RE: Briggs Gopher Tortoise Survey & Relocation CN 803, TA
Dear Mr. Sandel, Thank you for the opportunity to provide this proposal to support the Department with Gopher tortoise permitting and relocation services associated with the Briggs Boardwalk project at Rookery Bay National Estuarine Research Reserve. Based on a preliminary survey conducted by FDEP staff, the project area lies within the 25-foot protection zone of approximately 34 potentially occupied gopher tortoise burrows. This proposal outlines the consultant’s approach to coordinating with FWC staff biologists, conducting a comprehensive 100% coverage survey, preparing required environmental documentation, and managing all relocation, permitting, and excavation activities.

Briggs Gopher Tortoise Survey Contract Number 803, Task Assignment
Subtask 1: Gopher Tortoise Survey and FWC Coordination
Description: CONSULTANT will open dialogue with FWC staff biologist(s) to request that the 25-foot protection zone be reduced (where appropriate) for this project to prevent unnecessarily relocating gopher tortoises [since the project footprint is so small]. CONSULTANT, a Florida Fish and Wildlife Conservation Commission (FWC) Authorized Gopher Tortoise (GT) Agent will then conduct a 100% coverage survey of potential GT habitat in the project area and will obtain GPS coordinates for each gopher tortoise burrow within the project area. CONSULTANT will determine which burrows should be excavated based on their location, distance from the project, and entrance direction as discussed with FWC staff biologist(s).
Deliverable: Location of burrows on aerial in PDF format
Performance Measure: Deliverables will be reviewed by the Department to confirm they are complete, accurate, and timely.

Subtask 2: Gopher Tortoise FWC Application
Description: With the information obtained from the 100% survey, CONSULTANT will prepare the required environmental drawings, review and verify applicable GIS Sources, and complete a Gopher tortoise relocation application for submittal to FWC.
Mr. Garland Sandel Briggs Gopher Tortoise Survey & Relocation
CN 803, TA
CLIENT shall provide CONSULTANT with proof of local government approval authorizing construction activities, as required by the FWC Gopher Tortoise Permitting Guidelines. Providing proof of local government approval from CLIENT is necessary prior to initiation of capture and relocation activities. CONSULTANT will be responsible for paying all mitigation/application fees due to the FWC. CONSULTANT will coordinate with FWC to recommend onsite relocation through temporary exclusion from the project footprint using a silt fence barrier.
The FWC permitting process may take up to 90 days or more from time of complete application submittal. CLIENT understands and agrees that no site work (i.e., vegetation removal, staging of materials, clearing) may commence on the property until the permit has been obtained and relocation(s) has occurred in accordance with the terms of the permit.
Deliverable: Copy of the FWC permit in PDF format.
Performance Measure: Deliverables will be reviewed by the Department to confirm they are complete, accurate, and timely.

Subtask 3: Gopher Tortoise Relocation
Description: Once the appropriate permits have been obtained from FWC, the CONSULTANT shall provide FWC Authorized Gopher Tortoise Agent(s) who are permitted to supervise backhoe excavation of Gopher tortoise burrows. CONSULTANT shall provide a flat bucket backhoe and equipment operator to assist with the excavation(s). All burrows permitted for relocation will be excavated to their terminus, as required by FWC. Any live gopher tortoises that are recovered will be relocated according to the permit. This assumes excavation of approximately eight (8) burrows per day, depending on site conditions and this subtask estimates up to 17 burrows being relocated.
Additional burrows requiring relocation are payable under Subtask 4.
CONSULTANT will measure and mark (individual IDs are required for offsite relocation) any recovered gopher tortoises, as may be required, and release tortoise(s) at the chosen recipient site.
CONSULTANT will then compile the necessary burrow excavation data from the project and submit the “After-action report” to FWC, as required.
CONSULTANT will meet with CLIENT using Microsoft Teams to discuss project specifics and/or provide progress updates, as necessary.
