M.1 NOTICE LISTING SOLICITATION PROVISIONS INCORPORATED BY

REFERENCE

The following solicitation provisions pertinent to this section are hereby incorporated by reference (by Citation Number, Title, and Date) in accordance with the FAR provision at FAR "52.252-1 SOLICITATION PROVISIONS INCORPORATED BY REFERENCE" in Section L of this solicitation. M.2 52.212-2 EVALUATION – COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award up to 13 contract awarded agreements to the Offerors whose proposal conforms to the solicitation and represents the best value to the government considering price and non-price factors, FAR 15.101-1. Of the 13 awards, there will be a combination of large and small business awardees. Source Selection for the Log HOUSE solicitation fosters competition within each award category between potential contractors. Offerors who propose for the Full and Open award will only compete with other vendors proposing as Full and Open Offerors. Offerors who propose as Haul and Install (Small Business Set Aside) will only compete against other eligible Offerors who have submitted proposals as Haul and Install (Small Business Set Aside).

Offerors who propose as Maintenance and Deactivation (Small Business Set Aside) will only compete against other eligible Offerors who have submitted proposals as Maintenance and Deactivation (Small Business Set Aside).

The Government intends to award without discussion. However the Government reserves the right to hold discussions, if the Government determines discussions are necessary. The Government will first establish a competitive range then conduct discussions/negotiations in accordance with FAR Part 15. Proposals that are determined to be technically unacceptable will not be moved into the competitive range; therefore, no further evaluation will be performed and price will not be evaluated.

In making its “Best Value” determination award within each award category, award will be made on a best value trade-off basis to the proposal(s) that are determined to be most beneficial to the Government with appropriate consideration given to the evaluation factors. All non-price factors combined are significantly more important than price. The non-price evaluation factors that the government will use are as follows in their order of importance:

The offers pricing will also be evaluated for price reasonableness and realism.

ADDENDUM TO FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS

The following provisions are incorporated into 52.212-2 as an addendum to this solicitation:

Source Selection for the Log HOUSE solicitation fosters competition within each award category between potential contractors. Offerors who propose for the Full and Open award will only compete with other vendors proposing as Full and Open Offerors. Offerors who propose as Haul and Install (Small Business Set Aside) will only compete against other eligible Offerors who have submitted proposals as Haul and Install (Small Business Set Aside). Offerors who propose as Maintenance and Deactivation (Small Business Set Aside) will only compete against other eligible Offerors who have submitted proposals as Maintenance and Deactivation (Small Business Set Aside). As each award category is unique, FEMA has developed distinct requirements for each of the three (3) categories.

Full and Open

There is no business set-aside or other restrictions or limits for proposals responding to the Full and Open portion of the Log HOUSE solicitation. Offerors proposing as Full and Open Offerors must be able to meet all of the requirements identified. No consideration will be given to business size as part of the technical evaluation for Full and Open offers. Corporate Responsibility and Capability will be evaluated equally for all Offerors in this category. Full and Open Offerors are required to provide services in all areas of the Log HOUSE contract which include but are not limited to the general list below:

1. Prepare/construct MHU Staging Area

2. Transport manufactured homes;

3. Staging operations;

4. Haul and install manufactured homes;

5. Perform maintenance on manufactured homes;

6. Deactivate (uninstall) manufactured homes;

7. Commercial Park expansion including design and construct of commercial manufactured home parks;

8. Site selection/evaluation for the design and construct a new manufactured home parks (FEMA group sites);

9. Perform maintenance on FEMA group sites; and

10. Semi-Permanent/Permanent Construction

There are other requirements in the contract; however, the above list encompasses the major contract areas. Missions for Full and Open Offerors may include commercial park expansion and/or group site construction. The minimum haul and install mission size for Full and Open contractors is between 51 and 250 MHUs. Full and Open Offerors shall be able to support and manage two simultaneous events that require the construction of two group sites, the construction of two commercial park expansions, the installation and maintenance of 4000 units and the maintenance of two group sites.

Haul and Install (Small Business Set Aside)

Offerors are restricted to businesses that qualify as small businesses as defined in FAR Part 19.

