Delivery Method – Offerors shall submit electronic bids (.pdf format) in response to this solicitation. Only the PIEE Solicitation Module is authorized for the submission of electronic bids in response to this solicitation. Electronic bid submissions should be no larger than 1.9 GB per file. Offerors shall ensure that the Government has received the electronic proposal prior to the date and time specified. PIEE Solicitation Vendor Access Instructions are provided via Enclosure 11. Emailed submissions will not be accepted.

Vendor instructions are provided below:

Using the Solicitation Module available within Procurement Integrated Enterprise Environment (PIEE) at https://wawf.eb.mil/piee-landing/. Instructions for obtaining access to and using the Solicitation Module are provided below:

Offerors and quoters are required to be registered in System for Award Management (SAM) (https://sam.gov/SAM/pages/public/index.jsf) and their SAM account must include certain criteria PRIOR to obtaining access to the PIEE website and using PIEE’s Solicitation module. The General Steps required to obtain PIEE access include:

Step 1. Register with SAM. (This is a mandatory step.)

Step 2. Establish an Electronic Business (EB) Point of Contact (POC) in SAM. (This is a mandatory step.)

• If your firm already has an active SAM account, validate that an EB POC is identified by accessing https://www.sam.gov/ (External Link) and click on "Search SAM". Where prompted, enter your Dun & Bradstreet Data Universal Numbering System (DUNS Number) or Commercial and Government Entity (CAGE) Code or Company Name and click the "Search" button. If you are presented with a list of DUNS numbers, pick the specific location and click on the Detail link. Scroll to the bottom of the Inquiry Results page. There you can see if anyone is listed as the EB POC. If no one is listed, the company has not identified an EB POC yet. Contact your company SAM POC and ask them to update the company's registration to include the EB POC.

Step 3. Ensure the CAGE Code is added to the PIEE Vendor Group Structure. (This is a mandatory step.)

• Note: Your CAGE Code must be added to the PIEE Vendor Group Structure BEFORE any personnel can self-register for applications in PIEE. To establish a vendor group for a CAGE Code, someone in your company needs to either call the Customer Support Center 1-866-618-5988 or send an email to Defense Information Systems Agency (DISA) Ogden at disa.global.servicedesk.mbx.eb-ticket-requests@mail.mil. If your organization has multiple CAGE Codes, the PIEE Customer Support Center will assist in adding all your CAGE Codes to your Vendor Group Structure in PIEE. Phoned in requests will be activated immediately. Emailed requests will be processed within 48 business hours after receipt.

Step 4. Establish an Organizational Email Address. (This is a Wide Area Workflow (WAWF) step only.)

• Note: If you do not set up an organizational email address, the personal email address of the first person who self-registers from your CAGE/DUNS Code will be used as the organizational email address.

Step 5. Designate a Contractor Administrator (CAM). (This is a mandatory step.)

Vendors must appoint a CAM to manage their PIEE accounts. It is recommended that the EB POC be the CAM. If you appoint a CAM that is not your EB POC, then they are required to submit their CAM appointment letter, signed by their EB POC, via email to the Ogden Customer Support Center at disa.global.servicedesk.mbx.eb-ticket-requests@mail.mil. A sample CAM appointment letter is available at https://wawf.eb.mil/documentation/CAM- VendorAppointmentLetter.pdf Step 6. Determine if batch feeds for data input is necessary. (This is WAWF step only.)

Step 7. Set up PCs to Access applications in PIEE.

Step 8. Self-Register CAM. (This is a mandatory step - there must be a CAM to activate vendors.)

• When registering as a CAM, Vendor User Roles will not be allowed, only add Administrative User Roles. Important: If the CAM's account has not been activated within two (2) business days, notify the PIEE Customer Service.

Step 9. Have all users for the CAGE Code(s) self-register on the PIEE web site for one of the available Vendor Roles.

• Once the EB POC (CAM) has been activated, all company users will need to self-register. Every user must self-register on the PIEE web site by completing the online registration form. Note: User accounts will not be activated until the CAM activates the accounts.

Step 10. Complete the Web Based Training for the applications you will use in PIEE.

