About this file
This is a sample agreement template for Short-Doyle and Mental Health Services Act (MHSA) specialty mental health services between the County of Santa Clara and a contractor for fiscal year 2024. The agreement establishes the framework for providing outpatient, residential, and cost-based mental health services to eligible Medi-Cal beneficiaries in Santa Clara County. The contract term runs from July 1, 2023, through June 30, 2024. The scope of work is defined in Exhibits A through C, which specify program names, reporting units, staffing requirements, and service modalities. Contractors must comply with all federal and state regulations governing mental health services, including requirements from the California Department of Health Care Services (DHCS), the Centers for Medicare & Medicaid Services (CMS), and applicable state and federal codes. The agreement requires contractors to follow County policies and procedures for credentialing, quality improvement, utilization management, and claims processing as outlined in the Provider Manual.
The Maximum Financial Obligation (MFO) is specified in Exhibit B and is contingent upon availability of state and federal funding; unspent fiscal year appropriations do not roll over to subsequent years. Compensation is based on approved claims submitted within specified timeframes using Current Procedural Terminology (CPT) or Healthcare Common Procedure Coding System (HCPCS) codes at rates defined in Exhibit B. The agreement includes differential payment rates for intensive outpatient services, which are paid at 10 percent higher rates than standard outpatient services. Contractors may request advance payments up to 15 percent of the annual MFO if they maintain a blanket fidelity bond. The agreement incorporates all applicable federal and state requirements regarding program integrity, credentialing, fraud prevention, compliance programs, and data security. Contractors are subject to regular audits, chart reviews, and monitoring by County and state agencies, with audit rights extending ten years from the contract end date. All overpayments identified through audits must be reimbursed within 60 calendar days of identification.
