About this file
This confidentiality determination letter is issued by the Arizona Department of Administration to Bromberg & Associates, LLC regarding Request for Proposal #BPM005385 for Foreign Language Interpretation and Translation Services. The document outlines the procurement officer's evaluation of documents submitted by the offeror that were designated as confidential. The determination process follows Arizona Administrative Code R2-7-101(52) and Arizona Revised Statutes 41-2502 to assess whether submitted materials qualify as trade secrets or proprietary information exempt from public disclosure.
The procurement officer determined that three documents submitted as confidential—Confidential Supplement Insurance, Confidential Supplement Resumes, and Confidential Attachment Company Experience with reference letters—may be disclosed as they do not contain trade secrets and information is readily ascertainable through web searches or legal means. Two documents were determined to remain confidential: Confidential Supplement Financial Documents and Attachment 17 Arizona Baseline Security Controls Pre-Requisite. The determination emphasizes that contract terms and conditions, pricing, and publicly available information are not considered confidential under Arizona procurement regulations.

Re: Determination of Confidential Documents Request for Proposal #BPM005385 – Foreign Language Interpretation and Translation Services
Dear Jinny Bromberg, Proposal documents are designated confidential when the material is proprietary or a trade secret and therefore not subject to disclosure. Per A.A.C. R2-7-101(52), a trade secret is “information, including a formula, pattern, device, compilation, program, method, technique, or process, that is the subject of reasonable efforts to maintain its secrecy and that derives independent economic value, actual or potential, as a result of not being generally known to and not being readily ascertainable by legal means”.
In accordance with A.R.S. § 41-2502 A.A.C. R2-7-10, Written Determinations and the Arizona Procurement Code R2-7-103, Confidential Information, a Procurement Officer shall, upon receipt of an Offeror’s submission of information designated as “confidential” determine whether such submission is confidential or whether the information may be disclosed. The documents listed below were uploaded and designated “Confidential” in your offer, and we have determined that the documents listed below may be disclosed. This determination was made because none of these documents contained trade secrets or information that could not be ready ascertainable by a web search, or by legal means.
· Confidential – Supplement Insurance
· Confidential – Supplement – Resumes
· Confidential – Attachment - Company Experience (contains reference letters) & Attachment 11_References
The documents listed below were uploaded and designated “Confidential” in your offer, and we have determined that these documents will be kept confidential.
· Confidential – Supplement - Financial Documents
· Attachment 17 - Arizona Baseline Security Controls Pre-Requisite -1
Please keep in mind that, in accordance with A.A.C. R2-7-103, contract terms and conditions, pricing, and information generally available to the public are not considered confidential information.
This Determination is effective and shall remain in effect unless otherwise modified or revoked.
