The SF1442 has "draft" as a watermark embedded in it. My bonding agent wanted to know if there would be a final issued and also if there was a ROM or range for the Bid Guarantee or is it supposed to be for the entire $100 million?
Answer: We have released the final solicitation and I added the final solicitation without the water mark.
Page 6 lists the minimum/maximum amounts, there is a minimum guaranteed amount of $10,000.00 for the entire base year. There is no guarantee for any amount for the remainder of the contract.
4. What is the last day to ask questions?
Answer: You may ask questions until 18 May, the day the bid closes; however questions after the 8th of May, may not be answered.
5. Are you going to set up a projnet question account or did you have another process for questions? The RFP is silent on that.
Answer: No, we do not set up projnet 6: We have requested a bid guaranty (as required in the SF 1442) for $3 million since there is no indication of the amount required to be covered under the bid bond (20% of what amount) and we don’t know exactly what the bond was for. Is it your intent that the bid bond only covers the first year or will it cover all years?
Answer: This is an IDIQ; only provide a bid guaranty of 20% for the guaranteed amount of the contract, (contract guaranteed amount is $10,000.00). (20% of ten thousand dollars).
7. Can I assume that in lieu of 12 pitch font (which is 12 characters per inch, non-proportional spaced, and unavailable as a font measurement) you will accept 10 point font, which is the equivalent of 12-pitch. (Please note pitch was used for a non-proportional spaced font so you can be sure that you will get 12 characters per inch with a proportional spaced font (the only kind that is available), that will vary based on the types of letters in a word, for example, “good” takes up more space than “till”….?
Answer: If it looks like 12 pitch we assume it is 12 pitch and will accept it.
8. Our proposed superintendent has a concern regarding the question process. Since the Government in this solicitation is not using Projnet, when we ask a question how can we be sure that the answer is going to all competing teams so that the playing field remains level? Will the answers that we receive via email also be posted as an amendment? If we receive an answer via email that is not listed in an amendment, how should this be considered?
Answer: The contract documents will stay as written and all contractors will be competing on those documents. If a question is asked that will alter those documents an amendment will be accomplished and the contract documents will be changed. If an amendment is issued later during the solicitation phase, questions and answers may be included for information purposes even if they have not altered the contract documents but just provided clarification to an offeror.
9. Will all contractors including the current contract holder (SKW/ASRC) be required to develop the new pit in the base year?
Answer: The contract requirements are the same for all contractors
10. Our government clients have asked if they may send previously completed Past Performance Questionnaires or CCASS documentation in lieu of completing this form. Will that be ok?
Answer: No, however they may attach a copy of the CCASS report.
11. It is possible to get a copy of the last 3 years orders that were placed to the current contract?
Answer: Please send your request through the Freedom of Information Office at JBER. Their number is 907-552-1395. The previous contract was FA5000-08-D-0008 with 50 delivery orders and the current contract is FA5000-12-D-0003 with 5 delivery orders.
12. Could you direct me to if or where there would be an escalator clause for oil within the contract?
Answer: Clause 52.216-4 Economic Price Adjustment-Labor and Material (Jan 1997) is located on page 17 of the solicitation. Attachment 7 Economic Price Adjustment CLINS (EPA), lists the CLINS that may be affected by price change.
13. Regarding FAR 52.216-4 EPA : Please clarify the adjustment threshold of " 3% of the then-current total contract price". Not sure if this is cumulative through the issuance of the option years or only the total of the active delivery orders.
Answer: The then current total contract price would refer to only the total of the active deliver orders.
14. Please confirm that "the Schedule" as referenced in FAR 52.216-4 page 17 of 50 is in fact the EPA CLINS listed in attachment 7.
Answer: The schedule referenced in 52.216-4 refers to attachment 7.
15. Please confirm that the EPA covers Labor increases and only those materials listed in the schedule, ie: Asphalt Oil and Fuel.
Answer: The EPA only covers asphalt, oil and fuel on those material listed in the scheduled attachment 7. Labor increases are covered under FAR 52.222-32 and applies to the entire contract bid schedule.
16. Please confirm that labor price increases will be considered for an EPA adjustment for all items in the Bid Schedule and not limited to those shown on the EPA schedule (attachment 7).
Answer: Davis Bacon Act Price Adjustment is allowed for all items in the contract bid schedule IAW FAR 52.222-32.
17. Bid items #109 through #112 : Is it the governments intent that these items be full priced "placement" items to be used in lieu of item # 100 or should they be considered unit price increase/decrease/no change items to be added to item #100?
Answer: The original intent was to be a decrease in price, but specificationsection 1020 and is worded incorrectly. It would lead bidders to believe it is a complete line item price for placing asphalt pavement with recycled (RAP) added. This is not as intended. I have attached the entire specification section (01020) with rewritten item #109 - #112 as well as listed below each item below.
Line Item #109. 20 % Recycled AC Pavement Added to New Mix (Non-Airfield) Scope of Work: Payment shall be a unit price increase, decrease, or no change on any individual delivery order for the Use of recycled asphalt pavement into the mix for new asphalt pavements. Recycled asphalt is assumed to have between 3 and 7 percent asphalt oil. Testing of the crushed asphalt will be required to determine the amount of new oil needed for the mix design. Includes contractor's quality control and asphalt control testing.
Unit of Measurement: Unit price increase, decrease, or no change per TON of Recycled Asphalt Pavement (RAP) added to new mix.
Line Item #110. 30 % Recycled AC Pavement Added to New Mix (Non-Airfield) Scope of Work: Payment shall be a unit price increase, decrease, or no change on any individual delivery order for the Use of recycled asphalt pavement into the mix for new asphalt pavements.
