About this file
This is a Commercially Useful Function (CUF) Certification form issued by the State of California Department of Motor Vehicles for RFP ISD26-3629. The form must be completed and submitted by bidders with their proposals and applies to all certified small businesses (SB), micro businesses (MB), and Disadvantaged Veteran Business Enterprises (DVBE) operating as prime contractors or subcontractors. Bidders must certify that their SB, MB, or DVBE subcontractor(s) meet five specific CUF requirements: responsibility for executing a distinct element of the contract, actual performance or supervision of work, performance of work normal to the business, responsibility for negotiating pricing and managing materials and supplies (or mark N/A for service-only contracts), and limitation on further subcontracting beyond normal industry practices. The bidder must provide a written statement detailing the role, services, and goods each subcontractor will provide to satisfy CUF requirements, or indicate "Not claiming a preference" if no SB or DVBE preference is claimed.
Failure to answer "Yes" to any of the five CUF questions (except question four when marked N/A) may result in the proposal being deemed non-responsive. The State reserves the right to request additional written clarification prior to contract award. The bidder's authorized representative or corporate officer must sign and date the certification form, attesting that all certified small businesses or DVBEs satisfy the Commercially Useful Function requirement. This certification is a compliance requirement under California Government Code Section 14837, Military and Veterans Code Section 999, and Title II California Code of Regulations Sections 1896.4 and 1896.62.
