About this file
This is a federal contract clause document, specifically FAR 52.204-27, establishing a prohibition on ByteDance-covered applications in federal contracting.
The clause prohibits contractors and their employees from having or using TikTok or any successor application or service developed or provided by ByteDance Limited on any information technology owned, managed, or provided by the Government, or on any information technology used or provided by the Contractor under the contract. The prohibition applies to equipment used by federal contractors in the performance of federal contracts and includes computers, software, peripheral equipment, and related services. The clause defines "information technology" broadly to encompass equipment used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information. The prohibition derives from Section 102 of Division R of the Consolidated Appropriations Act, 2023, the No TikTok on Government Devices Act, and OMB Memorandum M-23-13 dated February 27, 2023. Exceptions to the prohibition may only be granted through written notification from the Contracting Officer in accordance with OMB Memorandum M-23-13. Contractors are required to insert the substance of this clause, including subcontract requirements, in all subcontracts, including those for commercial products or commercial services.
