About this file

The document is a federal provision (FAR 52.204-24) addressing representations regarding certain telecommunications and video surveillance services or equipment, issued in November 2021. The provision implements sections of the John S. McCain National Defense Authorization Act, which prohibits federal agencies from procuring or using telecommunications equipment or services from certain providers. Specifically, it requires offerors to disclose whether they provide or use covered telecommunications equipment or services, with detailed reporting requirements if they do so.

Key requirements include reviewing the System for Award Management (SAM) for excluded parties, completing representations about telecommunications equipment usage, and providing extensive disclosure information if affirmative responses are given. Offerors must identify the entities producing covered equipment, describe the equipment in detail (including brand, model number, and item description), and explain the proposed use of such equipment. The provision applies to both equipment and services, with specific reporting requirements for maintenance-related services and other telecommunications services.