Offerors proposing as Haul and Install (Small Business Set Aside) must be able to meet all of the requirements identified. Corporate Responsibility and Capability will be evaluated equally for all Offerors in this category. Haul and Install (Small Business Set Aside) Offerors are required to provide services in the areas defined as applicable to Haul and Install (Small Business Set Aside) within the Log HOUSE contract which include but are not limited to the general list below:

1. Transport manufactured homes;

2. Staging operations; and

3. Haul and install manufactured homes.

Maintenance and Deactivation (Small Business Set Aside)

Offerors are restricted to businesses that qualify as small businesses as defined in FAR Part 19.

Offerors proposing as Maintenance and Deactivation (Small Business Set Aside) must be able to meet all of the requirements identified. 3. Perform maintenance on manufactured homes;

PROPOSAL DIVISION

To make the requirements clearer for each category, Section M has been divided into three (3) separate sections and has been clearly identified. Section M is presented in the following order:

I- Full and Open – Section M.4 II- Haul and Install (Small Business Set Aside) – Section M.5 III- Maintenance and Deactivation (Small Business Set Aside) – Section M.6

M.3 EVALUATION RATING

An adjectival rating system will be used to show how well proposals meet technical solicitation requirements and performance standards. Unless specified otherwise, the following adjectival ratings will be used for all Technical Factors for each type of award.

Rating Definition

Superior

The proposal demonstrates an excellent understanding of the requirements and an approach that significantly exceeds performance or capability standards. The Offeror’s proposal addresses all aspects of the requirements in detail and has strengths that will significantly benefit the Government and risk of unsuccessful performance is very low.

Satisfactory

The proposal demonstrates an understanding of the requirements and an approach that meets performance or capability standards. The Offeror’s proposal addresses most aspects of the requirements and presents an acceptable solution with few or no strengths and risk of unsuccessful performance is moderate.

Marginal

Proposal demonstrates a shallow understanding of the requirements and an approach that only marginally meets performance or capability standards necessary for minimal but acceptable contract performance. The risk of unsuccessful performance is high.

Unsatisfactory

The proposal fails to meet requirements and one or more deficiencies exist for which correction would require a major revision or redirection of the proposal.

The Offeror’s proposal does not address key aspects of the requirement and a contract cannot be awarded with this proposal as the risk of unsuccessful performance is high.

SECTION M.4: FULL AND OPEN OFFERORS ONLY

VOLUME I: – TECHNICAL PROPOSAL REQUIREMENTS - FULL AND OPEN

FULL AND OPEN PROPOSAL - FACTOR 1 – TECHNICAL SCENARIOS

(TECHNICAL FACTOR) - (LOCATION IN PROPOSAL: VOLUME I, TAB 1)

For the Full and Open evaluation, the FEMA Technical Evaluation Board will evaluate the Offeror’s proposal for two scenarios: Technical Scenario 1 (TS1): Group Site Design, and Technical Scenario 2 (TS2): Haul and Install and Maintenance and Deactivation Mission. These scenarios are for evaluation purposes only. Evaluations will be based on the responses to the scenarios. FEMA will use the adjectival ratings in the Evaluation Ratings table located in Section M.3 of this document.

Note: A result below Marginal in a scenario may result in disqualification of the Offeror.

Full and Open Proposal - Factor 1 - SubFactor1: - TS1: Group Site Design - (Location in Proposal: Volume I, Tab 1, Sub-Tab 1)

Sub-Tabs 3 and 4: Shall be left blank or not included. The Offeror will not be rated on Sub- Factors 3 or 4.

Technical Evaluation Scenario One: Full and Open Category

Evaluation Criteria:

• Ability to produce a design that meets both contract and scenario requirements and national codes.

• Ability to produce a design with few major and minor deficiencies.

• Ability to develop quantity take offs.

• Ability to develop a construction cost estimate.

• Ability to identify quantities and costs for each invoice period for the construction period based on the estimated construction timeline.

Evaluation:

FEMA will evaluate the Offeror’s response to the scenario submitted with the proposal, on the following aspects:

• Ability to produce a design that meets the contract and scenario requirements, the items identified in Form J-27 and the conditions outlined in TS1.

• Ability to produce a design with a minimum of minor deficiencies and no major deficiencies.

