1. Identification of the requesting activity and contracting activity.

The requiring activity is the Armed Forces Retirement Home (AFRH) and the contracting activity is Bureau of the Fiscal Service.

2.a A description of the supplies or services required to meet the agency's needs.

The purpose of this sole source justification is to obtain approval to award a firm fixed price purchase order with High Energy Ozone LLC. for the purchase of Excimer Wave Sterilray

Luminaire tIV Systems in response to COIVID-I9. The need date for this requirement was

412312020.

3. IccE/Estimated dollar value.

The IGCE is $56,880.00 inclusive of all products.

In accordance with FAR 18.104 and 18.102, a purchase order was issued to High Energy Ozone LLC. on A4D312020 for UV equipment in response to the disinftcting and preventing possible traces of COIVID-19 virus within the AFRH locations in Gulfport MS and WashinSon DC. No formal synopsis or justification for a sole source was created prior to the award in accordance with FAR 18 and DTAP 1006.302-2, due to the unusual and compelling urgency for instances when preparation and approval of the justification prior to award would unreasonably delay the acsuisition.

5. Any other important information.

Contract Specialist - Ryan Radcliff Contracting Officer - Todd Ashcroft This was an urgent requirement that was procured in accordance with FAR 18 - Emergency Acquisitions. The clauses listed below enabled the course of action taken for this acquisition.

18.103 Synopses of proposed contract actions. Contracting officers need not submit a synopsis notice when there is an unusual and compelling urgency and the Government would be seriously injured if the agency complied with the notice time periods. (See 5.202(a)(2).)

18.104 Unusual and compelling urgency. Agencies may limit the number of sources and full and open competition need not be provided for contracting actions involving urgent requirements.

18.106 Acquisitions from Federal Prison Industries,Inc. (FPI). Purchase from FPI is not mandatory and a waiver is not required if public exigency requires immediate delivery or performance (see 8.605 (b)).

18.107 AbilityOne specification changes. Contracting officers are not held to the notification required when changes in AbilitvOne specifications or descriptions are required to meet

i8.203 Emergency declaration or major disaster declaration.

(a) Disaster or emergency assistance activities. Preference will be given to local organizations, firms, and individuals when contracting for major disaster or emergency assistance activities when the President has made a declaration under the Robefi T. Stafford Disaster Relief and Emergency Assistance Act. Preference may take the form of local area set-asides or an evaluation preference. (See 6.208 and subpart 26.2.)

A Fixed Price, definitive purchase order was created. The Contractor agreed to begin promptly, in accordance with 20342320P00008 and including all clauses required by the Federal Acquisition Regulation (FAR), and any other mutually agreeable clauses, terms, and conditions. This requirement was awarded via20342320F00008 otA4/2312A20 to small business High Energy Ozone LLC.
