About this file
This document is a contract evaluation provision (52.212-2) for commercial products and commercial services.
The Government will award the contract to the responsible offeror with the lowest conforming price that does not exceed available funding and is determined to be fair and reasonable. Price and Special Standards of Responsibility are the sole evaluation factors. Three specialized standards of responsibility apply: ANIAB accreditation from the ANSI National Accreditation Board (SP1), ANSI/NCSL Z540-1 certification for calibration and testing laboratories (SP2), and ISO/VIEC 17025 certification demonstrating competence of testing and calibration laboratories (SP3). All certificates/accreditations must be active and not expired; offerors failing to meet any specialized standard are ineligible for award. The evaluation process begins with a preliminary compliance review to ensure quotes follow solicitation instructions. The lowest-priced offer is then evaluated for price reasonableness; if reasonable, the offeror is identified as successful and assessed for responsibility using general standards and special standards of responsibility. If the successful offeror cannot be awarded the contract, the Contracting Officer evaluates the next lowest-priced offer using the same process until an award can be made or the Contracting Officer determines no award is possible. The Government intends to award without discussions but reserves the right to conduct discussions if deemed in its best interest. For procurements with options, the Government adds total option prices to the basic requirement price for evaluation purposes and may reject quotes with significantly unbalanced option pricing or quotes exceeding available funding.

E.2 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (NOV 2021)
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
EVALUATION
Bases of Award: This procurement is being conducted pursuant to RFO 13 and RFO § 9.1042, the Special Standards of Responsibility procedures. The Government intends to award a contract resulting from this solicitation to the responsible offeror whose quote, conforming to the solicitation, quotes the lowest price, whose quoted price does not exceed the amount of funding available for the procurement, and whose quoted price is found to be reasonable. Price, and Special Standards of Responsibility are the sole evaluation factors.
Offerors who fail to meet any special standard of responsibility will not be eligible to receive contract award.
Price: The Government will evaluate offers for award purposes on total cost of proposals submitted to determine if the price proposed is fair and reasonable. The Government anticipates adequate price competition and intends to award without discussions with respective Offerors. However, the Government reserves the right to conduct discussions if deemed in its best interest.
Special Standards of Responsibility: The following special standards of responsibility apply to this procurement:
SPECIALIZED STANDARDS
(Provide a certificate/accreditation copy)
SP1: ANIAB Accredited-ANSI National Accreditation Board
a. Certificate/Accreditation (Active-Not Expired)
SP2: ANSI/NCSL Z540-1-Requirements For Calibration & Testing Laboratories Control
a. Certificate/Accreditation (Active-Not Expired)
SP3: ISO/VIEC 17025 Competence of Testing & Calibration Laboratories
a. Certificate (Active-Not Expired)
Evaluation Process: Offers will be evaluated in the following manner: The lowest-priced offer will be evaluated to determine if is reasonable. If the offered price is found to be reasonable, the Offeror who submitted this offer will be identified as the “successful Offeror”.
The Contracting Officer will then determine if the successful offeror is responsible using the general standards of responsibility and the Special Standards of Responsibility and Past Performance applicable to this procurement. If contract award cannot be made to the successful Offeror, the Contracting Officer will evaluate the next lowest-priced offer following the procedures described above. This process will continue until a contract award can be made, or the Contracting Officer determines that no contract award can be made. A preliminary compliance review of quotes will be conducted to determine whether quotes followed the Solicitation Instructions. Quotes that fail to follow the Solicitation Instructions quote submission instructions will not be forwarded for evaluation and will not receive further consideration for award.
Award Without Discussions: The Government intends to evaluate quotes and award a contract without discussions with offerors. However, the Government reserves the right to conduct discussions at any time if determined by the contracting officer to be in the Government’s interest.
Options: The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced or if the quoted price for the basic requirement or any option exceeds the amount of funding available for any of those requirements. Evaluation of options shall not obligate the Government to exercise the option(s).
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