To utilize the PIEE Solicitation Module, register for an Account at https://www.eb.mil/; select vendor, create a user ID and password [Note you cannot change your user ID once registered]. Ensure you register for both Proposal Manager and Proposal View roles. Once activated by the CAM, search for the solicitation, using the Search link and solicitation number N44255-23-R-1503. Using the Proposal Manager role, select the Offer tab, then select the applicable CAGE Code for which submitting an offer. Upload the proposal using the Add Attachment link.

(Attachment file names cannot contain spaces and cannot exceed 1.9 GB per attachment. After uploading your proposal, select the Post Offer button to submit your proposal. The system displays a message recording the date and time your offer is posted. Keep that for your records. Additional and more detailed information regarding posting offers is available here: https://wawftraining.eb.mil/wbt/sol/Posting_Offer.pdf. NOTE that the submission of any proposal must be completed no later than the time indicated above. The PIEE Solicitation module will record the date and time of package submittal. The date and time of package submittal recorded in PIEE shall govern the timeliness of any proposal submission.

Offerors shall allow adequate time to upload files, which may be slower for non-DoD users, and to avoid other technical difficulties that may be encountered. Offerors are also responsible for submitting files in the format specified consistent with requirements stated elsewhere in this solicitation. Files that cannot be opened, or are otherwise missing the required content are the responsibility of offerors.

It is the sole responsibility of the Offeror to obtain the Request for Proposal (RFP) files, along with any amendments, from the Solicitation Module within PIEE (https://wawf.eb.mil/piee-landing/). Unprotected editable electronic file copies of the RFP documents, including Word, Excel, and/or Adobe files will not be provided. Please plan accordingly.

Small Business Subcontracting Plan. In accordance with FAR 19.703, large businesses are required to submit an acceptable small business subcontracting plan that meets the requirements of FAR 19.704 prior to award utilizing the format provided in Attachment C. The subcontracting plan (if applicable) shall be submitted electronically via email to emily.m.easterday.civ@us.navy.mil with a copy to jodus.d.hortin.civ@us.navy.mil no later than 2:00 pm PST two business days after the due date for submitting the proposal.

NOTICE OF BONDING REQUIREMENTS. Within 10 days after receipt of award, the bidder/offeror to whom the award is made shall furnish the bonds required by FAR Clause 52.228-15.

Bidders/offerors are hereby notified that the contract time for purposes of fixing the completion date, default, and liquidated damages will be as stated in FAR Clause 52.211-10 Commencement, Prosecution, and Completion of Work, regardless of when performance and payment bonds or deposits in lieu of surety are executed.

BASIS OF AWARD AND EVALUATION FACTORS

A. BASIS FOR AWARD

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.

2. As stated in the solicitation, the Government intends to evaluate proposal(s) and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary; procedures in FAR

15.306 shall be followed. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

3. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. The number of proposals to be evaluated for technical acceptability will be limited to the lowest priced offer. If the lowest priced proposal is not found to be technically acceptable then the next lowest price proposal shall be evaluated. If that proposal is also not found to be technically acceptable, then the process described will be conducted again as many times as necessary, until such time as the Government identifies a technically acceptable proposal.

4. An overall non-price factors rating must be “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

B. EVALUATION FACTORS FOR AWARD

1. The solicitation requires the evaluation of price and the following non-price factors:

Factor 1 – Corporate Experience Factor 2 – Safety Factor 3 – Past Performance Factor 4 – Technical Approach

The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

2. Basis of Evaluation and Submittal Requirements for Each Factor.

(a) Price:

(1) Solicitation Submittal Requirements: The offeror’s price proposal shall be separate from the technical proposal. The price proposal shall include the following:

(i) Cover Sheet in accordance with FAR 52.215-1 Instructions to Offerors – Competitive Acquisition (JAN 2017) that includes:

a. Solicitation Number;

b. Name, Address, Telephone and Facsimile, and Email addresses of the offeror;

c. Names, titles, telephone and facsimile numbers, electronic addresses of persons authorized to negotiate on the offeror’s behalf; and

d. Name, title, and signature of person authorized to sign the proposal.

