About this file
This is a federal contracting provision (FAR 52.204-24) requiring offerors to represent whether they will provide or use covered telecommunications equipment or services in contract performance.
The provision implements Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, which prohibits federal agencies from procuring equipment, systems, or services using covered telecommunications equipment or services as substantial or essential components or critical technology. Two distinct prohibitions apply: Section 889(a)(1)(A) prohibits procurement of equipment or services containing covered telecommunications components effective August 13, 2019; Section 889(a)(1)(B) prohibits contracting with entities that use covered telecommunications equipment or services in any capacity, effective August 13, 2020. Exceptions exist for third-party connectivity services (backhaul, roaming, interconnection arrangements) and telecommunications equipment unable to route, redirect, or provide visibility into user data traffic.
Offerors must make two representations: whether they will provide covered telecommunications equipment or services to the government in contract performance, and whether they use covered telecommunications equipment or services in their operations. If responding affirmatively to either representation, offerors must provide detailed disclosures including the producing entity name, unique entity identifier, CAGE code, OEM or distributor status, equipment descriptions (brand, model number, item description), Product Service Codes for services, and explanations of proposed use with factors relevant to determining permissibility under the prohibition. Offerors must review the System for Award Management (SAM) for excluded parties before submitting offers. The provision requires offeror name, date, and signature upon completion.
