About this file

This document is a federal contracting provision template titled "Buy American—Balance of Payments Program Certificate—Basic (FEB 2024)" prescribed under Defense Federal Acquisition Regulation Supplement 225.601(1). It is not a solicitation for specific products or services, but rather a certification form that offerors must complete for line items subject to Buy American and Balance of Payments Program restrictions.

The provision requires offerors to certify the country of origin and domestic content status of end products in their proposals. Offerors must identify which end products are domestic end products, which are qualifying country end products, and which are other foreign end products. For non-iron/steel foreign end products that are not COTS items, offerors must indicate whether domestic content exceeds 65 percent or mark "no" if the percentage is unknown. The form also requires separate identification of domestic end products containing critical components or critical items, with reference to Revolutionary FAR Overhaul 25.105. The Government will evaluate offers according to Part 225 of the Defense Federal Acquisition Regulation Supplement and will evaluate qualifying country end products without regard to Buy American statute restrictions. The certification must be signed by an authorized company representative with printed name, title, company, and date.
