About this file
This is Amendment A00003 to a Request for Lease Proposal (RLP) for the Department of Veterans Affairs Regional Procurement Office - West, effective April 7, 2026. The amendment addresses seven questions submitted by interested parties regarding solicitation 36C24W26R0013.
Key clarifications include: (1) the VA will follow RLP language regarding dual agency situations, with any offeror choosing dual agency required to execute a dual agency agreement with the broker at their sole discretion; (2) the draft lease sections will be finalized upon award and are provided for illustrative purposes only; (3) perimeter fencing is not strictly required but alternative fencing solutions must meet all applicable safety and security standards; (4) a minimum of 100 parking spaces is required; (5) this procurement is not set aside for Service-Disabled Veteran-Owned Small Business (SDVOSB); (6) offerors must respond to Section 4 evaluation factors in addition to demonstrating compliance with Section 3 requirements; and (7) BSAC Allowance provisions have been intentionally removed and do not apply. The amendment was signed by Jeffrey R. Deering, Lease Contracting Officer, on April 14, 2026.

This amendment provides answers to the questions submitted by interested parties to solicitation 36C24W26R0013.
1. There is potential for preferential treatment in a dual agency situation, which would be allowed per the current terms. With the amended Broker language in the current RLP, how will the VA ensure a fair and equal procurement when commissions are negotiated individually and dual agency is allowed? The VA will follow the language contained RLP, LA and any subsequent RLP amendments. Any offeror choosing to engage in dual agency must execute a dual agency agreement with the broker. This decision is solely at the offeror’s discretion and should be based on their assessment of whether it serves their best interests."
2. It appears there is broker commission to be paid for this procurement. If so, can the agency please amend the draft Lease Sections 1.04 and 2.05 to accurately reflect the Broker Commission, Commission Credit, and Payment of Broker language?
The draft lease will be finalized upon award. The draft lease version included in the solicitation is provided for illustrative purposes only and is not intended to represent the final, fully executed lease.
3. Can the agency confirm that perimeter fencing is required?
The agency is open to alternative fencing solutions, provided they meet all applicable safety and security standards and any other requirements in accordance with the RLP Language.
4. Can the agency clarify the required number of parking spaces?
A minimum of 100 parking spaces is required.
5. Can the agency confirm if this project is an SDVOSB set-aside?
This procurement is not set aside for SDVOSB.
6. Can the Agency clarify if the Offeror should include a response to Section 4 – Factors in their submittal, or if compliance with the requirements set out in Section 3 is sufficient?
Section 4 outlines the evaluation factors that will be used in determining the award and reiterates the information that should be included in the offer.
7. Can the agency clarify if a BSAC Allowance should be included in RLP Section 3.09?
This item was intentionally removed and does not apply to this solicitation.
Except as provided herein, all terms and conditions of the document referenced in Item 1, as heretofore changed, remains unchanged and in full force and effect.