Proposals signed by an agent shall be accompanied by evidence of that authority.

e. Company DUNS and Cage Code numbers;

(iii) Standard Form 1442 (Solicitation, Offer, and Award)-Blocks 14 through 20c to include acknowledgement of all solicitation amendments;

(iv) Completed Representations and Certifications, including the supplemental certifications provided in Section 00600 of the solicitation, are current and posted in SAM;

(v) Executed Bid Bond in accordance with FAR 52.228-1 (submitted electronically as authorized by FAR Deviation 2020-O0016); and a copy of the agent’s authority to sign bonds for the surety company shall accompany the bid bond;

(vi) Completed Financial Responsibility Questionnaire from Financial Institution and Surety; and, if a Large Business

(vii) Large Business Offerors shall submit an acceptable Small Business Subcontracting Plan with their proposal. The Small Business Subcontracting Plan shall include small business subcontracting goals that meet or exceed the minimum small business subcontracting targets stated below. The Small Business Subcontracting Plan template is provided as a solicitation attachment.

Small Business Subcontracting Program Target Small Business (SB) 40% HUBZone Small Business (HUBZone) 3% Service-Disabled Veteran-Owned Small Business (SDVOSB) 3% Small Disadvantaged Business (SDB) 5% Woman Owned Small Business (WOSB) 9%

It is the policy of the Government to provide maximum practicable opportunities in its acquisitions to

Small Business (SB) concerns, including Historically Underutilized Business Zone SB (HUBZone SB), Woman- Owned SB (WOSB), Small Disadvantaged Business (SDB), Veteran-Owned SB (VOSB), Service-Disabled SB (SDVOSB), and other small business concerns. Further, it is the policy of the Government that such concerns will have the maximum practicable opportunity to participate in contract performance consistent with its efficient performance.

Large Business Proposals that fail to provide an acceptable subcontracting plan will not be eligible for contract award. The small business subcontracting plan may be submitted no later than 2PM PST two business days after submission of the proposal.

(2) Basis of Evaluation:

The Government will evaluate price based on the total price, consisting of CLIN 0001 and Option CLINS 0002-0005. The Government intends to evaluate all options in accordance with the provision FAR 52.217-5, Evaluation of Options (JUL 1990). Inclusion of FAR 52.217-5, Evaluation of Options does not obligate the Government to exercise the option(s). A price realism evaluation will not be conducted. Proposal analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGCE.

(iii) Comparison of proposed prices with available historical information.

(iv) Comparison of market survey results.

Proposals that contain qualifications, conditions, express unilateral interpretations of the minimum contract requirements, or exceed budget limitations may be excluded from the competitive range or be considered ineligible for award.

(b) Technical Factors:

(1) Factor 1 – Corporate Experience:

(a) Solicitation Submittal Requirements:

The Offeror shall submit the following information:

Submit a minimum of two (2) and a maximum of five (5) construction projects for the Offeror that best demonstrates its experience on relevant projects that are similar in size, scope, and complexity to the RFP. The Government will only review five (5) construction projects. Any projects submitted in excess of the five (5) will not be considered. Every project shall meet at least one scope element, and the corresponding minimum size of 50,000 barrels of fuel storage. Failure to meet all of the criteria will result in an unacceptable rating.

For purposes of this evaluation, a relevant project is further defined as:

Scope:

Construction of above ground fuel storage facilities with transfer pipelines for liquid fuel with minimum individual tank storage volume (capacity) of 50,000 barrels of fuel storage.

Construction of fuel tank secondary containment structures.

Demolition and removal of underground fuel storage tanks with individual volumes no less than 35,000 barrels.

Cathodic protection of field erected aboveground tanks and associated constructed fuel systems.

Automatic Tank Gauging (ATG) & Automatic Fuel Handling Equipment (AFHE) System installation with instrumentation and controls integration.

Complexity:

Planning and multidisciplinary construction of an above ground storage facility while integrating with an active fuel depot that will remain operational during the construction process. Projects submitted for the Offeror shall be substantially complete (owner can occupy facility) within ten (10) years preceding the original date of issuance of this solicitation.

The two tanks are constructed in series. The second tank's construction will start approximately 1 1/2 year after the first tank is substantially completed. Site development completion near project completion. Unit price for disposal of soils and concrete are needed throughout the period of performance.

A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project;

rather Offerors shall submit the work performed under a task order as a project.

The attached Construction Experience Project Data Sheet (Attachment B -DBB) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods).

