About this file

This is a federal contracting provision template for the Buy American—Balance of Payments Program Certificate, effective February 2024. The provision establishes certification requirements for offerors responding to solicitations subject to Buy American and Balance of Payments Program restrictions under Defense Federal Acquisition Regulation Supplement (DFARS) Part 225.

Offerors must certify the country of origin for all end products and identify whether items are domestic end products, qualifying country end products, or other foreign end products. For non-COTS items that are foreign end products not consisting wholly or predominantly of iron or steel, offerors must indicate whether domestic content exceeds 65 percent or select "no" if the percentage is unknown. The provision requires separate identification of domestic end products containing critical components or critical items per FAR 25.105. Offerors must list qualifying country end products by country of origin and line item number, and separately identify any other foreign end products with their countries of origin and domestic content percentages. The Government will evaluate offers according to Part 225 policies and will evaluate qualifying country end products without regard to Buy American statute or Balance of Payments Program restrictions. The completed certificate requires signature by an authorized representative with company name, printed name, title, signature, and date. This is a template form designed for inclusion in solicitation documents rather than a standalone solicitation.
