About this file

This document is an Addendum to Instructions to Offerors for Commercial Items governing the submission of proposals for the procurement of Boeing 737 aircraft by JPATS (a U.S. Department of Justice program). Offerors must submit proposals by April 30, 2026, at 1:00 p.m. CST in two separately bound volumes: a Technical Proposal (not to exceed 100 pages, 10-12 point font) and a Business/Price Proposal. The period of acceptance for offers is 120 days from the solicitation closing date. Proposals must address four evaluation factors: (1) Technical Aircraft and Delivery Schedule, requiring completion of technical specification appendices, color photographs from specified angles of the aircraft exterior, interior, flightdeck, and cargo compartments, plus current maintenance and inspection status reports, airworthiness directives, service bulletins, and life-limited parts documentation, with delivery required within 12 weeks of award; (2) Aircraft Sales Experience, requiring up to five customer references from the past five years detailing similar aircraft sales; (3) Purchase of Existing Boeing 737-400 Aircraft and Spare Parts, requiring an offer (minimum $1) to purchase JPATS' existing 737-400 aircraft and spare parts on an "as-is, where-is" basis, with funds offsetting the new aircraft purchase price; and (4) Price of New Boeing 737-700 or 737-800 Aircraft, completed using the government's required pricing table from Addendum 52.212-2. Offerors may propose either the 737-700 or 737-800 model, with JPATS issuing only one award for one aircraft, though separate submissions for both models are permitted if all required documents are duplicated for each. The Business/Price Proposal cover letter must include contractor name, address, telephone number, CAGE Code, SAM.Gov UEI Number, and be signed by an authorized representative. Offerors must indicate any exceptions to terms and conditions or pricing requirements, and non-small businesses with subcontracting opportunities must submit a small business subcontracting plan targeting 36% Small Business, 5% Small Disadvantaged Business, 5% Women-Owned Small Business, 3% Service-Disabled Veteran-Owned Small Business, and 3% HUBZone participation. Questions must be submitted by April 6, 2026, at 1:00 p.m. CST to the Contract Specialist, Sheila Nimrod, at Sheila.nimrod@usdoj.gov. Proposal validity must extend at least 120 calendar days from the solicitation closing date.

Addendum 52.212-1 Instructions to Offerors – Commercial Items

In the event of conflict this addendum governs.

A. GENERAL.

1. Period of acceptance of offers: 120 days

2. Each Offeror shall submit a written proposal to be considered for the award of a contract.

Each Offeror’s proposal shall be submitted in two (2) separate parts – one entitled "Technical Proposal" and the other entitled "Business/Price Proposal," in accordance with instructions set forth in this section.

3. All communications regarding this solicitation must be directed to the Contracting Officer. Failure to adhere to this instruction may result in elimination from consideration.

4. The proposal shall be prepared simply and economically, providing a straightforward concise description of proposed aircraft. The proposal shall therefore be practical, legible, clear and coherent. In order that evaluation may be accomplished strictly on the merit of material submitted, no pricing information is to be included in the technical proposal.

5. Offerors shall not propose any additional/different CLINs. Offerors may propose both a

737-700 and 737-800 model aircraft, however JPATS will issue only one (1) award for one (1) aircraft.

B. PROPOSED ORGANIZATION AND CONTENT

1. Proposals submitted in response to this solicitation shall be formatted in accordance with the instructions provided in this section. Offerors shall furnish proposals in separately bound volumes as specified below. Each volume shall be complete in order that evaluation of one volume may be accomplished independently of, and concurrently with the evaluation of the others.

2. To aid in evaluation of the proposals, all proposals shall follow a format that mirrors the evaluation factors set forth in the solicitation. Each Offeror shall submit the following number of proposals:

4. Each page within each volume shall be numbered using a consistent numbering scheme.

This scheme shall also be used for all supporting documentation such as charts, figures, etc. included in each volume. This means each attachment, appendix; chart, etc. may be pre-numbered or sequentially numbered within it.
