The required performance has changed from Multiple Award Construction Contract (MACC) is a competitive 8(a) multiple award, indefinite delivery/indefinite quantity (IDIQ) construction contract based on established clauses, Terms and Conditions & General Provisions. Specific projects will be defined with each individual Task Order.Work is to be performed in the general construction category to include maintenance, repair, alteration, mechanical, electrical, heating/air conditioning, demolition, painting, paving, earthwork & waterfront work in industrial/office buildings. Work may involve design/build projects as well as new construction of buildings or facilities to include some or all of the above elements of work. Scope includes work at Shaw AFB, Pointsett Electronic Combat Range, & Wateree Recreation Facility,SC & various other sites throughout the southeastern US.A pre-proposal conference/site visit is scheduled for __20 Aug 13_____________. Veteran-owned small business concern means a small business concern--
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
"Women-owned small business concern," means a small business concern --
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; or
(2) Whose management and daily business operations are controlled by one or more women.
(d) Notice.
(1) If this solicitation is for supplies and has been set aside, in whole or in part, for small business concerns, then the clause in this solicitation providing notice of the set-aside contains restrictions on the source of the end items to be furnished.
(2) Under 15 U.S.C. 645(d), any person who misrepresents a firm's status as a small, HUBZone small, small disadvantaged, or women-owned small business concern in order to obtain a contract to be awarded under the preference programs established pursuant to section 8(a), 8(d), 9, or 15 of the Small Business Act or any other provision of Federal law that specifically references section 8(d) for a definition of program eligibility, shall--
(i) Be punished by imposition of fine, imprisonment, or both;
(ii) Be subject to administrative remedies, including suspension and debarment; and
(iii) Be ineligible for participation in programs conducted under the authority of the Act.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
PROPOSAL PREPARATION INSTRUCTI
52.215-1 INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION (Addendum)
SECTION L- PROPOSAL PREPARATION INSTRUCTIONS
A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein.
Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors.
Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of three (3) separate Parts; Part I - Price Proposal, Part II - Technical Proposal, and Part III - Past Performance Information. Note the 3 separate Parts of the offeror’s Proposal will be evaluated in accordance with Section M - Evaluation Factors for Award. The separate Proposal Parts will be broken into factors for evaluation as follows:
Part I = Factor 1: Cost/Price Part II = Factor 2: Technical Acceptability Subfactor 1: Drawings Subfactor 2: Specifications
Subfactor 3: Design Calculations Subfactor 4: Construction Cost Estimate of the Sample Project
Subfactor 5: Submittals Part III = Factor 3: Past Performance
B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional data will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit cost data to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.
C. Specific Instructions:
1. PART I – PRICE PROPOSAL - Submit original and one (1) copy
(a) Complete blocks 14, 15, 17, 19, (if applicable) 20, 20A, 20B, 20C of Standard Form 1442. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP Sections A through K. These sections constitute the model contract. Only official(s) having the authority to bind the company contractually must sign and date the SF 1442.
(b) Complete the necessary fill-ins and certifications in Sections I through K. Section K shall be returned in its entirety. For Sections C through I, the offeror shall submit only those pages that require a fill-in.
(c) Provide a copy of the letter from the Small Business Administration (SBA) showing proof of Section 8(a) status.
2. PART II – TECHNICAL PROPOSAL - Submit original plus three (3) copies.
Sample Project: Submit original plus three (3) copies.
Required Documents: Provide required documents as referenced in the sample project (Attachment 11 Sample Project SOW). In addition, an AF Form 3052 is required Technical data that will be review:

3. PART III – PAST PERFORMANCE INFORMATION - Limited to no more than 10 pages, excluding past performance questionnaires. Only references for relevant past efforts/contracts are desired. Submit original plus three (3) copies.
(a) Performance Surveys: The government will evaluate the quality and extent of offeror's performance deemed relevant to the requirements of this RFP. The government will use information submitted by the offeror and any other sources of information available to the Government to assess past performance.
Provide a list of no more than ten (10), of the most relevant contracts performed for Federal agencies and commercial customers within the last three (3) years as of proposal due date. Relevant contracts include includes efforts involving similar or greater in scope, magnitude and complexity than the effort described in this solicitation. The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition. Furnish the following information for each contract listed:
(i) Company/Division name
(ii) Product/Service
(iii) Contracting Agency/Customer
(iv) Contract Number
(v) Contract Dollar Value
(vi) Period of Performance
(vii) Verified, up-to-date name, address, FAX & telephone number of the contracting officer
(viii) Comments regarding compliance with contract terms and conditions
(ix) Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions.
(b) Quality and Satisfaction Rating for up to ten (10) Contracts Completed in the Past Three Years:
Provide any information currently available (letters, metrics, customer surveys, independent surveys, etc.)
which demonstrates customer satisfaction with overall job performance and quality of completed product for relevant past efforts/contracts (similar in scope and magnitude of effort and complexities this solicitation requires). In addition, explain corrective actions taken in the past for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc.
(c) If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any relevant and recent past performance information on previous teaming arrangements with same partner. If this is a first time joint effort, each party to the arrangement must provide a list of past relevant contracts.
(d) Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.
D. Documents submitted in response to this RFP must be fully responsive to and consistent with the following:
1. Requirements of the RFP (CLINs, SOW & All Attachments) and government standards and regulations pertaining to the SOW.
2. Evaluation Factors for Award in Section M of this RFP.
3. Any limitation on the number of proposal pages. Pages exceeding the page limitations set forth in this
Section L will not be read or evaluated, and will be removed from the proposal.
4. Format for proposal Parts II and III shall be as follows:
(a) The proposals will be 8 1/2” x 11” paper except for fold-outs used for charts, tables, drawing, or diagrams, which may not exceed 11” x 17”.
(b) A page is defined as one face of a sheet of paper containing information.
(c) Typing shall not be less than 12 pitch.
(d) Elaborate formats, bindings or color presentations are not desired or required.
(c) Pre-proposal Conference: A pre-bid/pre-proposal conference will be conducted at 10:00a.m., on 10 Sep 2013 at 13:30 pm, at the Bldg 921, Shaw AFB, SC for the purpose of answering questions regarding this solicitation.