If the offeror is a Joint Venture (JV), partnership, or mentor protégé, recent and relevant project experience should be submitted for projects completed by the JV, partnership, or mentor protégé entity. If the JV, partnership, or mentor protégé does not have shared experience, projects may be submitted for the JV, partnership, or mentor protégé members. At least one recent and relevant project shall be submitted for each JV, partnership, or mentor protégé member. Offerors who fail to submit experience for all JV, partnership, or mentor protégé members may be rated unacceptable. Offerors are still limited to five (5) projects combined. In addition, the offeror shall submit a signed copy of a JV agreement, partnership agreement, or approved mentor protégé agreement (MPA) for each member of the offeror’s JV team.

If the offeror's proposal presents the experience, past performance, or safety data of any entity with a Data Universal Numbering System (DUNs) or CAGE code that differs from that in the SF 1442 such as affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the information will not be considered unless the offeror establishes a basis for imputing the other entity's data to the offeror. The offeror must clearly explain why another entity's experience, past performance, or safety record is relevant to or indicative of the offeror's ability to perform this contract. A mere statement describing a corporate affiliation is insufficient; the offeror must also establish how the connection or nexus between it and the other entity relates to the offeror's qualifications. The explanation must be included in the solicitation attachment “Construction Experience Project Data Sheet”, required under Factor 1 - Experience (Construction). An offeror's failure to adequately justify a basis for crediting it with another entity's experience, past performance, or safety data may result in a deficiency, thereby making the offeror ineligible for award without discussions. Any projects submitted in excess of the five (5) will not be considered.

(b) Basis of Evaluation: The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP.

(2) Factor 2 – Safety:

Solicitation Submittal Requirements:

The Offeror shall submit the following information: The Days Away from Work, Restricted Duty, or Job

Transfer (DART) Rate; and Total Case Rate (TCR) for the specified five (5) Calendar Years (CY), as well as a safety narrative, as described below. For a partnership or joint venture, the Offeror shall submit separate DART and TCR rates for the specified five (5) CY for each contractor who is part of the partnership/joint venture; however, only one safety narrative is required. Any fatalities experienced within this 5-year timeframe must be explained in detail, to include root cause and corrective actions.

NOTE: DART and TCR shall not be submitted for subcontractors

1. DART Rate: Submit five (5) previous complete calendar years’ CY2022, CY2021, CY2020, CY2019, and CY2018 worth of data (not an overall average). If the Offeror has no DART rate, for any year, affirmatively state so and explain why.

a. DART cases include injuries or illnesses resulting in death, days away from work, and/or restricted work or transfer to another job days beyond the day of injury/illness.

b. Calculation of DART rate: Multiply the total number of DART cases by 200,000, and then divide by the number of employee labor hours worked

DART RATE = Number of DART incidents x 200,000 Total Number of Employee Labor Hours Worked

2. TCR Rate: Submit five (5) previous complete calendar years’ CY2022, CY2021, CY2020, CY2019, and CY2018 worth of data (not an overall average). If the Offeror has no TCR rate, for any year, affirmatively state so and explain why.

a. TCR cases include injuries or illnesses resulting in death, days away from work, restricted work or transfer to another job days beyond the day of injury/illness, medical treatment beyond first aid, or loss of consciousness.

b. Calculation of TCR rate: Multiply the total number of TCR incidents by 200,000, and then divide by the number of employee labor hours worked

TCR RATE = Number of TCR Incidents x 200,000

Total Number of Employee Labor Hours Worked

3. Technical Approach to Safety: Submit a narrative that addresses the following:

a. Describe the Offeror’s approach to implementing and executing a Safety Management System (SMS) including Management/Leadership involvement, Employee involvement, Hazard prevention, Hazard control, Worksite analysis, and Safety and health training, to include the standard(s) used to benchmark the SMS.

b. Describe the evaluation process used to select potential subcontractors.

c. Describe the processes of how the Offeror will oversee safety compliance of subcontractors at all levels throughout performance of the contract (to include the Offeror’s own in-house workforce).

d. The Technical Approach to Safety narrative shall be limited to two (2) single-sided pages or one (1) doublesided page. Font shall be no smaller than 11 pitch.

4. The Government reserves the right to review other available sources (public/Government internal) of information.

These may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS), Contractor Performance Assessment Reporting System (CPARS), Electronic Contract Management System (eCMS), etc.

