About this file
This is a Request for Proposal (RFP) solicitation issued by the International Boundary and Water Commission (IBWC), U.S. Section, for operation and maintenance (O&M) services at the South Bay International Wastewater Treatment Plant (SBIWTP) located in San Diego, California.
The solicitation (191BWC26R0009) seeks a single firm fixed-price contract to operate and maintain the SBIWTP, which treats wastewater at 25 million gallons per day (MGD) under normal operations and temporarily 35MGD with a 10MGD surge capacity. The base contract period runs from June 1, 2027 through May 31, 2028, with four unexercised option years extending through May 31, 2032. The contract is awarded using the Highest Technically Rated with Fair and Reasonable Price (HTR-FRP) method, with technical factors weighted at 100% and price evaluated solely for fairness and reasonableness. Published planning target price ranges for the base year are $21,000,679 to $23,211,276; option years escalate accordingly. The government will evaluate proposals based on seven weighted technical factors: Plant Operations and Permit Compliance (20%), Unique SBIWTP O&M Conditions (20%), Company Experience (15%), Staffing and Key Personnel (15%), SCADA Operations (10%), Plant Coordination (10%), and Past Performance (10%). Offerors must submit proposals by January 6, 2027 at 2:00 PM MST via secure Microsoft SharePoint; a mandatory pre-proposal site visit is scheduled for October 14, 2026 in San Diego. The contractor must comply with all NPDES permit requirements, maintain 24/7 operations, implement preventive maintenance and asset management systems, manage canyon collectors post-storm restoration within 96 hours, coordinate with Mexican authorities and concurrent construction contractors, maintain required insurance and bonding (performance bond at 25% of contract price), and establish background clearances for onsite personnel within ten days of contract award.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".

Document Number: 191BWC26R0009 PROCESSED Page 18 of 42
(2) After conducting a reasonable inquiry for purposes of this representation, the offeror represents that it ?
does, ? does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services.
(End of provision)
52.209-5 - Certification Regarding Responsibility Matters (DEVIATION JAN 2026)
(a)(1) The Offeror certifies, to the best of its knowledge and belief, that--
(i) The Offeror and/or any of its Principals--
(A) Are __ are not __ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have __ have not __, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract;
violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);
(C) Are __ are not __ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision; and
(D) Have __, have not __, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied. Federal taxes are considered delinquent if both of the following criteria apply:
(1) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if a pending administrative or judicial challenge remains. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(2) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) The Offeror has __ has not __, within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the Government will consider the certification in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) This provision does not require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a). The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If the Government later determines that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
(End of provision)