• Ability to develop appropriate and reasonable quantity take offs using the form labeled J-

27. DO NOT include pricing information on Form J.27 as part of the technical proposal.

• Ability to develop a realistic project plan and timeline for construction of the group site.

• Ability to comply with the terms and conditions of the contract and applicable codes and regulations apply including but not limited to National Electric Code, Uniform Plumbing Code, etc.

Any deficiency that can cause failure of critical systems such as water, sewer, electrical, road, erosion control or site drainage includes failure to address the requirements of TS1 in sufficient detail can be considered a deficiency.

Specifically for TS1, minor deficiencies can include omission or failure to mention or include an element of a required feature of the project, i.e., items listed in J.27.

Full and Open Proposal - Factor 1 – Sub-Factor 2: - TS2: A Haul and Install and Maintenance and Deactivation Mission for Full and Open Proposals - (Location in Proposal: Volume I, Tab 1, Sub-Tab 2)

Technical Evaluation Scenario Two: Full and Open Category

Evaluation:

• Ability to understand the conditions and requirements of the contract.

• Ability to identify the appropriate CLINs and quantities necessary to meet the requirements of the mission.

• Ability to provide an accurate timeline for the mission, including but not limited to site inspection, unit installation, unit maintenance, and unit deactivation, using the FEMA provided template (Attachment J.55).

• Ability to demonstrate, with a narrative description, a full understanding of the scenario and applicable requirements of the contract.

SubFactor3: TS3: Technical Scenario Three Haul and Install Mission

Past Performance – Past Performance Questionnaires to ascertain the probability of successfully performing the required effort. Past Performance will be evaluated as a measure of the Offeror’s ability to successfully perform this project based on demonstrated relevant and recent performance in supplying services and managing contracts/task orders. The Government will conduct past performance assessment based on the quality, relevancy, and recency of the Offeror’s past performance, as well as that of the subcontractors or partners. Past performance evaluation will consider the extent of the Offeror’s recent, relevant, and demonstrated ability to meet this project’s: 1) performance/technical requirements, 2) schedule, 3) cost control, 4) customer satisfaction, and 5) risk management.

The Offeror’s past performance as a prime Offeror or sub-Offeror, and that of any subcontractors or other partners, will be evaluated based on the past performance information provided by the Offeror in accordance with Performance Questionnaires, as well as data obtained by other sources. The Government reserves the right to obtain and utilize information obtained from any other source, e.g. CPARS, in addition to the information provided by the Offeror. The Government may consider a wide array of information from a variety of sources. Past Performance evaluation will determine, based on the relevance, and quality of the Offeror’s past performance, the degree of performance risk associated with the Offeror’s past performance.

FEMA will evaluate the Offeror’s past performance, considering performance/ meeting technical requirements, schedule, cost control, customer satisfaction, and risk management, on the following aspects:

• The Offeror’s relevant performance during work to complete one or more of the projects presented to the Government.

• The Offeror’s relevant performance during work to complete other projects.

• Relevant information about the Offeror’s performance history obtained by the

Government from other sources.

• The Government’s evaluation of the Offeror’s past performance may take into account past performance information regarding predecessor companies to the Offeror, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition.

• In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available, the Offeror will be evaluated as neutral.

(1) Subcontractor Approach. The Offeror’s will be evaluated on a subcontractor plan and approach that identifies how the Offeror will utilize subcontractors to achieve the requirements of the solicitation including the selection process for subcontractors, the management plan developed for monitoring subcontractors work quality and schedule, the level of work experience (number of projects together) with the subcontractor, and the magnitude of experience the subcontractor has as it relates to their functional role.

(2) The Offeror’s will be evaluated on whether they submit a subcontracting plan in accordance with the requirements identified in the Department of Homeland Security Subcontracting Plan Review Checklist (DHS Form 700-23). The Offeror should describe the efforts it will undertake to ensure that small business concerns will have an equitable opportunity to compete for subcontracts. The Offeror can reference DHS Form 700-23 for the rating definitions of the factors that will be utilized to evaluate the Offeror’s Small Business Subcontracting Plan (SBSP).

(3) For the plan to be acceptable, the Offeror’s SBSP must have a “Yes” in all of the factors identified in the DHS SBSP Checklist. A “No” in any of the factors will result in the SBSP being rated as unacceptable.
