About this file

This is a Task Assignment Change Order Form issued by the Florida Department of Environmental Protection (FDEP) for a design contract with DRMP (consultant) concerning the Lovers Key State Park South Beach Restroom Replacement project. The contract is identified as FDEP Contract No. CN225, Task Assignment No. 32, Change Order No. 4, and Project No. 61296C. The project location is Lovers Key State Park, with DRMP represented by Ben Lennon and FDEP Contract Manager Ralph Perkins overseeing the work.

Change Order No. 4 increases the task amount by $8,807.00, bringing the total task amount to $136,377.97 with all change orders. The change is necessitated by Hurricane Ian's September 2022 impact, which invalidated the existing wetland and general wildlife survey due to substantial changes in site conditions and topography. The work consists of two subtasks: Subtask 12 (Wetland and General Wildlife Survey Update) totaling $2,887.53 and Subtask 13 (Electrical Revisions) totaling $5,919.47. Subtask 12 involves conducting a new general wildlife survey, delineating wetlands and surface waters per federal and state guidelines, and updating the Ecological Assessment Report for permit requirements. Subtask 13 includes redesigning electrical service for additional capacity, adding future gazebo provisions, incorporating spare conduit provisions, updating lift pump specifications, and providing directional drill design for electrical service. The project end date is extended by 60 days from December 31, 2022 to August 28, 2024, with both subtasks scheduled for completion within six weeks from start. All signatures were obtained by September 11, 2023.

Subject: FDEP Agreement #CN225 – Task Assignment #32 Lovers Key South Beach Restroom Replacement Proposal for Change Order No. 04 – Wetland and General Wildlife Survey & Electrical Revisions

Dear Mr. Sandel:

Due to Hurricane Ian in September of 2022, the current wetland and general wildlife survey are not valid, as conditions and topography at the project site have changed substantially. The wetland and general wildlife survey will need to be done again, and the Ecological Assessment Report updated. This documentation will be required for the CCCL permit and water management district exemption. Also, electrical design revisions including added capacity and spare conduits, and directional drill design for electrical service. Permitting for the electrical drill will be included in permitting for the water and sewer drill (previously scoped). Please see below for detailed scope descriptions.

Sincerely, Date: 08/28/2023 Benjamin Lennon, P.E.

Senior Project Manager

CC: Patrick Day, P.E.

Subtask 12: Wetland and General Wildlife Survey Update

Description: A general wildlife survey will be conducted to identify the occurrence or potential occurrence of listed and protected species within the project footprint. DRMP’s Team of qualified Professional Wetland Scientists (PWS) will delineate the wetlands and surface waters within the project limits in accordance with federal and state guidelines (2010 USACE Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Coastal Plain Region and FAC Rule 62- 340, respectively). Field evaluations will include delineation of wetland limits, obtaining agency verification of wetland limits, and performing qualitative wetland assessments, using methods such as the Uniform Mitigation Assessment Method (UMAM). The wetlands and surface waters are expected to fall within the wetland regulatory jurisdictions of the South Florida Water Management District (SFWMD) and U.S. Army Corps of Engineers (USACE). Government and other databases shall be reviewed to determine whether occurrences of state and federal listed plant and wildlife species have been documented within or immediately adjacent to the project such that development of the site could be adversely affected. The survey shall be designed such that the methodology, results, and conclusions would be acceptable to the U.S. Fish and Wildlife Service, Florida Fish and Wildlife Conservation Commission. Those species referred to as protected are listed under Florida Administrative Code 39-27.003-005 and Code of Federal Regulation (50 CFR 17.12). Any unexpected findings or findings with potential to substantially impact future development of the project area shall be immediately reported to the Client with preliminary recommendation to address these concerns.

Assumptions:

1. Should protected species be identified on site, a Species-Specific Survey may be required by the regulatory agencies. Fee estimates for Species-Specific Surveys will be negotiated separately, if warranted, and are not included in this scope

Deliverables: The deliverables will include an updated Ecological Assessment Report to the BDC in pdf electronic format describing and detailing the location of jurisdictional wetlands, mangroves, and results of the general wildlife survey within and nearby proximity of the project area.

Performance Measures: Deliverables shall be reviewed by the Department to confirm they are complete, accurate, and timely.

Subtask 13: Electrical Revisions

Description:

Redesign electrical service for additional capacity (coordinate step up and down transformer sizes too).

Add future gazebo provisions to panel schedule.

Add notes for spare conduit to be ran in an accessible location in the building.

Update plans to show lift pump location and power allocations.

Subtask 12: Wetland and General Wildlife Survey Update

SUBTASK 4 TOTAL:

Site visit to determine necessary utility transformer information Coordinate new utility transformer capacity.

Provide directional drill design for electrical service from the mainland transformer to the building. This will parallel the current water and sewer directional drill.

Deliverables: The deliverables will be included the 100% Constructions Documents (Subtask 9) to the BDC in hard copy and digital format including CAD Drawings.

Performance Measures: Deliverables shall be reviewed by the Department to confirm they are complete, accurate, and timely.
