52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Price

(ii) Technical capability

Acceptable technical capability: Provide documentation to prove that the vendor meets the requirement of section 1.5.8 of PWS (all trainers are qualified/certified by a recognized agency to provide First Aid/CPR/AED training).

Unacceptable technical capability: Inability to prove trainers are qualified/certified by a recognized agency to provide First Aid/CPR/AED training in accordance with section 1.5.8 of PWS.

No further consideration will be given to the vendors who do not meet the technical capability.

Price will not be rated. Price and Total Price will be evaluated IAW FAR 13.106-3(a).

Total Price - The total price is the sum of the prices for the Contract Line Item Numbers of the solicitation. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the option(s). As part of the price evaluation, the Government will evaluate the Option to Extend Services under FAR Clause 52.217-8 by adding one-half of the quoter's final option period price to the quoter's total price. Thus, the quoter's total price for the purpose of evaluation will include the base period, first option, second option, third option, fourth option, and one-half of the fourth option. Quoters are required only to price the base and four options. Quoters shall not submit a price for the potential one-half year extension of services period.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
