About this file

This is a Treasury Standard Form 1009 - Sole Source Justification for Acquisitions at or Below the Simplified Acquisition Threshold.

The Alcohol and Tobacco Tax and Trade Bureau (TTB) Intelligence Division, through the Treasury Common Services Center (TCSC) contracting activity, seeks to award a sole source, firm-fixed-price contract to Kpler, Inc. (UEI: XCU6KYK7UF95), an Other Than Small Business, for five (5) one-year subscriptions to Kpler Terminal Premium Maritime Intelligence licenses. The need-by date is September 1, 2026, with an anticipated performance period of one 12-month base period plus three optional 12-month periods. The justification identifies maritime vessel tracking capabilities as the primary requirement, enabling TTB's Intelligence Division to review and analyze real-time exports to identify fraudulent claims involving unpaid Federal Excise Tax.

The sole source determination is based on market research demonstrating that Kpler is the only vendor meeting all salient functional requirements: web-only interface, direct data export in Excel/CSV or API access, minimum 10 years of AIS historical data, support for Class A and Class B vessel port history, unlimited vessel searches by name/IMO/other identifiers, and license assignment flexibility within budget constraints. Competing solutions evaluated—Vessel Finder, BigOcean Data, VT Explorer, CARGA, and S&P Global—were rejected for failing to meet specific technical requirements or exceeding budgetary limitations. The justification references TTB's prior experience with FleetMon (acquired by MarineTraffic in 2022), which proved inadequate due to search limitations and inability to export historical data directly.

SF 1009 - FAR 13.106-1(b) SOLE SOURCE JUSTIFICATION FOR

Treasury Standard Form – 1009 (Rev 10/18)

2.b Name and business size of the vendor.

2.c Requisition No.

3. IGCE/Estimated dollar value.

4.b Supporting information and facts.

The proposed procurement is to acquire Kpler Terminal Maritime Intelligence Licenses as follows:

Kpler Terminal (Premium) – 1yr Subscription, Qty: 5

The proposed solution have the following salient functional, performance characteristics, and level of quality that will satisfy the Government’s needs that no other solution appears to have at this time, based on current market research efforts conducted by the Government. Salient characteristics include the following: Web-only interface; Direct Data Export in Excel/CSV or API; AIS historical data of 10 years

(minimum); Support Class A and Class B Vessel Port History; Vessel searches by Name/IMO/Other; No limitation on volume of searches; License assignment flexibility; and within TTB Budget.

Kpler Terminal Maritime Intelligence Licenses provide maritime vessel tracking capabilities as needed, when needed. This self-service capability allows the Alcohol and Tobacco Trade Bureau’s (TTB’s)

Intelligence Division to review and analyze real-time exports to identify fraudulent claims involving unpaid Federal Excise Tax (FET).

Market research revealed several general-purpose competitors, however, their products do not offer the specific requirements needed by this procurement. Specifically, Vessel Finder, BigOcean Data, and VT

Explorer did not meet the requirement for direct data export in Excel/CSV by the user. CARGA did not have a standard of 10 years of AIS historical data. S&P Global far exceeded TTB's allotted financial resources for this requirement. Kpler met all requirements - web-only interface, direct data export in

Excel/CSV, 10 years of AIS historical data; Class A and Class B vessel coverage, port history, vessel searches by name, all with unlimited searches and the flexibility to reassign the named-user licenses.

Based on this information, Kpler Terminal licenses are identified as the only source available that can meet the needs of this requirement.

SF 1009 - FAR 13.106-1(b) SOLE SOURCE JUSTIFICATION FOR

5. Any other important information.

In December 2022, TTB Intelligence made a micro-purchase of vessel tracking data from FleetMon. This service met an immediate need but was not ideal due to limits on the number of searches that could be run before incurring additional costs. FleetMon subsequently merged with MarineTraffic, at which point the user was unable to perform direct pull down and export of historical data, which resulted in undue delays and unanticipated costs. As a result, TTB has continuously reviewed the market for providers of vessel tracking data that supported their investigations and found Kpler Terminal Maritime Intelligence licenses.
