About this file

This document is a federal contracting provision template for the Buy American—Balance of Payments Program Certificate, effective February 2024. It is prescribed for use in solicitations subject to the Buy American statute and Balance of Payments Program requirements under Defense Federal Acquisition Regulation Supplement Part 225.

The provision requires offerors to certify the country of origin and domestic content status of all end products subject to the Buy American and Balance of Payments Program—Basic clause. Offerors must identify each end product as either a domestic end product, a qualifying country end product, or a foreign end product. For domestic end products, offerors must separately list those containing critical components or critical items. For foreign end products that do not consist wholly or predominantly of iron or steel, offerors must indicate whether the products exceed 65 percent domestic content, except for commercially available off-the-shelf (COTS) items. If domestic content percentage is unknown, offerors must select "no." The Government will evaluate offers in accordance with Part 225 policies and will evaluate qualifying country end products without regard to Buy American statute or Balance of Payments Program restrictions. The provision includes certification tables for line item numbers organized by product classification and requires company, signatory, and date information. This is a template document used in defense solicitations to ensure compliance with domestic content and country-of-origin requirements.
