About this file
This is a federal contract provision template (FAR 52.204-24) addressing representations and disclosures regarding covered telecommunications and video surveillance equipment or services. The provision, effective November 2021, implements restrictions established under Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232).
The provision prohibits federal agencies from procuring or contracting with entities that use covered telecommunications equipment or services as substantial or essential components or critical technology in any system. Two key prohibitions apply: Section 889(a)(1)(A) effective August 13, 2019, restricts agency procurement of equipment or services using covered telecommunications components; Section 889(a)(1)(B) effective August 13, 2020, restricts agencies from entering contracts with entities that use such equipment or services regardless of whether use occurs during federal contract performance. Exceptions exist for services connecting to third-party facilities (backhaul, roaming, interconnection arrangements) and telecommunications equipment that cannot route, redirect, or provide visibility into user data traffic. Offerors must review the System for Award Management (SAM) exclusion list for entities barred for covered telecommunications violations and represent whether they will provide or currently use covered telecommunications equipment or services. If responding affirmatively to either representation, offerors must provide detailed disclosures including: the producing entity's name, unique entity identifier, and CAGE code; descriptions of equipment including brand, model number, and item specifications; and explanations of proposed use with factors determining permissibility under applicable prohibitions. The provision requires certification by an authorized individual with signature, title, and organization name.
