Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID:_36C250-20-AP-4493_
1. Contracting Activity: Department of Veterans Affairs, NCO 10, Dayton VA Medical Center
2237: 552-21-1-6950-0001
2. Nature and/or Description of the Action Being Processed: Request approval to use other than full and open competition to solicit on a brand name only to use Arriscraft/Clip System Masonry Veneer and products referenced in Section 04 72 10 and drawing AS-400 for Project #552-CSI-162 Site Prep for PET-CT. This is part of a new firm fixed price construction contract.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: As a part of the project Site Prep for PET-CT a building addition will be constructed. The new PET-CT building addition will require masonry veneer to match what was recently installed on a nearby building on our campus.
4. Statutory Authority Permitting Other than Full and Open Competition:
(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Arriscraft/Clip System Masonry Veneer is needed because is will match materials used on nearby buildings on our campus.
It is needed to provide a uniform and well designed campus.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The Arriscraft/Clip System Masonry Veneer is a proprietary material and they are the only manufacturer of this. Since the construction contract is being awarded as a firm fixed price contract through competitive sealed bidding, the bidders are incentifized to locate the supplier that will provide the item at the most economical price.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The best interests of the government are served through the use of this product. The pricing will be provided as part of equipment available in the commercial marketplace. The price will be determined to be fair and reasonable to the government based on competition.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The Arriscraft/Clip System Masonry Veneer has been used elsewhere on the VA Dayton campus. It is in our best interest to use similar materials on our campus building for a uniform look. FAR 6.302-1 “As described in Section 6 above, market research, OFOC SOP Revision 10 Page 2 of 3 Original Date: 03/22/11 Revision 10 Date: 09/10/2020 in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.”
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: This manufacturer Arriscraft/Clip System Masonry Veneer is the only one that produces these materials.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
Solicitations for future requirements will utilize “brand name or equal” language, if it is in the Government’s best interest to do so. The current requirement must be solicited using a brand name description because the Government needs to create an exact copy of a system/item that is currently in use.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
