About this file
This document is an exceptions determination for the Topete Stonefield offeror in response to Solicitation #BPM005633 for Foreign Language Interpretation and Translation Services. The exceptions determination outlines two contract requirements that the offeror contested. The first exception, regarding Section 1.3.1 of Exhibit A concerning Sexual Abuse and Molestation (SAM) insurance coverage, was accepted with alternative language. The state approved the offeror's rationale that SAM insurance is unnecessary for remote work arrangements, contingent upon submission of the insurance if in-person services are offered in the future. The second exception, regarding Addendum B Section 1-3.5.22 concerning network security requirements, was denied by the state.
The state's response to the denied exception requires the offeror to work with Homeland Security after contract award to confirm whether the network security requirements are truly inapplicable to the contractor's service delivery model. The offeror's rationale cited the prohibitive cost of compliance and the absence of state network access as justification for the exception request. The determination was finalized on December 4, 2023, establishing the terms under which the offeror may proceed with contract performance.
