SF 1009 - FAR 13.106-1(b) SOLE SOURCE JUSTIFICATION FOR
ACQUISITIONS AT OR BELOW THE SIMPLIFIED ACQUISITION THRESHOLD
1. Identification of the requesting activity and contracting activity.
The requiring activity is the Treasury Inspector General for Tax Administration (TIGTA), and the contracting activity is Treasury Common Services Center (TCSC).
2.a A description of the supplies or services required to meet the agency’s needs.
The purpose of this sole source justification is to obtain approval to award a firm fixed price contract with Research Electronics International, LLC (REI) for the purchase of the Orion
Non-Linear Junction Detector (NLJD). The need date for this item is Fiscal Year 2026.

The Orion Non‑Linear Junction Detector (NLJD) required by TIGTA is a specialized counter‑surveillance instrument used to detect hidden or concealed electronic semiconductor components, including non‑emitting devices such as dormant cameras, microphones, and illicit surveillance tools. Research Electronics International, LLC (REI) is the sole designer, manufacturer, and distributor of the Orion NLJD. The Orion product line incorporates patented NLJD technologies exclusively developed and controlled by
REI, which prevents any other business from producing, licensing, or distributing an equivalent NLJD based on REI’s proprietary methods.
Because REI is the only firm with ownership of the underlying patented technology, no other vendors can legally manufacture a functionally comparable Orion NLJD. Further, because REI alone manufactures this device, they are the only source capable of providing the required technical support, system maintenance, and warranty services associated with this specific product. Market research conducted by the requiring activity confirms that
NLJD instruments using REI’s patented detection technology are not available from any resellers, distributors, or alternative manufacturers. As a result, REI is the only responsible source capable of meeting the Government’s minimum requirements for this acquisition

5. Any other important information.
The Orion NLJD is essential for TIGTA’s investigative and counter‑surveillance mission.
The instrument provides unique capability to detect semiconductor components embedded within structures, furnishings, containers, or other materials, regardless of whether the device is active, hardwired, concealed, or powered off. This capability is necessary for safeguarding sensitive investigative operations and ensuring the integrity of protected work environments. No alternate device offering equivalent performance, detection methodology, or reliability has been identified

6.b Contracting Officer approval. In accordance with FAR 13.106-1(b)(1), as a warranted contracting officer, I hereby determine that the circumstances of the acquisition make only one brand-name or source reasonably available for the reasons provided above; therefore precluding competition and supporting the Government’s determination to solicit as a brand-name requirement or solicit and award to the vendor stated in section 2.b.