Section M - Evaluation Factors for Award
M001- SOURCE SELECTION
a. Basis for Contract Award This is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15, Contracting by Negotiation, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), the Air Force Federal Acquisition Regulation Supplement (AFFARS), DoD Source Selection Procedures, Appendix A, 04 March 2011 and Air Force Mandatory Procedures 5315.3 27 March 2013. These regulations are available electronically at the Air Force (AF) FARSite, http://farsite.hill.af.mil. The Government will select the proposals with the lowest evaluated price from among those meeting the acceptability standards for non-price factors. Contract(s) may be awarded to the offeror(s) who is deemed responsible in accordance with the FAR Part 9.1, as supplemented, whose proposals conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation) and is judged, based on the evaluation factors and subfactors, to represent the lowest price technically acceptable past performance proposals.
b. Number of Contracts to be Awarded The Government intends to award no more than six (6) contract(s) for the Multiple Award Construction Contract.
c. Correction Potential of Proposals If an offeror’s proposal is eliminated or otherwise removed from the competitive range, no further revisions to that offeror’s proposal shall be accepted or considered. The Government may request or allow proposal revisions to clarify and document understandings reached during negotiations. At the conclusion of discussions, each offeror still in the competitive range may be given an opportunity to submit a final proposal revision. The Government will establish a cut-off date for receipt of final proposal revisions. Requests for final proposal revisions will advise offerors that the final revisions shall be in writing and that the Government intends to make award without obtaining further revisions.
d. Discussions If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award.
e. Solicitation Requirements, Terms and Conditions Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors or subfactors. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable.
f. Approach
Step 1: Rank all proposals by price, from lowest to highest.
Step 2: Evaluate a minimum of 10 of the lowest priced proposals for technical acceptability and price reasonableness.
Step 3: Assess past performance for a minimum of 10 of the lowest priced technically acceptable offerors.
DoD Source Selection Procedures paragraphs 3.4 - 3.7 will be used if discussions may be conducted.
Step 4: Award to no more than six (6) Lowest Price Technically Acceptable (LPTA) contractors for Best Value
M002 EVALUATION FACTORS
a. Evaluation Factors and Subfactors The following evaluation factors and subfactors will be used to evaluate each proposal. The Government will evaluate proposals for acceptability, but will not rank the proposals by the non-price factors or subfactors.

