Information provided via answers to these questions in this amendment shall not qualify the terms and conditions of the solicitations and specifications. Terms of the solicitation and specifications remain unchanged unless specifically amended in the solicitation. Any disparity between the answers to the questions and the changes to the terms of the solicitation and specifications of the solicitation will go in favor of the actual solicitation, not answers to questions. If an amendment is issued, normal procedures relating to the acknowledgement and receipt of solicitation amendments shall apply.
1. RFI response #31 and attachment 23 indicates that a Government provided survey is included in amendment 04. Attachment 23 is not a survey and contains no bench mark data in which to place the building relative to existing buildings or roadways. Can the Government provide a survey for the site with existing conditions indicated such as buildings, roadways, parking lots, trees, utilities, etc.?

2. Question about Part III-Past Performance. We recently had to do a questionnaire similar to the one that is in this Solicitation, and I was wondering can we use that questionnaire; however it is five pages to each project. Would this still be limited to ten pages?
No, see amendment # 5, surveys and questionnaires will not count against 10 page limit.
3. It is the Contractor's understanding that Submittals will be required on the major portions of the job. Is this a correct understanding?
Yes
4. Are these Submittals on the major portions of the job only required on the 100% Submittal or on the 35% and 65% as well?
Yes
5. On most contracts, Submittals are usually only required after a project is awarded and purchase order is issued to the material supplier or subcontractor, because suppliers and/or subcontractors will not typically furnish submittals until they have received a contract. It usually takes 30 to 45 days after award to receive the submittals. In light of this, can the Submittals requirement the Government is asking for be waived to ease the burden on Contractor's wishing to bid on this RFP? –

6. Please provide any cad file or GIS file for the existing conditions information provided in Amendment 4.

7. The RFP requirements for full 35, 65 and 100% design documents is excessive and burdensome to an 8a Contractor and their designers. Please consider accepting conceptual drawings for the sample project as is normal for a Design/Build project.
See amendment #5, at this time, the Government has chosen to continue evaluation at 35%, 65% and 100%.
8. We respectfully request that the bid date be extended to allow sufficient time after issuance of the utility and survey cad files for the contractors and designers to prepare the required documents.

9. Due to the minimal amount of AutoCad files provided by the Government and the large amount of Drawings required for the Proposal, would the Government please extend the deadline for the proposal an additional 45-days?

10. The answer to question 38 of Attachment 18 seems to indicate that the "preponderance" of task order design-build projects would require 100% design at bid. This conflicts with the discussions that occurred during the pre-bid meeting on August 20. The indication from the government representative at that meeting was that all design-build task orders would be bid and awarded without any requirements for pre-bid design, other than what the contractor deemed to be necessary for his own use in preparing his bid. Please clarify this issue.
The answer to question 38 is incorrect. The preponderance of design-build task orders will be bid and awarded without any requirements for pre-bid design
11. The current RFI submittal cut-off date is 9/15/13 which is a Sunday. With the extension to the bid date issued in Amendment 5 and a second site visit scheduled for 9/10/13, please consider extending the RFI cutoff date at least another two weeks.

12. Will Design fees/cost be considered a part of the $750 cap for new construction?
Yes, the design fees should be included.
13. We are bidding on this project and in the process of obtaining Bid Bond but I’m wondering if this is required for the sample project. Also, I didn’t see a liquidated damages amount. Can you clarify if these are needed?
See amendment#3- There are no LD’s for the sample project as this is for evaluation purposes only. The determination to include LD’s will be made post award per individual task order as appropriate.
14. Concerning M002 EVALUATION FACTORS / Page 63 / a. Evaluation Factors and Subfactors / e. Past Performance Factor, (2) Evaluation Process /Page 65, item (ii) Relevancy Assessment - Relevant performance includes efforts involving similar or greater in scope, magnitude and complexity than the effort described in this solicitation. QUESTION: Does the description of work provided in the 1442, item 10, paragraph 2; and Clause 52.216-19 ORDER LIMITATIONS. (OCT 1995) below define what is considered Relevant Performance for Projects to be submitted?
Correction to previous answer – “To all previous responses to relevant contract past performance”. Relevant contract past performance will be based off of requirement(s) in the solicitation (MACC Contract), not individual task orders, i.e sample project.
15. Would it be possible to obtain a list of people who attended the prebid on Tuesday?

16. Government stipulates that the Offeror’s price proposal method is to be determined by the Offeror and will be part of the evaluation process; however this direction could lead to unrealistic pricing for the new building renovation, thereby providing an unfair advantage. The inclusion or exclusion of such factors as profit/overhead, bonds, permits, etc. will have impact on the new building cost and thereby the cost/square foot. This is a governing factor in MACC selection.
Contractor request that Government provide direction and stipulate such cost to be included else unfair advantage will be given to some Offerors.
As stated the offeror’s price proposal is determined by the offeror and will be part of the evaluation process. However, a blank AF Form 3052 has been provided via amendment # 2.
The AF Form 3052 has sections to address cost elements such as overhead, profit, bonds, etc., to be broke out for technical evaluation of individual cost element associate with the proposed pricing. We highly encourage prospective offerors too completely and accurately fill out the 3052; otherwise proposals may run the risk of being found technically unacceptable.
