About this file

This is a federal representation and disclosure form required for acquisitions of leasehold interests in real property involving telecommunications and video surveillance services or equipment.

The form implements Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, which prohibits executive agencies from procuring equipment, systems, or services that use covered telecommunications equipment or services as substantial or essential components or as critical technology on or after August 13, 2019. The offeror (defined as the owner of the property offered) must represent whether covered telecommunications equipment or services will be provided in performance of any contract, subcontract, or contractual instrument resulting from the solicitation. Exceptions apply to services connecting to third-party facilities such as backhaul, roaming, or interconnection arrangements, and to telecommunications equipment that cannot route or redirect user data traffic or permit visibility into user data or packets. If the offeror responds affirmatively to providing covered telecommunications equipment or services, disclosure requirements include: all covered equipment and services offered with brand, model number, and description; explanation of proposed use and factors determining permissibility under the prohibition; for services, the entity name, unique entity identifier, and CAGE code of the service provider; and for equipment, the entity name, unique entity identifier, CAGE code, and whether the entity is the original equipment manufacturer or distributor. The form requires signature by the offeror or legally authorized representative with name, address, telephone number, and date.