b. Cost/Price
1. The offeror's Price proposal for Sample Project, Attachment 11, will be evaluated for award purposes, based upon the total price proposed for the basic requirements. Price will be evaluated using techniques established in FAR 15.404-1 to ensure the Government receives a fair, reasonable, and balanced price. There are no Options to evaluate for this award.
2. In addition to the price analysis as described at FAR 15.404-1(b), price proposals will be analyzed to identify any potential unbalanced pricing (See FAR 15.404-1(g)). If the Government sees a wide variation in proposed contract line item prices, the technical evaluation board will be informed as soon as possible during the initial evaluation of proposals so the appropriate personnel may seek clarity through offeror exchanges. Absent any issues related to the stated requirement, unbalanced pricing may pose an unacceptable risk to the Government and may be a reason to reject an offeror's proposal.
3. There is a great expectation of competition for this requirement; thus offerors are cautioned to present their best price proposal up-front. The offeror's price proposal shall represent the offeror's best effort to respond to the solicitation. As an LPTA source selection, the Government reserves the right to, but is not required to conduct analysis on offers that appear to be exceptionally low and not supported by the offeror's technical approach. In instances where an offeror receives acceptable technical and past performance ratings, yet proposed prices appear exceptionally low, offerors may be requested to address this disparity, providing evidence of their capability and/or experience providing similar service(s) at similar price(s). An exceptionally or unrealistically low offer may pose an unacceptable risk to the Government and may be a reason to reject an offeror's proposal.
4. If the Government cannot determine the proposed pricing to be fair and reasonable, other than cost and pricing data will be obtained from the offerors.
d. Remaining Technical Factors The Government’s technical evaluation team shall evaluate the technical proposals on an acceptable or unacceptable basis, assigning one of the ratings described below for each subfactor. Any subfactor evaluated as “Unacceptable” will render the entire proposal unacceptable and, therefore, unawardable. Only those proposals determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. However, the offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.
The proposals shall be evaluated against the following technical subfactors:
Subfactor 1. Drawings: Drawings must be legible. Drawings and 3D Rendering must conform to the requirements contained in the definitions for 35% , 65% and 100% design, conform to the requirements of MACC General Provisions (Attachment 2) and Sample Project SOW (Attachment 11), ensuring inclusion of professional certifications
Subfactor 2. Specifications: All sections must be legible, edited to match the project scope and conform to the MACC General Provisions (Attachment 2) and the Sample Project (Attachment 11) and conform to the Construction Standards Institute (CSI) 2012 MasterFormat divisions' standard as defined in the Shaw AFB Design Standards (Attachment 3)
Subfactor 3. Design Calculations: All required design calculations must be legible and conform to the requirements of the MACC General Provisions (Attachment 2) and the Sample Project (Attachment 11)
Subfactor 4. Construction Cost Estimate for the Sample Project: The construction cost estimate (AF Form 3052) must be legible (front and back), contain pricing for each line item category as well as a total cost and be signed and dated by the contractor.
Subfactor 5. Submittals*: All submittals required by the Sample Project (Attachment 11), including color boards, cut sheets, MSDS’s, and ETC, must be legible and correspond to the products being proposed for the project. Submittals must conform to the requirements contained in MACC General Provisions (Attachment 2)
*Design Submittals: The 35% , 65% and 100% design submittals must contain all of the elements required by definitions in the MACC General Provisions (Attachment 2). The elements must be indexed or otherwise easily identifiable, for example, the design calculations for primary structure components (foundations, structures, roofs, etc.) should be clearly identified as such.
e. Past Performance Factor The Past Performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. Offerors must receive a past performance rating of “Acceptable” to be eligible for award.
(1) Ratings. The Past Performance factor will receive one of the ratings described below.

(2) Evaluation Process. The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the solicitation requirements. In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror’s Past Performance proposal volume and information obtained from other sources available to the Government, to include, but not limited to: the Past Performance Information Retrieval System (PPIRS); Federal Awardee Performance and Integrity Information System (FAPIIS); Electronic Subcontract Reporting System (eSRS), or other databases; and interviews/questionnaires with Program Managers, Contracting Officers and Fee Determining Officials, the Defense Contract Management Agency (DCMA), and commercial sources.
(i) Recency Assessment An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 3 years as of proposal due date. Past performance information that fails this condition will not be evaluated.
(ii) Relevancy Assessment The Government will conduct an evaluation of all recent performance information obtained to determine whether the products provided/services performed under those contracts relate to the Technical subfactors and Price factor.
For each recent past performance citation reviewed, the relevance of the work performed will generally be assessed for the Technical subfactors and Price Factor (however, all aspects of performance that relate to this acquisition may be considered). Relevant performance includes efforts involving similar or greater in scope, magnitude and complexity than the effort described in this solicitation. The Government may review more recent contracts or performance evaluations to ensure corrective actions have been implemented and to evaluate their effectiveness. A relevancy determination of the offeror’s past performance will be made based upon the aforementioned considerations, including joint venture partner(s) and major and critical subcontractor(s). In determining the relevancy of effort performed under individual past performance contracts, the government will only consider the specific effort or portion consistent with that proposed by the prime, subcontractor or teaming partner.1 The past performance information forms (PIFs) and information obtained from other sources will be used to establish the relevancy of past performance. The Government will use the following relevancy definitions when assessing recent, relevant contracts:

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a) (2) (iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
NOT RELEVANT Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
1 Only the past performance effort which is related to the work the offeror is proposing to perform will contribute to the assessment. Take, for example, an RFP for a contact to manufacture, provide logistical support, and provide user training for “System X.” If an offeror submits recent past performance contracts involving manufacturing effort which is “essentially the same scope and magnitude of effort and complexities this solicitation requires,” but the offeror is not proposing to manufacture System X (i.e., another team member or subcontractor is proposed to perform System X manufacture), the offeror’s past manufacturing performance would not contribute to the System X manufacturing performance assessment.
(iii) Performance Quality Assessment The Government will consider the performance quality of recent, relevant efforts (how well the contractor performed on the contracts). For each recent, relevant past performance citation reviewed, the performance quality of the work performed will be assessed for the Technical subfactors and Price Factor (however, all aspects of performance that relate to this acquisition may be considered). The quality assessment may result in positive or adverse findings. Adverse is defined as past performance information that supports an unsatisfactory rating on any evaluation element or any unfavorable comment received from sources without a formal rating system. For adverse information identified, the evaluation will consider the number and severity of the problem(s), mitigating circumstances, and the effectiveness of corrective actions that have resulted in sustained improvements. Process changes will only be considered when objectively measurable improvements in performance have been demonstrated. The Government will use the following quality levels when assessing recent, relevant efforts:

(3) Assigning Ratings. As a result of the relevancy and performance quality assessments of the recent contracts evaluated, offerors will receive an integrated past performance rating at the factor level (see Table 2).