Basis of Evaluation:

The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors. To meet the minimum requirements, the Offeror must demonstrate the following:

1. DART rates at or below 2.99

2. TCR Rates at or below 4.49

3. Technical Approach to Safety

a. Offeror describes a viable SMS that addresses elements such as Management/Leadership involvement, Employee involvement, Hazard prevention, Hazard control, Worksite analysis, and Safety and health training, to include the standard(s) used to benchmark the SMS.

b. Offeror describes a methodical process of evaluating subcontractor’s safety performance in their selection process.

c. Offeror describes a logical management plan to hold both themselves and their subcontractors accountable for adhering to the safety requirements of the contract.

(3) Factor 3 – Past Performance:

(i) Solicitation Submittal Requirements:

IF A COMPLETED CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM

(CPARS) EVALUATION IS AVAILABLE, IT SHALL BE SUBMITTED WITH THE PROPOSAL. IF THERE IS NOT A COMPLETED CPARS EVALUATION, the Past Performance Questionnaire (PPQ) included in the solicitation, Attachment D, is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 1 – Experience (Construction and Design). If the past performance is for a project submitted by a subcontractor under Factor 1 – Experience (Construction and Design), the PPQ must be completed by the end user (not the construction company who was awarded the project). AN OFFEROR SHALL

NOT SUBMIT A PPQ WHEN A COMPLETED CPARS IS AVAILABLE.

IF A CPARS EVALUATION IS NOT AVAILABLE, ensure correct phone numbers and email addresses are provided for the client point of contact. Completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment D), which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Emily Easterday, via email at emily.m.easterday.civ@us.navy.mil with a copy to jodus.d.hortin.civ@us.navy.mil and prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/Entity Identifier numbers of team members (partnership, joint venture, teaming arrangement, or parent company/ subsidiary/ affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), and any other known sources not provided by the offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.”

(ii) Basis of Evaluation: The degree to which past performance evaluations and all other past performance information reviewed by the Government (e.g., PPIRS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), performance recognition documents, and information obtained from any other source) reflect a trend of satisfactory performance considering:

- A pattern of successful completion of tasks;

- A pattern of deliverables that are timely and of good quality;

- A pattern of cooperativeness and teamwork with the Government at all levels (task managers, contracting officers, auditors, etc.); and

- Recency of tasks performed that are identical to, similar to, or related to the task at hand

This evaluation focuses on how well the Offeror performed on the relevant projects submitted under Factor 1 –

Experience and past performance on other projects currently documented in known sources. Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination.

In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown past performance will receive “no rating”.

Offeror shall have a minimum average rating of “Satisfactory” in the most recent Past Performance Evaluation in each of the project submitted to be considered acceptable.

(4) Factor 4 – Technical Approach:

(a) Solicitation Submittal Requirements:

Provide a narrative not to exceed two (2) double-sided pages (or four (4) single-sided pages) describing the construction approach. Pages exceeding this amount will not be considered. Font shall be no smaller than 11 pitch.

The submission shall be in narrative form only. A project schedule in any form (e.g. Gantt Charts, Critical Path Method (CPM) schedules, etc.) will not be evaluated. The narrative shall include the following:

A description of the Offeror’s approach to accomplishing the project’s goals and requirements for completing the project within the required timeframe. The narrative shall account for: construction period (clearly identify the number of calendar days), inspection and testing, administrative submittals, construction sequencing, and any critical path items including those submittals that must be accepted/ approved before demolition and construction work can begin.

The Offeror shall include a discussion of its Mitigation Plan that addresses anticipated project challenges that may negatively impact the critical path including potential removal and disposal of contaminated soils, weather, and anticipated site constraints including traffic and site topography. Include what measures will be taken to mitigate impacts to time and resources.

(b) Basis of Evaluation:

Evaluation of this factor will be a subjective assessment of the Offeror’s approach to accomplishing the project’s goals and requirements for completing the project within the required timeframe to determine if it is realistic and demonstrates the ability to properly accomplish the requirements of the project. Failure to address any of the submission requirements may result in an unacceptable rating.

Nothing in the submitted narrative will be considered an approved contract modification in the event there are elements of the narrative that are not in accordance with either the drawings or the specifications.
